Here’s How to Make Big Companies Listen

It can be frustrating when you rely on a service and don’t get the results you’ve paid for. Big companies make mistakes every day and not only is it their fault, but it can also cost you money, time, and leave you with big headaches.

Have you tried calling FlexShopper, LLC to address an issue, only to be told that the representative has no authority to do so? Or maybe you’ve tried talking to someone higher up in the company, only to be ignored, dismissed, or they take too long, continuing to waste your precious time. Maybe you’ve sent an email to the company which only resulted in a prefabricated response or they never follow through with what they’ve promised.

When you’re limited in your choices for service providers or you’re locked into a contract, what can you do?

Fortunately, you do have options.

Use Arbitration to Settle Your Complaint

Most companies like FlexShopper, LLC have an arbitration clause in their contracts to prevent being taken to court for traditional litigation. This is actually an advantage for the consumer. When you request an arbitration hearing, an independent third party (the arbitrator) with knowledge of the type of situation involved will listen to the facts from both sides and make an impartial, binding decision. FlexShopper, LLC will have to do a lot of work and there is no guarantee that they will have a successful outcome.

Arbitration is Fast, Inexpensive, and Private

Arbitration with FlexShopper, LLC is conducted through the American Arbitration Association (AAA). According to the AAA Consumer Due Process Protocol, arbitration through AAA will comply with their Statement of Principles, which includes:

  • The process is fundamentally fair – All parties are entitled to qualified, competent, impartial arbitrators who will conduct a fair hearing.
  • You get access to all relevant information – This includes reasonable costs, confidentiality, reasonable time limits, and meeting times and/or locations that are agreeable to both parties.
  • Transparency – AAA provides clear arbitration agreements and the ability for each side to hire their own representation.
  • Just process – Arbitration allows the arbitrator to award the same relief as traditional litigation in a binding decision.
  • Alternative to arbitration – Mediation and the ability to take the case to small claims court should be available in some cases.

Arbitration Gives you Control and Leverage

When FlexShopper, LLC is alerted that you plan to pursue arbitration, they know it will cost them money out of pocket. Not only do they run the risk of losing the case, but they will also pay for their mistake(s) and the arbitration itself. This gives you more leverage with your demands.

If FlexShopper, LLC doesn’t meet those demands and you have a real complaint, Mike Agruss Law can help by representing you in arbitration where you will get a fair, just, and transparent hearing.

Control and Leverage Triggers Faster Settlements

Large companies like FlexShopper, LLC don’t like the uncertainty and loss of control that comes with arbitration. Not only do they lose the advantage in the situation, but you’re also on equal footing with them in the eyes of arbitration.

The first step in taking on FlexShopper, LLC is to formally raise your complaint. The lawyers at Mike Agruss Law can help you to do so. We will send a letter of demands to the corporate offices of FlexShopper, LLC, letting them know that you’re ready to begin arbitration if a satisfactory resolution is not achieved. Typically, this is 30 days, but it will depend on your specific contract with FlexShopper, LLC.

Approximately 50% of cases will settle before proceeding to an arbitration hearing during this time. However, if FlexShopper, LLC doesn’t offer a reasonable settlement within the appropriate time frame, the next step would be filing a case with AAA. Mike Agruss Law will not only put together the necessary paperwork for arbitration, but we will also help you take the next steps in the arbitration process.

UDAAP and Arbitration

UDAAP is an acronym representing laws that prohibit Unfair, Deceptive, or Abusive Acts or Practices in the context of trade or business. This includes misrepresentation, deception, false advertising, or false promises. These laws emerged following the Dodd-Frank Wall Street Reform and Consumer Protection Act that was enacted in response to the 2008 financial crisis. The ultimate goal with these laws is geared towards protecting consumers involved in financial transactions, educating consumers on their rights, and allowing them access to information and resources to best inform their decisions.

UDAAP laws are regulated by two organizations, the Consumer Financial Protection Bureau (CFPB) and the Federal Trade Commission (FTC). The FTC expanded the initial UDAAP laws in 2004 to include unfair and deceptive acts and practices. Some standards for unfairness, in particular, include if it causes or is likely to cause substantial injury to consumers, the injury is not reasonably avoidable by consumers, and the injury is not outweighed by countervailing benefits to consumers or to competition.

Every state has UDAAP laws, which can vary widely. However, the lawyers at Mike Agruss Law understand these laws and can use them to get compensation for deceptive practices, representing consumers throughout the country in cases of arbitration at no cost to them. The company will not only pay the consumer, but they will also pay my fees as well. The consumer will never pay me a cent.

If you’re dealing with an issue with FlexShopper, LLC, you might try filing a complaint with the BBB or the customer service team with FlexShopper, LLC. Unfortunately, these avenues won’t always lead to a successful resolution for you, the customer. Instead, you may want to consider an experienced arbitration lawyer to take on your case.

Arbitration is a very useful tool for resolving disputes, and Mike Agruss Law can help. With our expert guidance, we bring the big companies to the table and provide the support needed to get your bills corrected, credit reports fixed, improper fees refunded, and more. Let us pick up the sword for you; you have nothing to lose.

How Do I File a Complaint Against FlexShopper, LLC?

We will use your state’s UDAAP law to file a complaint in Arbitration on your behalf at no cost to you. UDAAP laws include misrepresentation, deception, false advertising, or false promises. Under your state’s UDAAP law, you are likely entitled to money damages for your actual damages.  Plus, the other side will pay our fees and costs.  You will not pay us a penny.

I started with flexshopper in 2021-2022, I was paying religiously and on time every single week and then they stopped taking payments and then decided to charge me a lot of interest, when I called to make payment arrangements again they were trying to charge me way more and have still collected interest on my flexshopper account. It has been in collections and just received a text today stating if I didn’t call them and return “rental property” I’d avoid non complaisance and escalation. They haven’t got in touch with me in a very long time, I tried making arrangements and they didn’t like those arrangements and have charged me almost a grand or so in interest.

Ordered items from flex shopper in 2016, paid off at the end of 2016. Placed another order I believe in 2019, never received, emailed them and told them it wasn’t received, after 6 weeks of nothing I told them to cancel the order as it was for tools and I purchased elsewhere. Didn’t hear anything until a couple years ago, got a demand for payment for over $1200. I told them the order was cancelled and never received. Then this week I get a bunch of emails demanding payment, where an automated mailer screwed up the information, they sent another email saying that it was sent by mistake, another email followed saying the balance due was $ 1238.12, with the subject line “demand for payment to Avoid Further Actions”. I replied AGAIN and said the debt isn’t valid and they replied saying “Thank you for your response. Please, disregard the email communication that was sent in error. Unfortunately, your account is no longer being managed by Flexshopper, therefore, you need contact Milestone Parrish, LLC. at 8005538647 in regards to any question on this account.” Apparently these crooks took an invalid debt and sold it to a debt buyer. I’m ready to burn their office down.

I am having issues with Flexshopper. They will not listen to me. I do pay them something monthly but they still want to send it for legal action. When i started my account with them i was informed that i would be able to switch from weekly to monthly after paying my first 4 payments. So i called them after the first month and they refused to switch it. So i fell behind on it. Then i call to set up a payment arrangment with them monthly which they accept. But then still try to take out of the account weekly causing payments to not go through. I am a disabled veteran and only get paid once a month. Thank you for your help.

FlexShopper, the lease to own company, is stating that I had a past due balance and sent my account to collections. However, I had either paid off or returned everything per their policies. Due to their poor accountability, my account was sent to collections. I am trying to find determine my options to rectify the situation as their customer service is nearly useless with no action or follow-up.

Before I signed the contract with Flex Shopper on my purchase I was told I could set up a monthly payment plan as opposed to a weekly plan. I was told I should make the purchase then call to set up the plan, after we got the items. I did that and they changed their tune saying that I couldn’t do the monthly plan till I had made 1 full month of ontime payments. Now when I spoke with them when this loan was taken out I specifically told them at the time I was only receiving my social security but would be starting a new job in March. They began trying to deduct from my account on a weekly basis and by the time my SSDI came in on the next payment they had made me over $600.00 negative because of their charges and the fees from the bank. They added more and more fees as the continued to attempt charges. I finally had to lock my account so I could get it caught back up and still be able to pay my bills and feed my children. I called and spoke with someone named GIO and got a plan of $150 every other week and they removed 1/2 of the late fees. They refused to do anything about the issues they caused with my bank. About 8 payments on of the 150 plan they started trying to deduct the 150 plus an additional 84 each payment and 84 on the off weeks. I had to lock them out of my account again and have tried to set up a new plan but I have zero trust that they will follow it and now they say I owe around 4,000 instead of the just under 1,400 I had a signed up for.

Flexshopper is still charging me beyond the original amount. They texted me today 10/6/23 about a \"late payment\" for $6 but they did not text me EVER before to try to collect payments that had supposedly been declined (the rep just told me about this today). I made big payments early on so I thought I was done by now. I have paid $1025.92 so far from a contract of $960 now they want me to pay $1600 more!!!! I know I paid the amount because I have the records from my bank and credit card. I do not think the contract or agreement was clear. I even try to pull it up on my account website and it is not there at all! They have no copy of it to show me?? I was so sure I had paid the whole thing by the 90 days and now it turns out it was not.
