Here’s How to Make Big Companies Listen

It can be frustrating when you rely on a service and don’t get the results you’ve paid for. Big companies make mistakes every day and not only is it their fault, but it can also cost you money, time, and leave you with big headaches.

Have you tried calling Fortiva Financial, LLC to address an issue, only to be told that the representative has no authority to do so? Or maybe you’ve tried talking to someone higher up in the company, only to be ignored, dismissed, or they take too long, continuing to waste your precious time. Maybe you’ve sent an email to the company which only resulted in a prefabricated response or they never follow through with what they’ve promised.

When you’re limited in your choices for service providers or you’re locked into a contract, what can you do?

Fortunately, you do have options.

Use Arbitration to Settle Your Complaint

Most companies like Fortiva Financial, LLC have an arbitration clause in their contracts to prevent being taken to court for traditional litigation. This is actually an advantage for the consumer. When you request an arbitration hearing, an independent third-party (the arbitrator) with knowledge of the type of situation involved will listen to the facts from both sides and make an impartial, binding decision. Fortiva Financial, LLC will have to do a lot of work and there is no guarantee that they will have a successful outcome.

Arbitration is Fast, Inexpensive, and Private

Arbitration with Fortiva Financial, LLC is conducted through the American Arbitration Association (AAA). According to the AAA Consumer Due Process Protocol, arbitration through AAA will comply with their Statement of Principles, which includes:

  • The process is fundamentally fair – All parties are entitled to qualified, competent, impartial arbitrators who will conduct a fair hearing.
  • You get access to all relevant information – This includes reasonable costs, confidentiality, reasonable time limits, and meeting times and/or locations that are agreeable to both parties.
  • Transparency – AAA provides clear arbitration agreements and the ability for each side to hire their own representation.
  • Just process – Arbitration allows the arbitrator to award the same relief as traditional litigation in a binding decision.
  • Alternative to arbitration – Mediation and the ability to take the case to small claims court should be available in some cases.

Arbitration Gives you Control and Leverage

When Fortiva Financial, LLC is alerted that you plan to pursue arbitration, they know it will cost them money out of pocket. Not only do they run the risk of losing the case, but they will also pay for their mistake(s) and the arbitration itself. This gives you more leverage with your demands.

If Fortiva Financial, LLC doesn’t meet those demands and you have a real complaint, America’s Consumer Lawyer can help by representing you in arbitration where you will get a fair, just, and transparent hearing.

Control and Leverage Triggers Faster Settlements

Large companies like Fortiva Financial, LLC don’t like the uncertainty and loss of control that comes with arbitration. Not only do they lose the advantage in the situation, but you’re also on equal footing with them in the eyes of arbitration.

The first step in taking on Fortiva Financial, LLC is to formally raise your complaint. The lawyers at America’s Consumer Lawyer can help you to do so. We will send a letter of demands to the corporate offices of Fortiva Financial, LLC, letting them know that you’re ready to begin arbitration if a satisfactory resolution is not achieved. Typically, this is 30 days, but it will depend on your specific contract with Fortiva Financial, LLC.

Approximately 50% of cases will settle before proceeding to an arbitration hearing during this time. However, if Fortiva Financial, LLC doesn’t offer a reasonable settlement within the appropriate time frame, the next step would be filing a case with AAA. America’s Consumer Lawyer will not only put together the necessary paperwork for arbitration, but we will also help you take the next steps in the arbitration process.

UDAAP and Arbitration

UDAAP is an acronym representing laws that prohibit Unfair, Deceptive, or Abusive Acts or Practices in the context of trade or business. This includes misrepresentation, deception, false advertising, or false promises. These laws emerged following the Dodd-Frank Wall Street Reform and Consumer Protection Act that was enacted in response to the 2008 financial crisis. The ultimate goal with these laws is geared towards protecting consumers involved in financial transactions, educating consumers on their rights, and allowing them access to information and resources to best inform their decisions.

UDAAP laws are regulated by two organizations, the Consumer Financial Protection Bureau (CFPB) and the Federal Trade Commission (FTC). The FTC expanded the initial UDAAP laws in 2004 to include unfair and deceptive acts and practices. Some standards for unfairness, in particular, include if it causes or is likely to cause substantial injury to consumers, the injury is not reasonably avoidable by consumers, and the injury is not outweighed by countervailing benefits to consumers or to competition.

Every state has UDAAP laws, which can vary widely. However, the lawyers at America’s Consumer Lawyer understand these laws and can use them to get compensation for deceptive practices, representing consumers throughout the country in cases of arbitration at no cost to them. The company will not only pay the consumer, but they will also pay my fees as well. The consumer will never pay me a cent.

If you’re dealing with an issue with Fortiva Financial, LLC, you might try filing a complaint with the BBB or the customer service team with Fortiva Financial, LLC. Unfortunately, these avenues won’t always lead to a successful resolution for you, the customer. Instead, you may want to consider an experienced arbitration lawyer to take on your case.

Arbitration is a very useful tool for resolving disputes, and America’s Consumer Lawyer can help. With our expert guidance, we bring the big companies to the table and provide the support needed to get your bills corrected, credit reports fixed, improper fees refunded, and more. Let us pick up the sword for you; you have nothing to lose.

How Do I File a Complaint Against Fortiva Financial, LLC?

The ultimate goal with these laws is geared towards protecting consumers involved in financial transactions, educating consumers on their rights, and allowing them access to information and resources to best inform their decisions.

I went on Fortiva\'s preapproval site to see if I would get approved for a credit card. I filled out the information and submitted the pre-approval. The paged loaded saying \" You\'ve been approved and your new card will arrive in 2 weeks.\" Again, this was a pre-approval application. It also didn\'t tell me for how much. I called the customer service number and was told the application can\'t be canceled until it \'s created. The website falsely advertise that the application is a pre-approval and not an actual application to open an account with Fortiva.

Well first off Ive had Fortiva credit card since 2022, I requested a Credit line increase in 2023 and they sent me a second card with a $500 limit. I got behind on the first card they gave me. My monthly payment kept increasing from 55 dollars and got up to $300. I received a notification that they are offering me a payment match of up to 100% of my payment. I made a payment $548.01 on the 18th of November for the first card. I also made a $500 payment on the second card to pay it off in full. I just received notification from Expirean credit reporting that stated my account was closed. I contacted Fortiva who stated my account was permenatly closed on the 20th of November. I was told by Fortiva that if I made the full payment my account would stay active and that the payment did process on the 19th. I was then charged an annual fee on the 22nd supposedly after my account was closed. I also want to mention that only one account was past due. each card had its own account number.

Fortiva closed my account, which I am not upset about, but has for the past few months refused to send me a final invoice/bill for what I need to pay off the debt with them and has continued to call me, harass me for a payment, even reporting late/no payments on my credit but is continuing to refuse to send me a final bill for an account they closed. I just want the calls to stop, the final bill and to pay off the debt and stop hearing from this crap company.

I\'ve had a Fortiva credit account since approximately January 2022, with no interest. This company repurposed my loan to a Fortiva credit card, that upon use starting charging interest on my previous loan balance once I started using the card. Also, they take 5-7 days to receive payments made online, which seems like a way to push the payee outside of the statement pay date. I did not ask for this card.

Fortiva told me I had no payment protection plan. They said this 3 x when I called in august after being fired. The 4 agent said they’re wrong. u do have it. Now credit protect says they won’t pay September when I called in advance & will only pay October when I’m Entitled to September being covered.

I received a $3000 credit limit from FORTIVA and my monthly payment started at $177.00 and now it’s $181.65 and out of Tony monthly payment they take $86.00 and whatever my available credit is they deduct more money from my available credit and they say it’s because I’m paying the minimum monthly payment, but that’s not right they are just double dipping and I am making absolutely no progress at all my balance is still $2833.00 after making four monthly payments I don’t think that this is fair.

Cashier at Home Depot asked if I would like to apply for Home Depot card. Ran my info through his register and said sorry I didn’t qualify. Weeks later I received a Fortiva credit card at my home to use. Would make purchases and pay in card but when monthly Fortiva statement came never itemized of how balance became the balance . Over time it seemed I was alway getting late fees or would pay what was stated and I would never be zero balance . Also if I went to return an item purchased at Home Depot with my Fortiva card they couldn’t find on my Fortiva acct Finally just tired of the hassles received a statement balance somewhere $220 I called into the customer service number on Fortiva statement and just paid it off Then I stated getting statements says I had a balance started small. I would call in and explained I called and paid the entire balance off and no longer wanted the card. I figured it was all done 2022 or 2023 I had a charge off on my credit report for somewhere around $191 I went into Home Depot to speak with someone and asked for a copy of the contract and paper work I filled out to open this account and nothing could be found . I call Fortiva and asked for the paper work as well and to no avail. Now I’m just told the acct is closed I also was told I was under obligation to the charge off because I signed the paper work to open the account I never opened the account and I fact was told no I didn’t qualify at the register This has caused so much stree and havoc in my life as I’m building my credit back up Thank you Glad someone is looking into this as I was totally taken advantage of

My home owners insurance required me to purchase Vivent service and Fortiva equipment when I purchased my home in 2021. I was told that when I sold my home the Vivent contract could be canceled. I sold my home in July of 2023 and they continue to charge me and claim I am held to a 5 year contract. They made me pay off the equipment that was left with them home and continue to charge me the fee of monitoring although I don\'t live there, nor do I have access to those cameras via their app.

I am reaching out because fortiva illegally closed my account and opened up a master card account in my name without my consent which resulted in my credit score being lowered by 49 points. I am highly disappointed in this deceptive behavior by fortivia opening an account in my name without my consent. They could have called me and leave a voice-mail giving me the option to accept or reject a new account.

Fortiva opened a Mastercard in my name without my permission. They said it was an \"upgrade\" for on time payments when I used their services to purchase furniture from Wayfair. I since paid off that purchase and have not used Fortiva since which is well over 3-4 years or so. I come to find out a new credit card was opened July 2023 and sent to an address I don\'t even live at. Not to mention they negatively impacted my credit score by opening another credit account I did not consent. I did not consent for this credit card or \"upgrade\" as they deemed it.
