Plumber Issue

One of the primary concerns consumers have against HomeServe is with the quality of their plumbing experts. According to the complaints, the company sends plumbers who misdiagnose issues resulting in other problems. On one occasion, a client reported additional damage to their pipe as well as their sewer. On top of this, the company charges clients despite failing to deliver expected services.

Deceptive Advertisements

HomeServe has been advertising free freon for clients subscribing to their products. After subscribing, clients requesting for their free freon were refused as HomeServe’s partner company claimed the said advertisement wasn’t true. This was on top of consumers getting defective products.

Unwanted Emails

Other complainants aired out getting spam emails about HomeServe’s products and services. Despite requesting to be removed from the email list, consumers said they kept receiving spam emails.

Poor Customer Service

Customers of HomeServe who have issues with the products and services of the company found it hard to deal with the customer representatives for they unwillingly do their jobs, kept on emailing the clients about the billing, and not helping its customers to solve the problems.

Unfortunately, these complaints are just the beginning for HomeServe. Between customer service issues, plumber issues, deceptive advertisements, and unwanted emails, HomeServe customers are left wondering what options they have regarding their consumer rights.

We Fix Complaints When Customer Service Won’t

Has HomeServe used misleading sales tactics? Have you received poor service? Do you have complaints with billing? Do you want customer service at HomeServe to listen?

A lot of HomeServe Corporation customers aren’t happy with their service and the Better Business Bureau lists 473 customer complaints against the company in the past three years, including complaints for billing and collections practices, problems with a service/product, advertising and sales, among others.

If your complaints haven’t been heard, we can help. At America’s Consumer Lawyer we help customers who have been mistreated by big companies–much like HomeServe–and we turn your complaints into resolutions!

We’ll not only file your legal demands with HomeServe, we’ll negotiate with the company. If your claim isn’t resolved through these negotiations, we’ll work through the legal process that is outlined in your HomeServe contract, which is typically arbitration.

America’s Consumer Lawyer gets results–including zero balances, refunds, and other compensation.

Here’s How to Make Big Companies Listen

It can be frustrating when you rely on a service and don’t get the results you’ve paid for. Big companies make mistakes every day and not only is it their fault, but it can also cost you money, time, and leave you with big headaches.

Have you tried calling HomeServe to address an issue, only to be told that the representative has no authority to do so? Or maybe you’ve tried talking to someone higher up in the company, only to be ignored, dismissed, or they take too long, continuing to waste your precious time. Maybe you’ve sent an email to the company which only resulted in a prefabricated response or they never follow through with what they’ve promised.

When you’re limited in your choices for service providers or you’re locked into a contract, what can you do?

Fortunately, you do have options.

Use Arbitration to Settle Your Complaint

Most companies like HomeServe have an arbitration clause in their contracts to prevent being taken to court for traditional litigation. This is actually an advantage for the consumer. When you request an arbitration hearing, an independent third-party (the arbitrator) with knowledge of the type of situation involved will listen to the facts from both sides and make an impartial, binding decision. HomeServe will have to do a lot of work and there is no guarantee that they will have a successful outcome.

Arbitration is Fast, Inexpensive, and Private

Arbitration with HomeServe is conducted through the American Arbitration Association (AAA). According to the AAA Consumer Due Process Protocol, arbitration through AAA will comply with their Statement of Principles, which includes:

  • The process is fundamentally fair – All parties are entitled to qualified, competent, impartial arbitrators who will conduct a fair hearing.
  • You get access to all relevant information-This includes reasonable costs, confidentiality, reasonable time limits, and meeting times and/or locations that are agreeable to both parties.
  • Transparency – AAA provides clear arbitration agreements and the ability for each side to hire their own representation.
  • Just process – Arbitration allows the arbitrator to award the same relief as traditional litigation in a binding decision.
  • Alternative to arbitration – Mediation and the ability to take the case to small claims court should be available in some cases.

Arbitration Gives you Control and Leverage

When HomeServe is alerted that you plan to pursue arbitration, they know it will cost them money out of pocket. Not only do they run the risk of losing the case, but they will also pay for their mistake(s) and the arbitration itself. This gives you more leverage with your demands.

If HomeServe doesn’t meet those demands and you have a real complaint, America’s Consumer Lawyer can help by representing you in arbitration where you will get a fair, just, and transparent hearing.

Control and Leverage Triggers Faster Settlements

Large companies like HomeServe don’t like the uncertainty and loss of control that comes with arbitration. Not only do they lose the advantage in the situation, but you’re also on equal footing with them in the eyes of arbitration.

The first step in taking on HomeServe is to formally raise your complaint. The lawyers at America’s Consumer Lawyer can help you to do so. We will send a letter of demands to the corporate offices of HomeServe, letting them know that you’re ready to begin arbitration if a satisfactory resolution is not achieved. Typically, this is 30 days, but it will depend on your specific contract with HomeServe.

Approximately 50% of cases will settle before proceeding to an arbitration hearing during this time. However, if HomeServe doesn’t offer a reasonable settlement within the appropriate time frame, the next step would be filing a case with AAA. America’s Consumer Lawyer will not only put together the necessary paperwork for arbitration, but we will also help you take the next steps in the arbitration process.

UDAAP and Arbitration

UDAAP is an acronym representing laws that prohibit Unfair, Deceptive, or Abusive Acts or Practices in the context of trade or business. This includes misrepresentation, deception, false advertising, or false promises. These laws emerged following the Dodd-Frank Wall Street Reform and Consumer Protection Act that was enacted in response to the 2008 financial crisis. The ultimate goal with these laws is geared towards protecting consumers involved in financial transactions, educating consumers on their rights, and allowing them access to information and resources to best inform their decisions.

UDAAP laws are regulated by two organizations, the Consumer Financial Protection Bureau (CFPB) and the Federal Trade Commission (FTC). The FTC expanded the initial UDAAP laws in 2004 to include unfair and deceptive acts and practices. Some standards for unfairness, in particular, include if it causes or is likely to cause substantial injury to consumers, the injury is not reasonably avoidable by consumers, and the injury is not outweighed by countervailing benefits to consumers or to competition.

Every state has UDAAP laws, which can vary widely. However, the lawyers at America’s Consumer Lawyer understand these laws and can use them to get compensation for deceptive practices, representing consumers throughout the country in cases of arbitration at no cost to them. The company will not only pay the consumer, but they will also pay my fees as well. The consumer will never pay me a cent.

If you’re dealing with an issue with HomeServe, you might try filing a complaint with the BBB or the customer service team with HomeServe. Unfortunately, these avenues won’t always lead to a successful resolution for you, the customer. Instead, you may want to consider an experienced arbitration lawyer to take on your case.

Arbitration is a very useful tool for resolving disputes, and America’s Consumer Lawyer can help. With our expert guidance, we bring the big companies to the table and provide the support needed to get your bills corrected, credit reports fixed, improper fees refunded, and more. Let us pick up the sword for you; you have nothing to lose.

How Do I File a Complaint Against HomeServe?

We will use your state’s UDAAP law to file a complaint in Arbitration on your behalf at no cost to you.  UDAAP laws include misrepresentation, deception, false advertising, or false promises.  Under your state’s UDAAP law, you are likely entitled to money damages for your actual damages.  Plus, the other side will pay our fees and costs.  You will not pay us a penny.

I have a HomeServe cooling system service contract dispute where they wrongfully denied a $2,000 blower motor repair claim based on contractual ambiguity. I understand you specialize in HomeServe disputes with a no-cost guarantee, and I\'m seeking your evaluation of my case. **Case Summary:** My 14-year-old central air conditioning system\'s blower motor failed. HomeServe\'s cooling system contract (SC-CFC1006-NAW-HRM-COOL-U176-052421) covers \\\"condenser motor\\\" and \\\"condenser fan\\\" but doesn\'t explicitly include or exclude blower motors. HomeServe is using this silence to deny coverage, despite blower motors being essential HVAC components for air circulation. **Account Information:** The HomeServe account is under my spouse Gregg Dunham\'s name, but the monthly payments are made using my credit card. I, Al Johnston, am assisting with this dispute resolution process on behalf of the account holder. **Contractual Evidence:** I have documentation showing HomeServe\'s own combination heating/cooling contracts (SC-CFCHSES1109-NHRW-HRM-W-HVAC-V379-040524) explicitly cover \\\"blower motors, blower wheels, blower assemblies\\\" - proving they recognize these as coverable components when they choose to be explicit. This creates a strong precedent that the ambiguity in my cooling-only contract should be resolved in my favor under the contra proferentem doctrine. **Actions Taken:** - July 17, 2025: Filed service request via HomeServe app - July 18: FairDeal HVAC technician diagnosed failed blower motor and removed it for replacement sourcing - July 21: HomeServe denied $2,000 repair cost - July 22: Escalated to supervisor who repeated contractual denial despite my explanation of ambiguity and functional dependency between blower and compressor **Current Situation:** The technician currently has possession of the failed blower motor as evidence. We are proceeding with replacing both the air conditioner and blower at our own expense due to HomeServe\'s denial, but I want to pursue recovery of these costs. **Specific Questions:** 1. Have you successfully handled HomeServe cooling system disputes involving blower motor coverage denials? 2. What is your success rate with HomeServe warranty claim denials based on contractual ambiguity? 3. Can you confirm your \\\"no cost\\\" guarantee applies to my HomeServe dispute, including if we lose? 4. Would you recommend arbitration or court litigation for my specific case? 5. Should I continue pursuing internal appeals with HomeServe while you evaluate my case? 6. What documents do you need for case evaluation, and how quickly can you assess my claim? **Available Documentation:** - Complete HomeServe service contract and terms - HomeServe combination contract showing explicit blower motor coverage - Service timeline documentation with claim numbers - Technical diagnosis from licensed HVAC contractor - All correspondence with HomeServe including denial notifications The contract ambiguity combined with HomeServe\'s own coverage precedents for blower motors in other agreements creates what appears to be a strong Consumer Fraud Act violation. I\'m prepared to provide complete documentation and would appreciate your assessment of this case\'s merit under your no-cost representation. How quickly can you evaluate whether this dispute qualifies for your HomeServe specialty practice? Best regards, Al Johnston (assisting account holder Gregg Dunham) 208 Main St #177 Rancocas, NJ 08073 Phone: 609.206.3642 Email: AlfredoJohnston@comcast.net Account Holder: Gregg Dunham Email: GreggDunham76@gmail.com Service Agreement #: 168763908 P.S. I also have active heating and cooling system plans with HomeServe (Plans #169301171 and #186763713), demonstrating an ongoing customer relationship that makes their denial particularly problematic.`,

Long story summarized, I have an issue with a home warranty company. The contractor they hired damaged a sewer line connection upon installing a new line.(last year) I had continued issues and someone came out again to find the original contractor damaged a pipe/connection when installing. This is after they also damaged my foundation and refused to pay for so i paid out of pocket to fix that. Now the warranty company is telling me they wont fix the prior issue unless i replace my interior sewer line at my expense. Theres a lot more but this issue has been going on over a year and i need to know if hiring a lawyer would help rectify my situation

Hi! I have all the insurance policies for water line and sewer/drainage line coverage from HomeServe. I live in Charleston, SC and my house in on a slab. There was a major hole in the drain line for my kitchen under the slab. They had 2 companies come out to give estimates. 1 company was very thorough and gave a legitmate estimate of over $7k for the work. The other was a horrible company who gave me a $2000 estimate to tear up my kitchen not even know exactly where the problem was and how far it extended. I went with the thorough company and homeserve said they were only covering $1500 for my interior plumbing insurance. But I have $10K of coverage in my exterior and drain lines contract. I feel they are screwing me over and making my pay much of the expenses out of pocket.

My husband and I are getting a new driveway. We have a HomeServe warranty and have a used their services. Every couple of years they come and snake the line. We called and told them we got another opinion about the line to find out that the old sewer line is broken in two places and that is why we have to snake it because of the roots in the tree. If we get a new driveway and the problem isn’t fixed HomeServe will dig up my new driveway and will not replace it. According to my warranty, they cover sewer line repair up to $10,000. The estimate from another plumber states $13,000. I cannot invest in a driveway knowing that my sewer line is damaged. What are my rights?

Wanted to see if you could represent me against HomeServe, saw your article about deceptive practices. I purchased their home warranty which said it included hot water heater repair. Then a hot water heater failed at my 4 unit apartment building. They send 2 plumbers and refused to do the repair and only said they were willing to replace it and the replacement was not covered and would cost $13,000. I got another plumber to come the next day who agreed to do the repair for $1300. My believe is Homeserve never intends to do any repairs on hot water heaters and says everything is broken so they don\'t have to cover the claim. Please let me know if you can represent me in this case. -David

Battling with HomeServe since April 2024 to properly repair a damaged sewer line by one of their contractors and restore our property. It is now nearly July and no grass seed has been placed. HomeServe is now stating that they will not provide sod unless we pay. At this point, we’re fed up! We have photos of damages to our property caused by the 1st plumber not having property sewer line locating equipment.

Homeserve is refusing to cover my sewer line that has clearly collasped. A plumber tried to jet my line because of a backup and there is a coupling stuck. Homeserve states because there is an object in the line, they will not give me a new sewer line.

HomeServe has wrongfully denied our claim and will not honor our claim because they suspect that our claim was a preexisting condition, prior to our policy. They have no evidence to backup this claim and just stated that they suspect it was preexisting. HomeServe claimed that we initially reached out to them for a policy, that they do not have representatives that reach out to gain new customers. HomeServe called us on February 6th (which we have records of the incoming call) our policy started two days later on the 8th, which is stated on our documents. Unfortunately, only 3 days after the policy started we had a major sewage backup. We have images with time stamps of the occurrence, where it\'s pretty evident that the sewage is black and had been sitting in our pipes for a good while. Which was something we had no prior knowledge about. This was the first time we have had a backup in our home that led us to finding out that a clay pipe within the area of coverage had been broken and was the cause of the backup. We found this out through HomeServes services. Sewage still continues to backup into our home, daily, but does not reflect the same type or amount of sewage from the initial occurrence and point of contact, demonstrating that there was no backup prior to the initial backup on February 11th. We do have other images of our basement from January showing that this was not a preexisting problem, however, those photos are from January 6th.

I have a warranty for my sewer line with Service Line Warranties of America aka Home Serve USA. After a video of the sewer line was obtained, I received a detailed report from my city that indicates several failures in the line causing infiltration and/or sewage leakage. My city has mandated a repair to be done within 90 days. The warranty company is refusing to cover the claim.
