Unsympathetic to Consumers 

Complaints and reviews on Discover Bank showed that the financial service giant, despite customer loyalty, had no remorse suing consumers, randomly closing down accounts, and flat out refusing any alternative payment plans during a state emergency like Covid-19. Many of the bank’s consumers impacted by the pandemic had asked to take other payment options or had to defer payments after the massive layoffs and medical emergencies but were met with stern nos by closing their accounts without notice, reporting to credit bureaus, or suing. 

Sudden Accounts Closing/Restrictions

Numerous other complaints cited Discover Bank’s abrupt accounts restriction or closing. Even complainants current with their payments had their accounts closed for no reason and with the bank refusing to provide one upon contact. This has negatively affected many of the consumers’ credit scores. 

Deficient Notifications 

Prior to closing consumers’ accounts or reporting them to credit bureaus, Discover Bank had apparently failed to notify consumers of existing debts or charges. This is despite some of the complainants having paid off their accounts in full or in a timely manner. According to the complaints and reviews, the trouble could have been avoided had Discover Bank provided billing statements and other notices timely. 

Fraud Charges 

Other accounts recounted having their accounts charged for products they never ordered or bought. Even with proof of fraudulent activity, the bank refused to close the accounts and refund the charges.

UDAAP laws are regulated by two organizations, the Consumer Financial Protection Bureau (CFPB) and the Federal Trade Commission (FTC). The FTC expanded the initial UDAAP laws in 2004 to include unfair and deceptive acts and practices. Some standards for unfairness, in particular, include if it causes or is likely to cause substantial injury to consumers, the injury is not reasonably avoidable by consumers, and the injury is not outweighed by countervailing benefits to consumers or to competition.
