Here’s How to Make Big Companies Listen

It can be frustrating when you rely on a service and don’t get the results you’ve paid for. Big companies make mistakes every day and not only is it their fault, but it can also cost you money, time, and leave you with big headaches.

Have you tried calling Groupon, Inc to address an issue, only to be told that the representative has no authority to do so? Or maybe you’ve tried talking to someone higher up in the company, only to be ignored, dismissed, or they take too long, continuing to waste your precious time. Maybe you’ve sent an email to the company which only resulted in a prefabricated response or they never follow through with what they’ve promised.

When you’re limited in your choices for service providers or you’re locked into a contract, what can you do?

Fortunately, you do have options.

Use Arbitration to Settle Your Complaint

Most companies like Groupon, Inc have an arbitration clause in their contracts to prevent being taken to court for traditional litigation. This is actually an advantage for the consumer. When you request an arbitration hearing, an independent third-party (the arbitrator) with knowledge of the type of situation involved will listen to the facts from both sides and make an impartial, binding decision. Groupon, Inc will have to do a lot of work and there is no guarantee that they will have a successful outcome.

Arbitration is Fast, Inexpensive, and Private

Arbitration with Groupon, Inc is conducted through the American Arbitration Association (AAA). According to the AAA Consumer Due Process Protocol, arbitration through AAA will comply with their Statement of Principles, which includes:

  • The process is fundamentally fair – All parties are entitled to qualified, competent, impartial arbitrators who will conduct a fair hearing.
  • You get access to all relevant information – This includes reasonable costs, confidentiality, reasonable time limits, and meeting times and/or locations that are agreeable to both parties.
  • Transparency – AAA provides clear arbitration agreements and the ability for each side to hire their own representation.
  • Just process – Arbitration allows the arbitrator to award the same relief as traditional litigation in a binding decision.
  • Alternative to arbitration – Mediation and the ability to take the case to small claims court should be available in some cases.

Arbitration Gives you Control and Leverage

When Groupon, Inc is alerted that you plan to pursue arbitration, they know it will cost them money out of pocket. Not only do they run the risk of losing the case, but they will also pay for their mistake(s) and the arbitration itself. This gives you more leverage with your demands.

If Groupon, Inc doesn’t meet those demands and you have a real complaint, America’s Consumer Lawyer can help by representing you in arbitration where you will get a fair, just, and transparent hearing.

Control and Leverage Triggers Faster Settlements

Large companies like Groupon, Inc don’t like the uncertainty and loss of control that comes with arbitration. Not only do they lose the advantage in the situation, but you’re also on equal footing with them in the eyes of arbitration.

The first step in taking on Groupon, Inc is to formally raise your complaint. The lawyers at America’s Consumer Lawyer can help you to do so. We will send a letter of demands to the corporate offices of Groupon, Inc, letting them know that you’re ready to begin arbitration if a satisfactory resolution is not achieved. Typically, this is 30 days, but it will depend on your specific contract with Groupon, Inc.

Approximately 50% of cases will settle before proceeding to an arbitration hearing during this time. However, if Groupon, Inc doesn’t offer a reasonable settlement within the appropriate time frame, the next step would be filing a case with AAA. America’s Consumer Lawyer will not only put together the necessary paperwork for arbitration, but we will also help you take the next steps in the arbitration process.

UDAAP and Arbitration

UDAAP is an acronym representing laws that prohibit Unfair, Deceptive, or Abusive Acts or Practices in the context of trade or business. This includes misrepresentation, deception, false advertising, or false promises. These laws emerged following the Dodd-Frank Wall Street Reform and Consumer Protection Act that was enacted in response to the 2008 financial crisis. The ultimate goal with these laws is geared towards protecting consumers involved in financial transactions, educating consumers on their rights, and allowing them access to information and resources to best inform their decisions.

UDAAP laws are regulated by two organizations, the Consumer Financial Protection Bureau (CFPB) and the Federal Trade Commission (FTC). The FTC expanded the initial UDAAP laws in 2004 to include unfair and deceptive acts and practices. Some standards for unfairness, in particular, include if it causes or is likely to cause substantial injury to consumers, the injury is not reasonably avoidable by consumers, and the injury is not outweighed by countervailing benefits to consumers or to competition.

Every state has UDAAP laws, which can vary widely. However, the lawyers at America’s Consumer Lawyer understand these laws and can use them to get compensation for deceptive practices, representing consumers throughout the country in cases of arbitration at no cost to them. The company will not only pay the consumer, but they will also pay my fees as well. The consumer will never pay me a cent.

If you’re dealing with an issue with Groupon, Inc, you might try filing a complaint with the BBB or the customer service team with Groupon, Inc. Unfortunately, these avenues won’t always lead to a successful resolution for you, the customer. Instead, you may want to consider an experienced arbitration lawyer to take on your case.

Arbitration is a very useful tool for resolving disputes, and America’s Consumer Lawyer can help. With our expert guidance, we bring the big companies to the table and provide the support needed to get your bills corrected, credit reports fixed, improper fees refunded, and more. Let us pick up the sword for you; you have nothing to lose.

How Do I File a Complaint Against Groupon, Inc?

We will use your state’s UDAAP law to file a complaint in Arbitration on your behalf at no cost to you. UDAAP laws include misrepresentation, deception, false advertising, or false promises. Under your state’s UDAAP law, you are likely entitled to money damages for your actual damages.  Plus, the other side will pay our fees and costs.  You will not pay us a penny.

Feb 3 I bought office 2024 and followed the instructions to install. Microsoft would not accept the key. Groupon then said through text to download this office 2021 and imput this key number and see if that works. Microsoft rejected that key. I worked with the groupon rep for 15 hours before we both agreed to the 3 day no hastle refund that was adversed next to the office 2024 I purchased. Microsoft would not asccept any key they provided. The assistant says that I will be getting a refund. Then some senior suppooirt person stated you get no refund. That I was provided a key so they will refuse all refund. I said the key you provided was for another program that you tried when the item I purchased never worked, I never received any key for the program I purchased, And at abny rate, you cannot nullify the advertised 3 day non hastle refund which I have a picture of with the office 2024 and the url at the top. I said thisn is theft. And why is your keys not working? Others also said your keys are not working. I suspect they are not working bcause groupon is not a microsoft affiliate and they are selling software that will not work and keeping the money. Theft of money on an iten purchased that never worked is illegal and it did not phase fgroupon.

I am seeking your legal assessment of whether I have a viable claim against Groupon, Inc., notwithstanding Groupon’s Terms of Use, based on the facts below. Background: I purchased and redeemed a Groupon voucher for a prescription medical product. The product was never delivered to me, was instead delivered to a third party in another state, and my protected health information (PHI) was exposed. I notified Groupon of the PHI disclosure and non-delivery on December 5, 2025 via email. Groupon refused a refund and continues to list and profit from the merchant. Questions for Counsel: Failure to Vet / Negligent Enablement: Where Groupon advertises and profits from prescription medical services, does Groupon have a duty to reasonably vet and monitor medical merchants—particularly where the prescribing provider has been reprimanded by multiple states for conduct related to prescribing and patient safety, and those issues are publicly available? Knowledge and Complicity: Given that Groupon’s own platform reviews, BBB complaints, and consumer reports reflect long-standing patterns of non-delivery, lack of communication, and refund stonewalling by this merchant, can Groupon be deemed to have actual or constructive knowledge of these risks, making its continued hosting of the merchant negligent or unconscionable? Negligence After Notice: After I provided Groupon actual notice of non-delivery and PHI exposure on December 5, 2025, does Groupon’s refusal to refund and decision to continue listing this prescription-based merchant support a claim for negligence after notice or negligent enablement? Terms of Use vs. Texas Law: Although Groupon’s Terms of Use attempt to disclaim responsibility by placing liability solely on the merchant, am I correct that Texas consumer-protection laws (including the DTPA and UDAAP principles) cannot be waived by contract and may override such disclaimers where Groupon’s own acts or omissions contribute to consumer harm? UDAAP / DTPA Exposure: Can Groupon’s advertising of this medical service, coupled with its control over redemption and refund mechanics—and its use of voucher redemption to deny relief after complete nonperformance—constitute unfair or deceptive acts or practices, independent of the merchant’s conduct? Conversion / Retention of Funds: After lawful rejection of performance due to safety and privacy concerns and a clear demand for refund, does Groupon’s continued retention of my funds support a claim for conversion or other equitable relief? Damages Beyond Refund: Are damages potentially available beyond a simple refund, including statutory damages or enhanced/punitive damages, where harm includes medical privacy exposure and a knowing refusal to cure after notice? Arbitration Strategy: Based on these facts, would consumer arbitration (e.g., AAA) be an effective mechanism to pursue claims directly against Groupon, or would small-claims or regulatory actions be more appropriate? I can provide full documentation, including evidence of the provider’s disciplinary history, misdelivery and PHI exposure, notice to Groupon, refund refusal, and the merchant’s continued listing despite widespread complaints. I am seeking your evaluation of whether these facts support a viable claim against Groupon itself, not solely the merchant. 1. Transaction Details Name Under Groupon: Alma Alexander - I legally changed my name in September 7, 2016. Groupon profile is old. Groupon recognize the order under Alma Alexander. Camille Binbek AKA Alma Alexander Purchase Date: July 9, 2025 Groupon Order #: 1000-150090-964220 Voucher Redemption Date: October 28, 2025 Amount Paid to Groupon: $112.50 Shipping Paid to Merchant: $29.99 Total Out-of-Pocket Loss: $142.49 Merchant Advertised by Groupon: CosmeticRx (prescription **********)

Groupon sold me a voucher for a service that included one session. I drove 2.5 hours to get the service and the vendor was charging me for the full price on top of making me redeem the voucher. Groupon will give me a $15 credit to my account. There are multiple people who reported this same issue.

Potential claim against Groupon??? I own a spa in Brecksville, Ohio. I have various Groupon campaigns. I am usually paid 2x per month on the 6th and 20th. I have not received a payment since 9/20. I have contacted them so many times and still have not heard back. I wanted to know if I can file a claim against them for the money owed and the loss taken due to denying customers bc we have not been paid so we cannot book them.

Groupon is refusing to issue a refund for a voucher even though the merchant is refusing to honor my voucher. I want my refund back to my credit card and then to delete my groupon account permanently.
