Sallie Mae Lawsuits

If you want to know just how unhappy consumers are with Sallie Mae, take a look at the number of lawsuits filed against the agency on the Public Access to Court Electronic Records (“PACER”). PACER lists over 5,400 lawsuits involving Sallie Mae throughout the United States, and there are also likely hundreds of claims filed through the American Arbitration Association. Nowadays, most credit card companies have arbitration clauses, which mean that if you have a complaint with a credit card company, you must file your claim in arbitration. Sallie Mae Complaints

The Telephone Consumer Protection Act (TCPA) protects you from robocalls, which are those annoying, automated, recorded calls that computers make all day long. You can tell it’s a robocall because either no one responds on the other end of the line, or there is a delay when you pick up the phone before a live person responds. You can receive $500 per call if Sallie Mae violates the TCPA. Have you received a message from this agency that sounds pre-recorded or cut-off at the beginning or end? These are tell-tale signs that the message is pre-recorded, and if you have these messages on your cell phone, you may have a TCPA case against the agency.

The Electronic Fund Transfer Act (EFTA) protects electronic payments that are deducted from bank accounts. If Sallie Mae took unauthorized deductions from your bank account, you may have an EFTA claim against the agency. Sallie Mae, like most collection agencies, wants to set up recurring payments from consumers; imagine how much money it can earn if hundreds, even thousands, of consumers electronically pay them $50 – $100 or more per month. For example, if you live in California, Florida, Michigan, Montana, North Carolina, Pennsylvania, Texas, or Wisconsin, you may be able to add a state-law claim to your federal law claim above.  North Carolina, for example, has one of the most consumer-friendly statutes in the country: if you live in NC and are harassed over a debt, you may receive $500 – $4,000 in damages per violation.   5. Does the Fair Debt Collection Practices Act apply to banks or credit card companies? No. Only third-party debt collectors are bound by the FDCPA. That is, original creditors, such as credit card companies and banks are not bound by the FDCPA.

I am not in legal trouble with Sallie Mae yet, but I believe it is only a matter of time before I am and I need help understanding my rights. I have an insurmountable level of debt with them that I simply cannot afford. I took these loans out with a cosigner when I was 17 years old, my cosigner has since passed, and I am running out of short term solutions in order to stay in good standing with Sallie Mae. Sallie Mae setup up a plan for my account, then due to internal errors labeled it a default and dinged multiple credit reports (co-signer). I have had a loan with Sallie Mae since 2013. They claim it is a variable rate, however have never provided the documentation supporting this. I almost rear ended homeless making payments to Sallie Mae. They won’t lower my payments on base income and seem to not care to help. I cannot afford paying them over 1,500 dollars monthly. I am also back to school and they have delayed my in school deferment process. They do not care to help or if I go homeless. I barely have any money left on my account right now and have been depressed and stressed out about the situation. Anytime I make a payment, it goes back to owing more and more as the interest continues increasing. It is never ending and they email, daily and call from different numbers harassing me to submit payments. Even though I already spoke to a representative I can’t until next week as I don’t have the money right now and they won’t lower my payments monthly dues.

My husband cosigned for his daughter, sallie mae has called my daughter and his other daughter telling them both about his dept. The daughter on the loan gave them a sob story about she was suppose to get an inheritence that was to pay it so she refusses to pay and now my husband is thinking he needs to sell our harly to get money to pay on this loan. We paid close to $10000 in the beginnig of this year to get her out of default and to make her payment lower but she decided the lower payment was still to much so she again didnt pay. I helped my son take out a loan with sallie Mae in 2020. My aunt was used as a co signer at the time and my son had to drop out for financial reasons out of our control. I just was advised by lawyer advertising that my son and Aunt have a lawsuit against them by a collection company that is representing Sallie Mae. My son is unemployed and my aunt bed ridden with alzheimer\'s. The pandemic has took a role in us all. We have never heard from the lawyers office before this or have still not been advised that we are being sued. Only was aware by the mail from lawyers wanting to represent them. I looked up on line and seen a case open. I was advised this is a tactic they use to not notify so that the judge can rule in their favor. I don’t know what to do. Please help

Last Fall, I took out a Sallie Mae loan to help pay for my college tuition, but I ultimately ended up withdrawing for the semester. I withdrew before my university’s 100% tuition refund period. My university failed to pay Sallie Mae back this loan in full for almost two months. During this time, Sallie Mae harassed me for not making payments on the loan even though it was canceled. I called them and explained the situation. They said they’d take it into account, but they didn’t. Due to this, my credit score has been poorly affected, and I have been rejected from applying to student beginner credit cards. I have no other way to enhance my credit score because I am twenty years old and do not have a credit card.

Sallie mae has been extremely resistant to any of my efforts to settle my loans in a fashion which I can afford. They are constantly changing the amount which I owe, they tell me I am not following the guidelines of payment plans and this results in my total balance to increase even though I had been making payments, they withdraw money on dates I never agreed, directly from my bank account, and they just made my account go overdrawn by 249$ when I had insufficient funds and this was on a date that I never authorized an auto withdrawal, and there is so much more in the past.

Sallie Mae financed my student loans almost ten years ago for a school that went under for a short time, and didn’t allow me to graduate/finish my degree because THE SCHOOL moved me forward without first allowing me to take prerequisite classes. they told me i was unable to graduate and had me leave. i am now 40k in debt and unable to pay my loans almost ten years later. i now have an autism diagnosis, a full-time job, and i still can’t pay these loans. sallie mae is constantly trying to tell me to have my retired mother pay them for me, and that’s just wrong. i want them refinanced or just plain gone. i wasn’t ALLOWED to receive my degree. i shouldn’t have to pay for it.

My mom was able to take $40,000 in loans from sallie mae somehow with not great credit, putting herself as a cosigner, and now is not able to help. sallie mae, despite covid and financial hardship, somehow was able to come up with $400-$600 rmonthly repayment, which i have proof that i cannot afford because it is almost half of my rent, which i can also barely afford. they are trying to take money from me that i don\'t have and won\'t have any grace and their only excuse is that they are a private loan company.

I am about to go into default with Sallie Mae. I just re-enrolled to complete my PhD and since the requirements at the final stages of my degree are ) credit, but still have a finical aspect (this semester I paid close to $7,000) Sallie Mae say I cannot get in school deferment. Hello! I have student loans with Sallie Mae and have tried to reason with them about my payment of $1,500 a month. It’s a ridiculous amount to be paying right out of college and just starting to work. I have called and gotten different answers telling my there are no programs available or if I come out of the program I am in my payment will be much higher. I can not afford it at all. I told them to stop calling me about making a payment and I would pay when I could but they keep calling after I asked them not to. They call me and my co-signer multiple times a day after we asked them not to. It’s ridiculous for people who are trying to survive and make it in this world to have to deal with this. Do you all have any suggestions on how to deal with this? Is there anything to be done to help with this outrageous payment? I’m not saying that I won’t make a payment but this is a bit much and to tell me that they lowered the payment and $1,500 is no where near lowered.
