Fraudulent Activity 

One of the primary complaints detailed against Merrick Bank involved fraudulent activity. According to reports, a number of individuals have received letters from the bank claiming their cards had been activated despite not applying for the said card with Merrick. On one account, the individual reported this immediately to the bank and requested it to be canceled but was later billed $123 for an account the person never applied for on top of being falsely reported to the credit bureau. 

Billing Deficiency

Another primary concern for Merrick Bank is with the company’s billing. Complainants reported that the bank failed to notify them of balances they would’ve immediately settled if they have been aware of the marginal discrepancies. This poor billing practice has also incurred consumers overdraft fees and, in worse cases, have been recorded against their credit reports. 

Inaccurate Payment Records

Other complaints pointed out the bank’s poor billing records. Merrick’s consumers reported being contacted by collection agencies collecting on behalf of the bank. This comes as a surprise considering some of the said consumers had supposedly paid off their loans or have been paying their monthly dues timely and completely.

UDAAP laws are regulated by two organizations, the Consumer Financial Protection Bureau (CFPB) and the Federal Trade Commission (FTC). The FTC expanded the initial UDAAP laws in 2004 to include unfair and deceptive acts and practices. Some standards for unfairness, in particular, include if it causes or is likely to cause substantial injury to consumers, the injury is not reasonably avoidable by consumers, and the injury is not outweighed by countervailing benefits to consumers or to competition.

I’ve had a secured credit card with Merrick Bank for over eight years and 100 % on time payments. I was promised to be switched over to an unsecured credit card. My credit score now is 810 to 850. My limit is only $2100 after 8 years . If I cancel the card, it will actually hurt my credit. I don’t think they were being fair with my credit score. very deceptive. And I never at least reached the $3000 out of eight years with a credit score of 810 to 850. Merrick Banks words: may return your deposit and make the account unsecured if you use it responsibly. That limit/deposit can be anywhere from $200 to as much as $3000

MB has been reporting a charge off on my credit, but the account on my credit states is open to date and reports each month. My credit has improved outside of this issue that they won\'t budge to remove/ delete on my report. I dispute it to no avail. I want MB off my report. I would like to set up a time to discuss. They are charging me late fees of $40 even tho I have automatic payments. They are charging me 12 to 13 dollars for purchase fees even tho I havnt bought anything on top of a $4 annual fee!!!! They won\'t talk to me. They keep me on hold over an hour overtime I call. This is stealing!!! No wonder I can\'t pay thos chard off! I make payments over what the month cost I\'d. After 6 months it hasn\'t budged an inch to be paid down.

Merrick Bank has been reporting that I have a charged-off account for the past 6 years. I have never used their card. I requested they investigate, and they concluded their reports are accurate. This is wrecking my credit. I need these charge-offs removed, willing to pay for it to happen quickly.

I have been unable to make any headway on paying back my Merrick Bank account. I tried to call a few times and was just kind of passed from person to person about my complaint. I originally wanted to know why I was being charged 2 monthly interest rates, but never understood their answer. It\'s like I am just stuck.
