Erroneous Credit Reporting

Per the BBB complaints against Mariner Finance, LLC, customers lamented about the company’s fallacious credit reporting. According to consumers, despite accounts being paid in full and having records of their payments, the company reported them to credit reporting agencies. This has tainted the consumers’ credit reports, effectively causing their credit scores to plummet.

Cancellation Request Difficulties

Other complaints reported difficulties canceling loan insurance. On one account, the consumer narrated calling Mariner Finance, LLC’s company once every month for six months to get an update on their request. The consumer called every 20th of the month from January to June 2020 and had only been instructed to fax a form that Mariner Finance, LLC had never sent.

Poor Customer Service

On top of the other complaints consumers had with Mariner Finance, LLC is their lousy customer service. According to reports, clients have been met with unhelpful customer representatives who have left them with questions and issues unresolved. This subpar service has caused much great stress especially for consumers whose concerns involved their credit reports.

Unfortunately, poor credit reporting, service request issues, and lousy customer relation complaints are just the beginning for Mariner Finance, LLC. The company’s customers are left wondering what options they have regarding their consumer rights.

Here’s How to Make Big Companies Listen

It can be frustrating when you rely on a service and don’t get the results you’ve paid for. Big companies make mistakes every day and not only is it their fault, but it can also cost you money, time, and leave you with big headaches.

Have you tried calling Mariner Finance, LLC to address an issue, only to be told that the representative has no authority to do so? Or maybe you’ve tried talking to someone higher up in the company, only to be ignored, dismissed, or they take too long, continuing to waste your precious time. Maybe you’ve sent an email to the company which only resulted in a prefabricated response or they never follow through with what they’ve promised.

When you’re limited in your choices for service providers or you’re locked into a contract, what can you do?

Fortunately, you do have options.

Use Arbitration to Settle Your Complaint

Most companies like Mariner Finance, LLC have an arbitration clause in their contracts to prevent being taken to court for traditional litigation. This is actually an advantage for the consumer. When you request an arbitration hearing, an independent third-party (the arbitrator) with knowledge of the type of situation involved will listen to the facts from both sides and make an impartial, binding decision. Mariner Finance, LLC will have to do a lot of work and there is no guarantee that they will have a successful outcome.

Arbitration is Fast, Inexpensive, and Private

Arbitration with Mariner Finance, LLC is conducted through the American Arbitration Association (AAA). According to the AAA Consumer Due Process Protocol, arbitration through AAA will comply with their Statement of Principles, which includes:

  • The process is fundamentally fair – All parties are entitled to qualified, competent, impartial arbitrators who will conduct a fair hearing.
  • You get access to all relevant information – This includes reasonable costs, confidentiality, reasonable time limits, and meeting times and/or locations that are agreeable to both parties.
  • Transparency – AAA provides clear arbitration agreements and the ability for each side to hire their own representation.
  • Just process – Arbitration allows the arbitrator to award the same relief as traditional litigation in a binding decision.
  • Alternative to arbitration – Mediation and the ability to take the case to small claims court should be available in some cases.

Arbitration Gives you Control and Leverage

When Mariner Finance, LLC is alerted that you plan to pursue arbitration, they know it will cost them money out of pocket. Not only do they run the risk of losing the case, but they will also pay for their mistake(s) and the arbitration itself. This gives you more leverage with your demands.

If Mariner Finance, LLC doesn’t meet those demands and you have a real complaint, Mike Agruss Law can help by representing you in arbitration where you will get a fair, just, and transparent hearing.

Control and Leverage Triggers Faster Settlements

Large companies like Mariner Finance, LLC don’t like the uncertainty and loss of control that comes with arbitration. Not only do they lose the advantage in the situation, but you’re also on equal footing with them in the eyes of arbitration.

The first step in taking on Mariner Finance, LLC is to formally raise your complaint. The lawyers at Mike Agruss Law can help you to do so. We will send a letter of demands to the corporate offices of Mariner Finance, LLC, letting them know that you’re ready to begin arbitration if a satisfactory resolution is not achieved. Typically, this is 30 days, but it will depend on your specific contract with Mariner Finance, LLC.

Approximately 50% of cases will settle before proceeding to an arbitration hearing during this time. However, if Mariner Finance, LLC doesn’t offer a reasonable settlement within the appropriate time frame, the next step would be filing a case with AAA. Mike Agruss Law will not only put together the necessary paperwork for arbitration, but we will also help you take the next steps in the arbitration process.

UDAAP and Arbitration

UDAAP is an acronym representing laws that prohibit Unfair, Deceptive, or Abusive Acts or Practices in the context of trade or business. This includes misrepresentation, deception, false advertising, or false promises. These laws emerged following the Dodd-Frank Wall Street Reform and Consumer Protection Act that was enacted in response to the 2008 financial crisis. The ultimate goal with these laws is geared towards protecting consumers involved in financial transactions, educating consumers on their rights, and allowing them access to information and resources to best inform their decisions.

UDAAP laws are regulated by two organizations, the Consumer Financial Protection Bureau (CFPB) and the Federal Trade Commission (FTC). The FTC expanded the initial UDAAP laws in 2004 to include unfair and deceptive acts and practices. Some standards for unfairness, in particular, include if it causes or is likely to cause substantial injury to consumers, the injury is not reasonably avoidable by consumers, and the injury is not outweighed by countervailing benefits to consumers or to competition.

Every state has UDAAP laws, which can vary widely. However, the lawyers at Mike Agruss Law understand these laws and can use them to get compensation for deceptive practices, representing consumers throughout the country in cases of arbitration at no cost to them. The company will not only pay the consumer, but they will also pay my fees as well. The consumer will never pay me a cent.

If you’re dealing with an issue with Mariner Finance, LLC, you might try filing a complaint with the BBB or the customer service team with Mariner Finance, LLC. Unfortunately, these avenues won’t always lead to a successful resolution for you, the customer. Instead, you may want to consider an experienced arbitration lawyer to take on your case.

Arbitration is a very useful tool for resolving disputes, and Mike Agruss Law can help. With our expert guidance, we bring the big companies to the table and provide the support needed to get your bills corrected, credit reports fixed, improper fees refunded, and more. Let us pick up the sword for you; you have nothing to lose.

How Do I File a Complaint Against Mariner Finance, LLC?

We will use your state’s UDAAP law to file a complaint in Arbitration on your behalf at no cost to you. UDAAP laws include misrepresentation, deception, false advertising, or false promises. Under your state’s UDAAP law, you are likely entitled to money damages for your actual damages.  Plus, the other side will pay our fees and costs.  You will not pay us a penny.  These laws emerged following the Dodd-Frank Wall Street Reform and Consumer Protection Act that was enacted in response to the 2008 financial crisis. The ultimate goal with these laws is geared towards protecting consumers involved in financial transactions, educating consumers on their rights, and allowing them access to information and resources to best inform their decisions.

never been late but the interest rates are higher than the principle payments and the balance after 2 years doesn\'t seem to go down. I need to investigate them for illegal interest rates, lack of transparency under california usury laws.

Hello. I am hoping you can help me with Mariner Finance. This isn\'t about phone calls, in fact they do not contact me. They never contacted me that my account was going into default or going to be charged off. I noticed it one day on my credit report. They never alerted me. I have been making monthly payments to Mariner since June of last year. My balance continues to increase no matter how much I pay. My account shows the same balance month after month. I have been collecting screenshots. I have emails between me and Mariner with me asking, begging, to set up a monthly payment plan. I am told that I have not been making payments long enough to qualify for a plan? They then in writing would tell me repeatedly that they are accepting my payments (which they really aren\'t because my balance keeps increasing) and not pursuing tougher collection, which in other words they aren\'t suing me. I have called in and asked again, for a payment plan and they told me they don\'t offer that. I asked them for an amount to pay each month so the balance can go down. They said just make the full monthly payment of $145. I said even if I do that it keeps increasing. They said yes because it is past due. They refused to give any kind of payment to decrease the balance so no matter how much I pay the balance increases. I have screenshots. I have emails. I have proof I have tried repeatedly to reach out to them with no avail. This doesn\'t seem right to me at all. Are you able to assist in helping me?

Mariner Finance has sent a summons a few months ago, refused to work out a payment plan with me, and continues to report a derogatory account to the credit reporting agencies every month with interest added. I’ve never received a bill/letter from them showing the interest or how it’s accumulated. I need help, please.

Mariner finance charged off $3575 two years ago. I just started debt management plan with consumer credit counseling agency, money management to pay all my charged off debt in 42 monthly pmts due to financial hardship. I wanted to include Mariner finance $3575 charged off debt too but my credit counselor said mariner finance does not participate in debt management plan. I just noticed on my credit report that balance is $6200 which is not charged off $3575 amount. I called mariner finance recovery department and was told that $6200 includes interest on $3575 charged off amount after the charged off date and interest will continue to be charged until account is settled or paid off. I told them I have 7 other charged off accounts in my debt management plan and all 7 creditors did not charge interest after charged off dates and I can not pay post charge off date interest. They said that I can settle for one one lump sump $3575 payment or I can start to make any payment toward $6200 balance. I told them I don’t have $3575 lump sum payment now but I can pay $100 monthly for 36 months to pay off charged off balance due to financial hardship (that I am retired with limited income with no assets and starting to pay off $40k debt mostly charged off debt toward $3575 charged off amount )which they did not accept. I have resolved all debt to pay in 42 monthly pmts on my credit report thur management plan. I need to resolve the last charged off account with mariner finance thru payment arrangement to pay $3575 in monthly payments since I am not able to pay $3575 in one payment. I do not want to pay $6200 current balance which includes post charge of interest. It’s my understanding that lenders are required to send periodic monthly statements showing interest in order to charge post charge off date. Mariner finance has never sent me any periodic statement showing interest after charged off date. Can you help me to get payment arrangement for $3575 charged off amount to settle the account. If yes how much your fee fee in monthly payments? Thank you

I\'m writing in regards to a civil hearing notice I recently received from a Constable for an unsecured loan I have with Mariner Finance that is 2 months past due. Mariner Finance has decided to sue me for the entire amount owed plus court fees totaling just under $4,000. I currently live in Troy, PA (Bradford County) and one day I randomly received a check from Mariner Finance in the mail for $3,500.00. At the time, I was struggling to pay back some loans, credit card payments and my car insurance premium so upon receiving the check, I took it as a miracle. Before cashing the check however, I called Mariner Finance to validate its authenticity. I spoke with employee Ethan who assured me that it was a legitimate check but repeatedly suggested that I ask for more than just the $3,500 which I turned down because I didn\'t want to increase the monthly payment or put myself in a position where I couldn\'t pay it back. I\'m a 41 female, single with no family, disabled and live on a very low fixed SSDI income. It\'s also my only source of income. I also live in a section 8 apartment and I\'m on food stamps and Medicare struggling to survive. I\'m at the point now where I\'m taking out loans and opening credit card accounts just to pay for groceries and personal items. I have no assets other than a personal vehicle and furnishings in this apartment, but I\'m afraid of a judgment lien being placed on my vehicle and/or personal belongings to pay back the loan with Mariner Finance. I haven\'t responded to the civil notice yet as I\'m looking for legal counsel and guidance to help me settle this debt. I would greatly appreciate it if you please contact me with any advice or suggestions you may have. I look forward to your response. Sincerely, Diana Thurston 570-499-2842

I have an account with Mariner Finance LLC. I have defaulted due to COVID 19 Hardship. Interest and principal now about 14k and growing. I been trying to settle with them and had no luck they continue to say I don’t qualify because I only made one payment and another payment was NSF . I told them it was due to hardship they said there’s no help for me. I filed a BBB complaint and still no assistance. On 02/06/23 I received an email stating to call them to settle for less than what I owe . When I called them again they stated they can’t help me . The rep even asked me if I filled a complaint I stated yes . She continued to go over the same info I don’t qualify for any type of assistance . I asked her why would you guys send me an email stating there’s settlement options for me. She stated those emails are part of our annual campaign you don’t qualify. I find this email deceiving. It clearly states there’s settlement options and even shows only my principal mount and it states to call . Nowhere in the email it states that I may not qualify I even read the fine print .
