Unreleased Deeds of Trust

UDAAP laws are regulated by two organizations, the Consumer Financial Protection Bureau (CFPB) and the Federal Trade Commission (FTC). The FTC expanded the initial UDAAP laws in 2004 to include unfair and deceptive acts and practices. Some standards for unfairness, in particular, include if it causes or is likely to cause substantial injury to consumers, the injury is not reasonably avoidable by consumers, and the injury is not outweighed by countervailing benefits to consumers or to competition.

LLC claiming to represent a Hoa in which turn apartment into separate condominium was torn down 2011 was bought in 2009 never admitted to having a Hoa City charge owner for demolition and after 14 with no citations and only one paid taxes took land possession of land

I bought my farm in 2019. I had the land surveyed and paid Fidelity for Title insurance. I ended up in a land dispute with the buyer of the property to my east. Fidelity did not research the title back to the hundred year marker. I have been paying taxes, lost my fence and hostile take over of my property. Fidelity appointed a lawyer that did nothing to clear the title but offered a settlement of $6K. Due to their negligence, I almost lost my license to practice dentistry. My husband has been run out of the state and I could not attend any of my son’s football games. I have spent over $250K defending my family due to the negligence of Fidelity. If Setco and Fidelity had done their job, my life would be different. Through the lawsuit, I continued to pay takes and attorney’s fees. They now want to settle. My name is Jason Heritz and I am in the process of contacting several law firms regarding numerous issues my Stepfather and I have experienced with Fidelity National Title in Mishawaka, IN. My Stepfather and I had a closing scheduled at Fidelity National Title. Fidelity Canceled and rescheduled our closing at least 3 times. We were told the closing was canceled and rescheduled due to the buyers drivers license being expired. However when I spoke with the buyers after the closing they thought my Stepfather and I had canceled and rescheduled the closing. Prior to the last rescheduled closing date Fidelity reported they discovered a Mechanics Lien had been placed on our property in the sum of $50,000. It turns out the Mechanics Lien was filed a couple weeks prior to our first scheduled closing date by an associate of Edward Hardig Jr. VP of North Central Indiana Operations Manager and Counsel for Fidelity National Title. This persons name is Steve Kollar. It is important to note that Steve Kollar had been placed in prison twice for numerous charges including fraud. It is also critical to note Meridian Title will not work with Steve Kollar or even work with properties Steve Kollar has been involved with. While sitting in the waiting area/lobby at Fidelity National Title. An employee named Elizabeth Housand came into the lobby area and announced to everyone in the lobby and our realtor Patty Baba that Steve Kollar had been contacting her all morning about his $50,000. My Stepfather nor I have any idea why Elizabeth would be discussing our confidential closing with Steve Kollar and we have no idea why Steve Kollar knew we were even closing on that date. After Elizabeth made this loud and unprofessional announcement to anyone sitting in the lobby our realtor Patty Baba got up from her chair, approached Elizabeth and led her down the hallway away from my Stepfather and I. When we were called back to sign closing documents my Stepfather felt the right way to handle the Lien and closing was to proceed with the closing and allow Fidelity to place $50,000 in escrow until we were able to address the Mechanics Lien. The mechanics lien was later dismissed twice by Judge Gammage in St. Joseph County Superior Court. After my Stepfather insisted we proceed with the closing so the new buyers would receive their new home Fidelity then insisted my Stepfather place an additional $25,000 in escrow. I would also like to report that when I reviewed the preclosing documents it showed that Steve Kollar had deeded over this property to my Stepfather twice within 2 weeks with 2 different LLC’s one of which did not even own the property being deeded to my Stepfather. This is just a couple examples of the issues we experienced as a result of working with Fidelity National Title and Edward W. Fidelity aided and abetted a scheme spanning over a number of years by systematically disposing of all real property owned by my ex husband and myself as joint tenants. The ways in which they accomplished this included in part, executing and recording false documents, fictitious deeds, using straw buyers, falsifying defaults etc.. for our commercial and residential properties. All properties today are unilaterally owned solely by my ex husband. The parties involved are long time business associates and friends of my ex, who have worked for fidelity national title company for many years and clearly well versed in this type of business practice. The parties involved are primarily located in the Los Angeles area Sherman oaks and surrounding cities. I am currently in the process of filing a civil suit, (in pro se), against all involved for causing me financial harm in the millions by their various unconscionable schemes. I have a legitimate claim in for attorney fees in a lawsuit filed in court, and Fidelity title insurance refuses to honor the title insurance that was offered to me. Fidelity admits that they failed on putting the correct information in my title insurance. They have since corrected it and continue to deny me funds to cover my lawsuit.
