UDAAP laws are regulated by two organizations, the Consumer Financial Protection Bureau (CFPB) and the Federal Trade Commission (FTC). The FTC expanded the initial UDAAP laws in 2004 to include unfair and deceptive acts and practices. Some standards for unfairness, in particular, include if it causes or is likely to cause substantial injury to consumers, the injury is not reasonably avoidable by consumers, and the injury is not outweighed by countervailing benefits to consumers or to competition.

Liberty First Lending LLC solicited me to apply for one of their loan products via my Facebook page feed.  After I confirmed that Liberty First Lending has an arbitration clause in their \"Terms of Use\" contract on their website.  Liberty First Lending first asks how you will use the money. I chose the emergency cash option. Then they collect your full name, email address, phone number, address, and date of birth. Prior to submitting the address portion of the loan application. It states, \"By Clicking \"Continue\", I am providing express written consent under the Fair Credit Reporting Act for Americor and its partners to obtain my consumer credit report from my credit profile or other information from a Credit Bureau(s) in order to provide me with personal loan and debt resolution options without affecting my credit score. However, Liberty First Lending is not mentioned. However, they are the one that is collection the personal consumer credit information. After I submitted all of the information, Liberty First Lending asked for. I got an immediate results message. The results page states, \"Thank you for submitting your application! We\'ll follow up with you shortly via phone and email. Want to learn more? Call us now: (866) 216-0458\" However, this is not what was solicited to me via my Facebook page feed. The solicitation states and asks how much the consumer wants to borrow. Says \"Received the funds as early as tomorrow\" Then displays a fixed rate from 5.99%. Also, their website landing pages state \"Check Your Rates In 1 Minute\", \"Accept The Terms Online\", and \"Get Your Money Next Day If approved, funds will be electronically deposited directly into your designated bank account\" However, this is not what happened after I submitted my personal information with the expectation of a loan quote Bottom-line layperson\'s analysis and assessment Based on the nine preserved evidentiary documented PDFs I have acquired for review upon request by counsel. Liberty First Lending likely triggered Regulation B application-processing duties, but the evidence does not yet establish a matured ECOA failure-to-notify violation yet as of July 23rd. The immediate “Thank you for submitting your application” screen is an acknowledgment, not an approval, denial, counteroffer, or notice of incompleteness. The strongest issues that appear to exist already are: A plausible Truth in Lending Act/Regulation Z advertising violation. A strong deceptive loan-marketing or bait-and-switch theory based on the overall funnel. A meaningful contradiction over whether Liberty First or Americor obtained and evaluated the application. A potentially strong future ECOA/Regulation B failure-to-notify claim if no proper action-taken or incompleteness notice arrives within the applicable 30-day period. A conditional FCRA adverse-action claim if a consumer report was used to deny, filter, or divert the loan request without the required notice. My Bottom Line Assessment and Layperson Opinion: Is that Liberty Lending, LLC and Americor are practicing and displaying very deceptive advertising and \"Bait and Switch\" behavior. To conceive consumers into assuming they are applying for a loan. When in fact they are being steered toward debt relief program funnels. If this is a case or something the firm is interested in representing me please let me know. I do have further evidentiary documents upon request.
