Billing Errors 

A primary concern for numerous GM Financial customers is their billing discrepancies. Some complaints indicated unreported payments they have religiously paid while others stated receiving varied billing amounts. Customer service was also of no help explaining the breakdown of the charges.

The ultimate goal with these laws is geared towards protecting consumers involved in financial transactions, educating consumers on their rights, and allowing them access to information and resources to best inform their decisions.

UDAAP laws are regulated by two organizations, the Consumer Financial Protection Bureau (CFPB) and the Federal Trade Commission (FTC). The FTC expanded the initial UDAAP laws in 2004 to include unfair and deceptive acts and practices. Some standards for unfairness, in particular, include if it causes or is likely to cause substantial injury to consumers, the injury is not reasonably avoidable by consumers, and the injury is not outweighed by countervailing benefits to consumers or to competition.

Every state has UDAAP laws, which can vary widely. I am in California and have had some financial problems recently. GM Financial has been a complete nightmare and has made my life even worse. After 4 years of making payments and calling to harass me, they informed me that every time my payment is late, not only am I being charged a LATE FEE but I am also charged 2.5% PER DAY in interest. This doesn\'t sound legal and the only reason I found out was because I couldn\'t figure out why my pay-off balance was more than my principal balance and I called to find out. Because of this, they\'ve added approximately $2,000 onto my pay-off amount. This was not stated to me during the purchase of the vehicle and I don\'t see it on my terms in the contract. If my payment is late, they harass me several times a day (Saturdays also) with phone calls and are extremely rude. When I call, they won\'t make any updates to my account or changes until the payments are brought up to date. Sometimes they don\'t add payments I\'ve made to my payment history. ie: I made one large payment once of 3 payments total and it\'s never shown up in my history. When I purchased the car, they tried to tell me I was forced to purchase their wrap-around coverage before I could leave the dealership, even though I had called my insurance and gotten full coverage for he car and they said wrap-around coverage wasn\'t necessary. They added some type of \"Century Service Vehicle Service Agreement\" and \"theft etching\" - which is basically a sticker on the drivers side window that says the car has a theft deterrent (which it doesn\'t have), to my contract that I told them I didn\'t want or need. $1750 for the warranty and $395.00 for the sticker for a grand total of $2,145.00. On my contract it states that my payments would be $307.81 Excluding those 2 items and $350.42 including them. So that means I\'m paying $42.61 additional every month. By my calculations, since I\'ve made 51 payments on the car already, 51 x $42.61 = $2,173.11. So, I\'ve more than paid for the warrantly and the sticker.. I called GM Financial and pointed this out to them and stated that my payments should now be $307.81 and they said, \"No, because you agreed to the payment of $350.42 for 72 months. If this is the case, then why is it pointed out in my contract how much my payments are or will be without those items?? Please send me an email if you think you can help me. Thank you. \"Under California law, the late charge must bear a reasonable relationship to the probable loss of the lender resulting from the late payment.[1] An unreasonable late charge is unenforceable as a penalty that punishes the borrower. California law prohibits punitive damages in contracts.[2] Since the purpose of a late charge is to compensate the lender for any damages suffered due to the late payment, a late charge that is out of line with that compensation is interpreted as existing to punish the borrower for nonperformance and is therefore unenforceable.\"

In April 2021 we leased 2 Chevy Bolt EVs (prior to this we had a 2019 Bolt that was part of an earlier battery fire recall and the car was a buy back under CA Lemon Law - we leased the 2021 Bolts since we were assured by GM that the 2021 model was not affected). In September 2021 GM announced the recall was expanded to 2021 models due to a potential battery fire. We were told not to leave the vehicle in a garage or near buildings until the battery was replaced, as a result of this we were unable to charge the cars and had to leave them on the road. It took 16 months before we received replacement batteries so the vehicles only covered 4,000 miles in 20 months! Our leases are due to be returned in April 2024 and we\'ve asked GM Financial to consider extending the lease to compensate for the fact that 16 of the 36 months the vehicles were not usable but they will only offer a 1 month extension. Do you think i\'d have a good outcome at an arbitration hearing?

I\'m having a problem the billing error with GM Financial. I\'ve sent billing errors notices, call customer service and spoken to supervisor who are no help. I have file complaints with CFPB, BBB, DOJ, my congresswoman in my area. I have tried going to AAA and GM Financial said they don\'t have contract with me so my AAA case was dismissed. They repo my car because of this. I had to file for 13 bankruptcy to get my car back. I just need to some help,

They are suing me for a deficiency when I had long term COVID under undue influence my caregiver got me to sign a truck in his name against my wlll. He wreaked it never paid as he said I volunterry surrender it in Feb I wasn\'t able to pay I had wrote bbb consumer affairs and the attorney general and nothing
