Numerous customers have left reviews about defective cellular phones that have malfunctioned a week after delivery or upon receipt. Replacements were also reportedly defective. The company refused refund requests from customers despite being under the warranty.

False Advertisements

Other complaints mentioned Consumer Cellular, Incorporated offered a free trial for a month with free cancellation; however, a customer recounted that upon canceling on the 28th day, the company still charged the consumer.

Delivery Issue

Customers also complained about products bought from the company that they didn’t receive. Apparently, ordered phones were lost in transit, sent to the wrong addresses, or were simply left undispatched. Representatives also refused to answer the customers demanding refunds.

Here’s How to Make Big Companies Listen

It can be frustrating when you rely on a service and don’t get the results you’ve paid for. Big companies make mistakes every day and not only is it their fault, but it can also cost you money, time, and leave you with big headaches.

Have you tried calling Consumer Cellular, Incorporated to address an issue, only to be told that the representative has no authority to do so? Or maybe you’ve tried talking to someone higher up in the company, only to be ignored, dismissed, or they take too long, continuing to waste your precious time. Maybe you’ve sent an email to the company which only resulted in a prefabricated response or they never follow through with what they’ve promised.

When you’re limited in your choices for service providers or you’re locked into a contract, what can you do?

Fortunately, you do have options.

Use Arbitration to Settle Your Complaint

Most companies like Consumer Cellular, Incorporated have an arbitration clause in their contracts to prevent being taken to court for traditional litigation. This is actually an advantage for the consumer. When you request an arbitration hearing, an independent third-party (the arbitrator) with knowledge of the type of situation involved will listen to the facts from both sides and make an impartial, binding decision. Consumer Cellular, Incorporated will have to do a lot of work and there is no guarantee that they will have a successful outcome.

Arbitration is Fast, Inexpensive, and Private

Arbitration with Consumer Cellular, Incorporated is conducted through the American Arbitration Association (AAA). According to the AAA Consumer Due Process Protocol, arbitration through AAA will comply with their Statement of Principles, which includes:

  • The process is fundamentally fair – All parties are entitled to qualified, competent, impartial arbitrators who will conduct a fair hearing.
  • You get access to all relevant information – This includes reasonable costs, confidentiality, reasonable time limits, and meeting times and/or locations that are agreeable to both parties.
  • Transparency – AAA provides clear arbitration agreements and the ability for each side to hire their own representation.
  • Just process – Arbitration allows the arbitrator to award the same relief as traditional litigation in a binding decision.
  • Alternative to arbitration – Mediation and the ability to take the case to small claims court should be available in some cases.

Arbitration Gives you Control and Leverage

When Consumer Cellular, Incorporated is alerted that you plan to pursue arbitration, they know it will cost them money out of pocket. Not only do they run the risk of losing the case, but they will also pay for their mistake(s) and the arbitration itself. This gives you more leverage with your demands.

If Consumer Cellular, Incorporated doesn’t meet those demands and you have a real complaint, America’s Consumer Lawyer can help by representing you in arbitration where you will get a fair, just, and transparent hearing.

Control and Leverage Triggers Faster Settlements

Large companies like Consumer Cellular, Incorporated don’t like the uncertainty and loss of control that comes with arbitration. Not only do they lose the advantage in the situation, but you’re also on equal footing with them in the eyes of arbitration.

The first step in taking on Consumer Cellular, Incorporated is to formally raise your complaint. The lawyers at America’s Consumer Lawyer can help you to do so. We will send a letter of demands to the corporate offices of Consumer Cellular, Incorporated, letting them know that you’re ready to begin arbitration if a satisfactory resolution is not achieved. Typically, this is 30 days, but it will depend on your specific contract with Consumer Cellular, Incorporated.

Approximately 50% of cases will settle before proceeding to an arbitration hearing during this time. However, if Consumer Cellular, Incorporated doesn’t offer a reasonable settlement within the appropriate time frame, the next step would be filing a case with AAA. America’s Consumer Lawyer will not only put together the necessary paperwork for arbitration, but we will also help you take the next steps in the arbitration process.

UDAAP and Arbitration

UDAAP is an acronym representing laws that prohibit Unfair, Deceptive, or Abusive Acts or Practices in the context of trade or business. This includes misrepresentation, deception, false advertising, or false promises. These laws emerged following the Dodd-Frank Wall Street Reform and Consumer Protection Act that was enacted in response to the 2008 financial crisis. The ultimate goal with these laws is geared towards protecting consumers involved in financial transactions, educating consumers on their rights, and allowing them access to information and resources to best inform their decisions.

UDAAP laws are regulated by two organizations, the Consumer Financial Protection Bureau (CFPB) and the Federal Trade Commission (FTC). The FTC expanded the initial UDAAP laws in 2004 to include unfair and deceptive acts and practices. Some standards for unfairness, in particular, include if it causes or is likely to cause substantial injury to consumers, the injury is not reasonably avoidable by consumers, and the injury is not outweighed by countervailing benefits to consumers or to competition.

Every state has UDAAP laws, which can vary widely. However, the lawyers at America’s Consumer Lawyer understand these laws and can use them to get compensation for deceptive practices, representing consumers throughout the country in cases of arbitration at no cost to them. The company will not only pay the consumer, but they will also pay my fees as well. The consumer will never pay me a cent.

If you’re dealing with an issue with Consumer Cellular, Incorporated, you might try filing a complaint with the BBB or the customer service team with Consumer Cellular, Incorporated. Unfortunately, these avenues won’t always lead to a successful resolution for you, the customer. Instead, you may want to consider an experienced arbitration lawyer to take on your case.

Arbitration is a very useful tool for resolving disputes, and America’s Consumer Lawyer can help. With our expert guidance, we bring the big companies to the table and provide the support needed to get your bills corrected, credit reports fixed, improper fees refunded, and more. Let us pick up the sword for you; you have nothing to lose.

Consumer Cellular allowed fraud to happen on my deceased mother\'s cell phone account when I had closed it and received confirmation due to fraud and Consumer Cellular allowed a family member who stole her phone, re-activate account, change all security account information to access my mother\'s bank accounts by her phone.

I was threatened by a consumer cellular employee, I have the voicemail recording, who threatened to steal my identity and do anything they wanted with it, all the while cursing at me. I did not intimidate or respond to his voicemail but instead I called consumer cellular and spoke with a supervisor and explained the problem and playing the voicemail for them. They escalated the issue to a higher up who called me back 2 days later after they compared the voice recordings and stated the employee was properly dealt with but would not give me further details. I asked for the persons name and where they lived but they stated that was confidential. I stated I do not feel safe now and not secure anymore. I froze my credit at all 3 agencies, paid a $400+ subscription to LifeLock to help secure possible retaliation. I filed a police report, filed a complaint with FTC and FBI as well. Less than 2 weeks later my router, personal computer, my cell phones, and every device on my home network were compromised doing significant damage to my security and financial well being. My credit cards were falsely charged, my email passwords and all my accounts passwords were changed. My wife and I had to buy new phones and changed my carrier to ATT. I replaced my router and wiped my computer and lost a lot of information that I can’t restore due to possible data compromise. Our phone calls were rerouted to other numbers. For example, when I called my internet provider it went to the hackers numbers where they attempted to fake me out with their own means to mislead me. When I called the 3 credit agencies I was rerouted to Medicare instead. My wife and I are elderly and this event has cost us dearly emotionally and we feel paranoid and untrusting of everything around us. We lost 32K from our checking accounts and are looking to be refunded for all of this. We are very emotionally distressed have gone through all of this in the last 3 weeks and are looking for assistance here. There are more details I have not explained since it is hard to detail here but I have a police report that explains everything that happened up until we filed it. I have spoken to consumer cellular but they only want more and more details even after forwarding them a copy of the police report! The details of all of that happened are not detailed in the report without further investigation. I told consumer cellular I want what money I lost and I expected to be refunded promptly, within a week but I have not received any further response from them. I told them I will turn this over to others I trust because we are elderly and this has upset us greatly and we cannot continue down this path of them just pursuing even more information. My wife and I just returned from the social security office today. I explained the situation to them, stating my identity has been stolen and they asked that we come down to their office after making an appointment to do so.

How are you doing? My mother and I jumped on Consumer Cellular through her AARP membership that claimed that the first month was free and that she\'d be able to cancel any time within the 30 day period at no cost. Regrettably, it was a total waste of time, and now a current headache. We \"used\" their service for about 4-5 days. And I\'m using quotation marks because we didn\'t get to use their service much. Couldn\'t make phone calls, couldn\'t text, despite it was \"unlimited everything.\" The internet was severely slow or it would just disconnect. The phone device that my mother bought was returned within 3 days, received a full refund. I bought a phone for my mother elsewhere thinking it would fix the issues, unfortunately it didn\'t. Still a very mediocre phone connection. We cancelled service over the phone on the 5th day. The operator we spoke to claimed we\'d only pay $6 for the 5-day \"service\" ...despite \"first month is free.\" I just wanted it all to end so I stupidly didn\'t fight that off. Anyway, I received the email confirming the termination, along with another email stating the $6 to pay. Months later they are still charging as if the account still exists. Gave them a call, and the operator in that call claimed that the previous phone call \"never took place\" because he \"couldn\'t find it\" and furthered said that phone call wasn\'t \"registered in their system.\" The sleaze still attempted for me to pay up. They call my number daily, they continue sending me bills that specify absolutely nothing. They are now threatening my mother with forwarding her to collections {PCS|Professional Credit Services}. I checked her credit report status through CreditKarma, and it doesn\'t show anything about her being behind any payments or owing anything other than her regular banking credit card account. At this point it seems like fraud to try and collect money, which would be illegal. The constant harassing calls and threatening I believe are illegal as well. I feel like they target and pry seniors for their money. I can email you screenshots of emails and receipts if you\'d need me to. I\'d like this madness with Scammer Cellular to end! I\'m so annoyed I don\'t even want to pay those $6.

Received two replacement phones; both were defective. Canceled service after receiving two phones that didn\'t work.
