Consistent Coverage Denial

One of the primary complaints against American Guardian Warranty Services is their refusal to pay for car parts supposedly covered under their warranties. Numerous customers have complained about the company requiring their vehicles to be dismantled only to be refused coverage for every part or service clearly needed as advised and endorsed by professional mechanics.

Confusing Contracts

American Guardian Warranty Services has some of the most confusing terms in their agreements. The company advertises a day-one coverage warranty, which according to some of its own dealers, is a racket as the warranties would normally kick in within 7 to 14 days upon purchase. This has rendered many clients vulnerable due to the gaps in their coverage. Misleading Coverages Customers have reported signing contracts with American Guardian Warranty Services for specific items supposedly covered under their terms but were, ultimately, met with denied claims. According to statements, customers have had to pay higher dues to secure their contracts only to be left disappointed and having to fund their needs out-of-pocket.

Poor Customer Service

Reviews have depicted American Guardian Warranty Services’ hotlines as unresponsive to emergency calls from customers, especially to those asking for help due to car breakdowns. Their customer service has, reportedly, told consumers that the company won’t pay for damages, pinning responsibility for the required repairs on almost all of their clients. This is despite mechanics backing up customers and verifying with American Guardian Warranty Services’ agents that the damages were not due to the customers’ doing. The representatives’ false accusations against its policyholders have resulted in the company refusing coverage for numerous claims.

Unfortunately, these complaints are just the beginning for American Guardian Warranty Services. Between consistent coverage denial, customer service issues, misleading contracts, and other contract issues, American Guardian Warranty Services customers are left wondering what options they have regarding their consumer rights.

Here’s How to Make Big Companies Listen

It can be frustrating when you rely on a service and don’t get the results you’ve paid for. Big companies make mistakes every day and not only is it their fault, but it can also cost you money, time, and leave you with big headaches.

Have you tried calling American Guardian Warranty Services to address an issue, only to be told that the representative has no authority to do so? Or maybe you’ve tried talking to someone higher up in the company, only to be ignored, dismissed, or they take too long, continuing to waste your precious time. Maybe you’ve sent an email to the company which only resulted in a prefabricated response or they never follow through with what they’ve promised.

When you’re limited in your choices for service providers or you’re locked into a contract, what can you do?

Fortunately, you do have options.

Use Arbitration to Settle Your Complaint

Most companies like American Guardian Warranty Services have an arbitration clause in their contracts to prevent being taken to court for traditional litigation. This is actually an advantage for the consumer. When you request an arbitration hearing, an independent third party (the arbitrator) with knowledge of the type of situation involved will listen to the facts from both sides and make an impartial, binding decision. American Guardian Warranty Services will have to do a lot of work and there is no guarantee that they will have a successful outcome.

Arbitration is Fast, Inexpensive, and Private

Arbitration with American Guardian Warranty Services is conducted through the American Arbitration Association (AAA). According to the AAA Consumer Due Process Protocol, arbitration through AAA will comply with their Statement of Principles, which includes:

  • The process is fundamentally fair – All parties are entitled to qualified, competent, impartial arbitrators who will conduct a fair hearing.
  • You get access to all relevant information – This includes reasonable costs, confidentiality, reasonable time limits, and meeting times and/or locations that are agreeable to both parties.
  • Transparency – AAA provides clear arbitration agreements and the ability for each side to hire their own representation.
  • Just process – Arbitration allows the arbitrator to award the same relief as traditional litigation in a binding decision.
  • Alternative to arbitration – Mediation and the ability to take the case to small claims court should be available in some cases.

Arbitration Gives you Control and Leverage

When American Guardian Warranty Services is alerted that you plan to pursue arbitration, they know it will cost them money out of pocket. Not only do they run the risk of losing the case, but they will also pay for their mistake(s) and the arbitration itself. This gives you more leverage with your demands.

If American Guardian Warranty Services doesn’t meet those demands and you have a real complaint, America’s Consumer Lawyer can help by representing you in arbitration where you will get a fair, just, and transparent hearing.

Control and Leverage Triggers Faster Settlements

Large companies like American Guardian Warranty Services don’t like the uncertainty and loss of control that comes with arbitration. Not only do they lose the advantage in the situation, but you’re also on equal footing with them in the eyes of arbitration.

The first step in taking on American Guardian Warranty Services is to formally raise your complaint. The lawyers at America’s Consumer Lawyer can help you to do so. We will send a letter of demands to the corporate offices of American Guardian Warranty Services, letting them know that you’re ready to begin arbitration if a satisfactory resolution is not achieved. Typically, this is 30 days, but it will depend on your specific contract with American Guardian Warranty Services.

Approximately 50% of cases will settle before proceeding to an arbitration hearing during this time. However, if American Guardian Warranty Services doesn’t offer a reasonable settlement within the appropriate time frame, the next step would be filing a case with AAA. America’s Consumer Lawyer will not only put together the necessary paperwork for arbitration, but we will also help you take the next steps in the arbitration process.

UDAAP and Arbitration

UDAAP is an acronym representing laws that prohibit Unfair, Deceptive, or Abusive Acts or Practices in the context of trade or business. This includes misrepresentation, deception, false advertising, or false promises. These laws emerged following the Dodd-Frank Wall Street Reform and Consumer Protection Act that was enacted in response to the 2008 financial crisis. The ultimate goal with these laws is geared towards protecting consumers involved in financial transactions, educating consumers on their rights, and allowing them access to information and resources to best inform their decisions.

UDAAP laws are regulated by two organizations, the Consumer Financial Protection Bureau (CFPB) and the Federal Trade Commission (FTC). The FTC expanded the initial UDAAP laws in 2004 to include unfair and deceptive acts and practices. Some standards for unfairness, in particular, include if it causes or is likely to cause substantial injury to consumers, the injury is not reasonably avoidable by consumers, and the injury is not outweighed by countervailing benefits to consumers or to competition.

Every state has UDAAP laws, which can vary widely. However, the lawyers at America’s Consumer Lawyer understand these laws and can use them to get compensation for deceptive practices, representing consumers throughout the country in cases of arbitration at no cost to them. The company will not only pay the consumer, but they will also pay my fees as well. The consumer will never pay me a cent.

If you’re dealing with an issue with American Guardian Warranty Services, you might try filing a complaint with the BBB or the customer service team with American Guardian Warranty Services. Unfortunately, these avenues won’t always lead to a successful resolution for you, the customer. Instead, you may want to consider an experienced arbitration lawyer to take on your case.

Arbitration is a very useful tool for resolving disputes, and America’s Consumer Lawyer can help. With our expert guidance, we bring the big companies to the table and provide the support needed to get your bills corrected, credit reports fixed, improper fees refunded, and more. Let us pick up the sword for you; you have nothing to lose.

How Do I File a Complaint Against American Guardian Warranty Services?

We will use your state’s UDAAP law to file a complaint in Arbitration on your behalf at no cost to you.  UDAAP laws include misrepresentation, deception, false advertising, or false promises.  Under your state’s UDAAP law, you are likely entitled to money damages for your actual damages.  Plus, the other side will pay our fees and costs.  You will not pay us a penny.

I have AGWS. Ive only had my vehicle for a year and 3 days before the engine went. It went exactly 32 miles the same day I had the oil changed. Ive had the car at 2 mechanics that stayed that I did nothing wrong that there is oil in the engine and it shouldn\'t have died. They asked the 1st machanix.to do a breakdown which ID BE REASONABLE TO PAY so I took the vehicle for a 2nd opinion. They also stated the same them the warrenty denied me because my oil receipts didnt have the mileage on them, again not my fault. So I them went to where I had all my oil changes got updated invoices with receipts and submitted they then reopened the claim. Now its denied because of lack of lube and inconsistent receipts. I called AGWS a d waa told the updated receipts dont show I paid and to send in statements showing I paid. THE RECEIPTS did show I paid and how yet I still sent in my statements with proof. The man at AGWS then said even after the receipts are fixed it still lacks lube. He said my current mechanic stated that the oil waa half full and dirty which means where I took it didnt do the oil change so they are reliable. Well that is 1000000% not true. They did do the oil change right infront of both my daughter\'s and when I spoke to my mechanic he said he NEVER told AGWS that the engine waa half full. He said it was completely full with the exact amount it should\'ve had in it. The warrenty company refuses to do anything and is trying to find anything and everything to deny what should be covered

We spent over 20K on a warranty for our rv with AGWS. I have not even put 6K miles on it, the turbo went out, and coolant has been found in the engine. Now AGWS wants the repair facility to provide them with the reason for the failure. Which basically means they want them to tear it down. After reading all the complaints on AGWS i see that this is a tactic that they use. Once its taken apart, they will take their time to approve the claim, forcing the owners to have it repaired because the repair facility cant keep the rv sitting in the garage for weeks waiting on an approval. What do we do???

Our RV is in the shop for rear bushings. The bushings took over 2 months to find. In early July we dropped it off for the repairs to be done. On July 20th they called for approval. They were also doing an inspection on the front bushings at this time. On July 26th I called to try a push the approval so could use the RV. I was told they could not approve it because they were waiting for the finding of the front bushings. On August 3rd they submitted the front bushing claim. At no point were either of us informed that an inspection would be required. On August 6th they sent an inpector but they had already finished the bushings. He took pictures of the new ones, the hold ones were supposed to be kept but they fell apart upon removal and got discarded. We also submitted photos that I received of the inspection that clearly show the bushings were gone. We also submitted a statement for the shop. They still denied it. After several calls they offered me $1,800 one time if I sign a waiver. The labor is $3,00 plus about $1,400 in parts.
