Membership Cancellation Issues 

At the height of the pandemic, members of Fitness International, LLC reported being charged despite the company’s closed facilities. Others who have canceled their memberships entirely also reported the same issue. This was exacerbated by the company’s customer service.

Dear Bill, Thank you for your longtime patronage and your service. I understand your frustration, and we relocated your membership twice because of previous incidents involving you and our staff members. My staff does not feel safe right now, and it is my duty and responsibility to fix that. At this time, we have decided the best course of action is to cancel your membership. I have been with my Wife for 41 Years this June, and I have been a member of LA Fitness since 1995 and have traveled across the United States using LA Fitness Facilities without ever any issues. Below I will summarize my complaint with the events that happened on this date, Monday, January 22, 2024, please note that this is the 3rd time I have brought this to the attention of LA Fitness/Esporta and every time it has fell upon deaf ears and turned around as I did something wrong. On this date Monday, January 22, 2024, at approximately 0910 Hrs. I went to the Front Desk and spoke to Alexis at the Front Operations Desk and told her that there was a Black Female in the Men’s Room cleaning while other Men were in there with no cloths on including myself, the Female I am referring to I believe her name is Reva, LA FITNESS/ESPORTA Janitor. As I entered the Men’s Locker Room from the Swimming Pool Area there were No Signs informing me that there was a Female in our Men’s Locker Room, please refer to Exhibit#2. I went to the Sauna and then to the Shower, as I opened the Shower Curtain to get my towel, I had no cloths on and Reva the Janitor seen me with no cloths on, I felt very violated. I said to her that I do not think she should be in our locker room, and she cursed at me and said it is not any of my F-ing GD Business, I then said to her that she should not be speaking to me that way. I was very shocked that she spoke to me this way because I have always complimented on her hard work in the gym area outside the Men’s Locker Rooms. I told Alexis what had happened, and I was very professional with her, I asked to speak with the Manager who is Ashley Davis, and I was told the GM is Dautyn Dodd, Alexis said that they would be in at 0900 Hrs. and wrote their names down for me on a piece of paper. As I was talking with her there was an older man that was talking to her which was in the Men’s room at the time the incident happened. I have seen him before and really do not care to speak to him because he is always talking about Politics and in my opinion a very negative person, I do not care to speak with him and have in the past asked him not to talk to me. I asked the man talking to Alexis what he was saying about me, and he said I cornered Reva and took pictures of her in the Men’s Room, I told him that is not true. Please see Exhibit #2, I was on the other side of the Door in the Toilet Area when I took these pictures, the Man that I am referring to I am told is a witness that wasn’t even in the same room as me, he was in the Locker Room Area and I was I the Toilet Area, he couldn’t have seen the incident or heard what was said. After the incident as I was dressing, I informed him what had happened and he said that he didn’t see anything wrong with Reva in the Men’s Locker Room while Men are naked, I respectfully disagreed with him, and he didn’t like it and then started to argue with me, and I ignored him and left the Locker Room to finish my workout. After this I continued my workout and at approximately 0910 Hrs. I went to the Front Desk, Alexis and Ashley were present, we had a civil conversation and Ashley said that she is going to try and post additional signage. I respectfully told her that is not good enough and that something like this should never happen and that it is wrong. Ashley went on to say that this a California based Company and things are different now, it is 2024 and that there are LGBTQ’s that probably go into the Locker Rooms, and we don’t even know, I told her I never have seen this before and I told her that LA Fitness is violating Arizona Laws that protect these kinds of incidents from happening that are inappropriate, that is why there is a Men’s & Women’s Locker Room. Ashley went onto say that LA Fitness is Short Staffed and that is why Men work in Women’s Locker Rooms and Women work in Men’s Locker Rooms at times. I told Ashley that having Men working in Women’s Locker Rooms and Women’s working in Men’s Locker Rooms is inappropriate and we left it at that. Ashley told me that a complaint was filed against me and that I would be hearing from Corporate LA Fitness. After I returned home, I received a call from Nick Brown at about 10:30am who I have talked to in the past about this same issue, Nick was very pleasant, and we had a good conversation. I explained to Nick what had happened, and he recommended that I document what had happened and email It to LA Fitness. Nick said that Reva said I called her a Black B, that is not true, I don’t even curse or would say anything like that, Reva is not being honest, and I resent what she is accusing me of. Some of my best friends are black, and I have served with many black men in Kuwait and Afghanistan which are my Brothers and they as I would lay down my Life for them, in my opinion Reva is concerned that this matter will escalate, and she could lose her job. I also mentioned that I have observed Reva talking on the Head Sets she wears around the gym when she is cleaning using inappropriate language while talking on the phone through them. Nick said that he is cancelling my Membership and will be getting back to me, I asked him to reconsider and he said that it has happened 3 other times and that indicates that there is a problem, yes there is and it is the SOP’s, Standard Operating Procedures LA Fitness has allowing inconsiderate unethical behavior in it’s Gyms such as Men working in Women’s Locker Rooms and Women working in Men’s Locker Rooms while Members have no clothing on. Then of all things turning the inappropriate situation around as though it is my fault, I am the one that has been violated and accused of something I did not do. Nick called me back later in the afternoon and I couldn’t really talk because I was at the Hospital while my Wife was having surgery. Nick was very professional and did say that after 1 year lets revisit this and he would consider me being a member again. I informed Nick that LA Fitness is in Violation of CODES / ARIZONA / TITLE 13. CRIMINAL CODE Arizona Revised Statutes Title 13. Criminal Code § 13-3019. Surreptitious photographing, videotaping, filming or digitally recording or viewing;  exemptions; classification;  definitions Current as of March 08, 2022. A. It is unlawful for any person to knowingly photograph, videotape, film, digitally record or by any other means secretly view, with or without a device, another person without that person\'s consent under either of the following circumstances: 1. In a restroom, bathroom, locker room, bedroom, or other location where the person has a reasonable expectation of privacy and the person is urinating, defecating, dressing, undressing, nude or involved in sexual intercourse or sexual contact. 2. In a manner that directly or indirectly captures or allows the viewing of the person\'s genitalia, buttock, or female breast, whether clothed or unclothed, that is not otherwise visible to the public. Is it LA Fitness/Esporta SOP’s, Standard Operating Procedure to think that it’s perfectly fine for men to have their genitals exposed to women in a male-only area? This is absolutely NOT the same thing as a cleaning-lady coming in and closing off the room with clearly visible signs while she cleans the room. The men’s locker room was already in use with naked men and me inside when Reva entered. Therefore, I must surmise that this happens much more frequently than just the times that I happened to be there, I have several LA Fitness Members that will come forward in my defense regarding this matter. It is unethical that LA Fitness/Esporta actually permits this and thinks that this is perfectly acceptable, this is Not California. This is absolutely not acceptable. This is a violation of privacy. This practice must stop. I do not consent to this, I feel violated. Even writing this is giving me much anxiety, and the fact that Reva the Janitor has accused me of a frivolous allegation. I thought that LA Fitness/Esports was supposed to be a safe zone, but I guess that doesn’t include the men’s locker rooms. This event today has made me feel incredibly uncomfortable, which completely defeats the purpose of even having separate locker rooms for men and women. The men’s locker room is clearly labeled. There should be no women inside for any reason, whether it’s staff or public – especially during regular hours while naked men are occupying the room. Imagine if the roles were reversed – Male LA Fitness/Esporta Staff members entering the women’s locker room while naked women are inside. Or if a man decides to go in to retrieve a girlfriend’s belonging for her. There would be an uproar; those men would find themselves in trouble with Arizona Law Enforcement. Yet, it’s perfectly fine for a female staff member to do the same thing in the men’s locker room. Or worse, what happens if a naked man in the men’s locker room decides to inappropriately approach one of these female staff members – while she’s only in there to retrieve supplies? There is clearly a double-standard going on here. There are only two solutions here: 1. only male staff members should be permitted inside the men’s locker room for any reason, or 2. move the contents of the storage closet outside the men’s locker room (while retaining a policy that only permits men inside the men’s locker room). In closing I am requesting that my LA Fitness Membership be reinstated. My Wife and I have been Members since 1995 and my Wife and I attend the Gym together. If I am not reinstated, I will be taking this matter to our Arizona Senators for resolution and our Insurance Company Human Silver Sneakers who pay for our Membership. I went to the Mens locker room to change into my swimming trunks to go swimming, please note there was not a sign at the entrance of the Mens Locker Room or any women cleaning when I entered. After swimming I entered the Mens Locker Room from the pool area to shower. After my shower I entered the “Mens Locker Room area “without clothing on and there was a woman cleaning in the “Mens Locker Room” and she looked at me without clothing on and then turned around and started cleaning again in the sink area which is visibly seen from the lockers were we change, as a result of this I felt violated, and I was angry, even writing this letter is giving me much anxiety, this is a violation of privacy. This has actually happened before but at another location, Power Road ESPORTA in Queen Creek, Arizona, and I complained but the matter fell upon deaf ears. It’s as if ESPORTA Manager’s thinks that it’s perfectly fine for men and young adult men to have their genitals exposed to women in a male-only area. The men’s locker room is clearly labeled. There should be no women inside for any reason, whether it’s staff or public especially during regular hours while naked men and young men and boys are occupying the room. There were several men inside the men’s locker room at the time, changing and also showering naked. After dressing I walked to the front desk to complain I spoke to a man there and explained to him the situation, I do not know the name of the person I complained to, I asked to speak with the Manager. I introduced myself to the manager, which I would later find out from the Gilbert, AZ Police that his name is Lupe Felix, at the time of my conversation I did not know his name. I explained to Lupe the situation and that I felt violated and that this matter is a violation of my privacy and when I asked him for his name, he would not give it to me, I asked for the phone number of ESPORTA, and he would not give it to me he said that I could get his name and number of Corporate ESPORTA Monday. The Manager said that it was perfectly alright to have Women Janitors in the Mens Locker Room cleaning when Men and young Men and Boys are without their clothes on. The conversation escalated and angered me but remained civil in my opinion, but the Manager seemed to be aggravated because I continued to talk to him about the situation and I told him I was going to write a complaint against him. The Manager said I threatened him and that he was going to call the Police, I also called the Gilbert Police. He also said he was banning me from ESPORTA and pulling my Membership for Life. After the Police arrived, I walked outside to meet with them, I met with Officer’s Tommy and Steve, Tommy was the Officer who communicated with the Manager and I separately. The Manager filed a Trespass Complaint against me, please see the attached. The Officer told me that Lupe said that I made Racial remarks to him, this is not true I wouldn’t do that, The Officer Tommy also told me the Manager said there was a complaint about me at another ESPORTA, this is not true either, however I did complain about Human Feces being in the Mens Sauna, let me explain. Just before Christmas of 2022 I was working out at the ESPORTA located at 7225 S Power Rd Bldg. A, Queen Creek, AZ 85142, Phone: (480) 988-6262. As I and other members were in the Sauna, we noticed that their “Human Feces” on the floor by the Sauna regulator that was dried up, I took pictures of this and brought it to the front desk for them to view and I was informed that they would take care of the matter. Then in January of 2023 I was at the same location and the “Human Feces” was still present in the Sauna that was dried up in the same location as it was back in December of 2022 when I complained. I took pictures and brought them to the front desk where there was a young women working and I informed her of this matter, my voice is very deep and she thought I was yelling at her in which I was not, this must of offended her and perhaps she noted this in the log of ESPORTA and that is what Officer Tommy was talking about when he said Lupe said there was a complaint about me at another ESPORTA and that is why he is filing a “No Tress Pass” against me. I called the Corporate Office of LA Fitness and spoke to someone, I don’t know their name and explained to them the situation. I was informed to file a complaint with the pictures. I didn’t follow through as Life is busy enough for me and I have my Wife of 40 Year battling Breast Cancer. This event made me feel incredibly uncomfortable, as well as embarrassed which completely defeats the purpose of even having separate locker rooms for men and women. The men’s locker room is clearly labeled. There should be no women inside for any reason, whether it’s staff or public especially during regular hours while naked men are occupying the room. Imagine if the roles were reversed, Male or Staff Members entering the Women’s locker room while naked women are inside. There would be an uproar; those men would find themselves in trouble with law enforcement. Yet, it’s perfectly fine for a female staff member to do the same thing in the men’s locker room. Or worse, what happens if a naked man in the men’s locker room decides to inappropriately approach one of these female staff members such as the women Janitor while they are the only two in the locker room, now this is a Safety Matter which could potentially be an OSHA, Law Enforcement matter and Civil Litigation. There is clearly a double standard going on here. The only solution here is to only have Male staff members permitted inside the men’s locker room for any reason. I do not want the Manager terminated for his behavior; however, this matter should be used as a training tool for sensitivity on how ESPORTA Club Employees treat and speak to Club Member Customers about any concerns they may have. When I asked the Manager for his name and information on how to file a complaint against him for his inability to speak with me professionally about this situation at hand, he should have given me the information I asked for without confrontation and this matter would have not escalated in my opinion. If the Manager would have spoken to me respectfully, I would not be writing this letter. In closing I apologize for any inconvenience that this matter has caused and at 65 even I have learned something from this situation. I should have tabled the issue and left the gym and filed my complaint as I am now. I hope the Manager Lupe Felix has also learned something from this. I am not the kind of guy that goes to social media to solve issues I have with anyone; my Father and the Military taught me to go straight to the source of the problem and try to settle matters then if nothing is resolved fly it up the Flagpole for resolution and this is what I am doing now. I could have filed a complaint with the Gilbert Police Department, but I didn’t. I am respectfully asking that the “No Tress Pass” the Manager Lupe Felix filed with the Gilbert, AZ Police be rescinded. In addition, I hope this matter will encourage Policy Changes respecting the privacy of Club Members and their Families. CC: L. Louis Welch. I was sold towel service as a part of the contract and that was never given. On the contrary, I was harassed, misbehaved with and my membership was terminated and I was rudely asked to leave the premises. All of that was recorded on the camera, all because I told them that have breached their contract and FTC guidelines.
