Harassment

The Fair Debt Collection Practices Act (“FDCPA”) is a federal law that applies to everyone in the United States.  In other words, everyone is protected under the FDCPA.  The FDCPA is a laundry list of what can and cannot do while collecting a debt, as well as things debt collectors must do while collecting a debt.  If is harassing you over a debt, you have rights under the Fair Debt Collection Practices Act.The Electronic Fund Transfer Act (“EFTA”) protects electronic payments that are deducted from bank accounts.  If took unauthorized deductions from your bank account, you may have an EFTA claim.  like most collection agencies, wants to set up reoccurring payments from consumers.  Imagine how much money gets if hundreds, if not thousands, of consumers electronically pay them $50-$100, or more, per month.  If you agreed to this type of reoccurring payment, must follow certain steps to comply with the EFTA.  Did continue to take electronic payments after you said stop?  Did take more money from your checking account than you agreed to?  If so, let’s talk about your rights under the EFTA.The Fair Credit Reporting Act (“FCRA”) works to ensure that no information reported to your credit report is false.  In essence, it gives you the right to dispute those inaccuracies that you find on your credit report.  We handled a lot of cases recently where reported debt on a consumer’s credit report.  likely reports on credit reports to obtain greater leverage over the consumer.  If is on your credit report, they may tell you if you pay the debt, they’ll remove it from your credit report.  This is commonly known as pay for delete.  You pay and they delete the debt from your credit report.  Even if not on your credit report, maybe the original creditor is.  If you pay off the debt to then the original creditor, and should accurately report this on your credit report.Several states also have laws that provide its citizens an additional layer of protection.  For example, if you live in California, Texas, Florida, North Carolina, Wisconsin, Michigan, Montana, or Pennsylvania you may be able to tack on a state-law claim with your federal law claim above.  North Carolina, for example, has one of the most consumer-friendly statutes in the country.  If you live in NC, and you’re harassed over a debt, you may get $500.00 – $4,000.00 in damages per violation.  We work with a local counsel in NC.  Our NC clients have received some great results in debt collection harassment cases.  If you live in NC, and is harassing you, you have tons of leverage to get a great settlement.

What If Is On My Credit Report?

  1. Mark L. v. . In this case, called our client on his cell phone. was attempting to collect on an alleged debt originating from a federal student loan. In or around January 2015, began placing collection calls to our client’s work telephone. called from 763-400-3498, which is one of their numbers. During one call with , our client was told he needed to set up a payment plan or pay the balance in full or his wages would be garnished. did not inform our client that he had a right to dispute the debt. Since our client lives in Texas, we alleged that violated both the Fair Debt Collection Practices Act and the Texas Debt Collection Practices Act.
  2. Betty H. v. . In this case our client began receiving collection calls around September 2016. The calls were from 716-515-0088, among other numbers. On October 3, 2016, our client answered a call from and told the representative to stop calling. Despite our client’s requests, continued to call and harass her. In this instance we alleged that violated the Fair Debt Collection Practices Act.
  3. Natalie L. v. . In this case, was collecting on a debt arising from a Federal Family Education Loan Program (“FFELP”) student loan serviced by Educational Credit Management Corporation (“ECMC”).  In September, 2014, ECMC sent Plaintiff a Notice that her wages were going to be garnished beginning October 18, 2014. was aware that our client’s wages were being garnished but despite their awareness, began collection attempts on the same debt. called our client, her brother, and her boss. told our client that if she did not make additional payments to them that they would ruin her credit, force her to lose her vehicle, file a lawsuit against her and issue a warrant for her arrest. Our client told to stop calling on numerous occasions but despite her requests they continued to place collection calls unabated. In this case we alleged that violated the Fair Debt Collection Practices Act.

Can Sue You?

Although anyone can sue anyone for any reason, we have never seen sue consumers.  It’s likely does not sue because they do not always own the debt they are collecting on.  Also, would have to hire a lawyer, or use in-house counsel, to file a lawsuit.  It’s likely collects debts through the entire country.  Therefore, it would be very difficult to have lawyers, or a law firm, licensed in every state.  There are collection agencies that do sue consumers.  For example, Midland Credit Management is one of the largest junk-debt buyers.  Midland Credit Management collects on debt and also sues on debt.  The opposite is true with Therefore, it would be very unusual if sued you.  The original creditor, on the other hand, may hire a collection firm, or lawyer, to sue you.  If has threatened to sue you, call us.  We can help.

Can Garnish Your Wages?

No, not unless they have a judgment.  If has not sued you, then cannot get a judgment.  If does not have a judgment, then cannot garnish your wages.  Minus limited situations (usually dealing with debts owed to the government for student loans, taxes, etc.), in order to garnish someone’s wages, you need a judgment first.  In short, we have not seen file a lawsuit against a consumer.  So, cannot garnish your wages, minus the exceptions listed above.  If has threatened to garnish your wages, contact our office right away.

Settlement

If you want to settle a debt with , ask yourself these questions first:

  1. Do I really owe this debt?
  2. Is this debt within the statute of limitations?
  3. Is this debt on my credit report?
  4. If I pay this debt, will remove it from my credit report?
  5. If I pay this debt, will the original creditor remove it from my credit report?
  6. If I pay this debt, will I get something in writing from confirming the payment and settlement terms?

reference no 570009532102 I have been harassed for the last few years over this debt yes my name matches the other name but my ssn# does not and I have called at least 5 times over the last 8 years over this and was told no more would be sent I would like if you would do what you say and not lie to me any more it seems that your company is fake and just tries to get random people to not ask questions and send you money they do not owe you are nothing but common thiefs

This company calls repeatedly concerning a student loan that gets paid by direct debit from my bank account every month. I have left messages explaining to them to quit calling and they still call my cell and office saying that " I wouldn't be in their system if I didn't owe " Well clearly I owe but am paying the actual loan not some third party . They also have tried to garnish my wages, luckily I have a communicative boss who asked me about it rather than just filling out the paperwork and starting the process. I've read reviews of this company and once they get a garnishment going or payment apparently it never ends, payments increase and often they collect well beyond what is owed. Be warned about this company!

I have received numerous calls and now I have received a letter in the mail from them collecting on a debt i have never heard of. The creditor is Nellie Mae. I have heard of Sallie Mae. I am currently working with FMS through the Department of Education and making payments towards my college loan. This is getting ridiculous and when they call and I ask them information they cant disclose to me but if Im the person they are trying to collect a debt from well I should be allowed to have the information. Hi Shannon, If you are already paying back your student loans to FMS, then Allied Interstate should not be harassing you, too. I am not familiar with Nellie Mae, but I have familiar with Sallie Mae. I know Allied Interstate collects on Sallie Mae student loans. Allied Interstate should have sent you something in writing regarding the debt. I will contact you to further discuss the situation. Hi Brandy, I have tons of experience with Allied Interstate. I've probably helped over 100 consumers being harassed by Allied Interstate. They're a huge company. Plus, Allied Interstate collects on all kinds of debt. Allied Interstate does a lot of collections on student loans. Especially, federal student loans. In fact, in the last 6 months, most of my clients having issues with Allied Interstate involves student loan debt. this people was calling me every minute, they even call my grandfather... this lady Belinda Johnson was so rude and don't have any manners she left voice massages so rude. and the words is that the was harassed me and said that shes going to take my account money and my taxes. plus they suspend me for my job thanks to her... i sings the papers that she send me and know i don't know my status and they took my money. this company is pure trash

I have no idea who these people are. noticed on my credit report they say I owe 115.00 My billfold was stolen last year w/ all of my cards and ID, I noticed it quickly and stopped all the cc. But they had my information. Now this corrupt company is after me. What good is a credit report if the credit agency gives they crooks credibility. I will try again. my billfold was stolen last year,I quickly recovered it after stopping all CC but they had my info. my question is: WHAT GOOD IS A NAT CREDIT REPORT IF IT ACCEPTS CRAP FROM CROOKS LIKE THIS. I just received a notice from my employer saying that Allied Interstate is garnishing my wages for Student Loans. I have not received any letters or phone calls stating that this was going to take place. If I would have even known I had this debt, I would have started a repayment plan!

They keep calling daily and get rude and loud when I ask them hat this is about. Sometimes when I answer I hear people talking in the background but they don't speak to me so I hang up. Now if I don't recognize the number I don't answer.

The student loans I had with the Federal government were written off because of a program that they have for permanent disability. My private loans I received 9 years ago would not do the same. This loan has been sold 5 times. Now it has gone to allied interstate. They call all day long never say anything. The only voice message they left; had to be from a different country. I could not understand the name of the person. I did make out that a sheriff would be coming to arrest me that day and take me to jail and also someone from their company would be coming that day to demand payment. I was really scared and upset that they could put me in jail over this. I called a family member and was told they could not do this. I had not committed a crime. I have medical conditions and it caused severe problems for me. They have called from more than one number.

I HAD A ACCOUNT FIGER Hut made arandments of 25.00 to take it out of my account on the 3rd of the month.KNOW Alliedinterstate is contacting me willing to take 150.00 to close ACCOUNT 217.40 is owed they wont let me mail it in and got nasty when i wouldnt give my credit card number.Where do i go from here

I got a student's Loan for about $6000.00 while attending Pitt Community College. My loan fell into default and when I tryed to get some answers from P.C.C, and Great Lake they had no paper work on it. They said I don't owe them anything. Grea Lake said that my account have been transfer to Allied Interstate. Now, Allied have made several phone calls to me while I'm at work. They said if I go on -line and sign the paper work stating that I owe them $18,900 and some dollars they would put me on a Rehabilitation Program paying $5.00 a month, but the payments would have to be 7 straight payments for the Rehabilitation Program to work. I refused to go that way because I didnt owe anyone that amount of money. When question about the amount they said the account is in defaultness and it has accumulated lateness and interest that's why the balance is high. Allied Interstate has already taking over $15,000 and also ganishing my wages without 1cent going toward the balance This have cause me a financial hardship. I may have no other choice but to stop work because this is not right. What kind of government do we have? Please HELP me.

I have received call from different numbers and now they are sending me letters informing me that I owe money to eBay in the amount of $203.51. When I spoke with eBay over 5 months ago I explained to them that the price they are attempting to over charge me and at that point they (eBay) kept emailing me a bill over the past 5 months along with Allied Interstates phone calls. They are calling my family members at work calling my grandparents house at all hours of the night. They are even calling my brothers house with his two young children at 8pm or later and when asked to have them stop calling this late they continue to harass and call right back. I was involved in a motor vehicle accident hit by a drunk driver and I'm trying to get back on my feet and they keep calling and harassing me

I received a letter for Allied Interstate. I don't even know what the account is for unless it is one that I had over 10 years and it is time barred. They said they have been "Retained" by LVNV who bought the debt. I found out from LVNV that they have not been retained. I called them on 5/3 and tried to inquire about the debt but the collector hung up on me. Are they allowed to use language in their letters such as Retained? To me that implies something legal and then when their client LVNV says that paid no such retainer it just seems very deceptive. Like they choose to use that language to deceive consumers implying they are attorneys or will somehow come after you legally. No problem. I tried to get Validation of the debt from me and they just shun me off telling me they are putting the account in a cease and desist status. Just basically telling me the consumer if you are not going to pay us we'll just dump you back off to our client because we have no proof of the debt. I've been emailing Brenden their VP of Legal. Brenden says he knows Mr. Agruss. I really don't want to discuss it unless you think I have a claim. I just can't believe they are allow to not have proof of the debt and lie to consumers on tens of thousands of letters I'm sure they mail out telling consumers they have been "Retained" where that is just a complete fabrication. Yes and my wife, Dana. She received this threatening letter out of the blue and I'm pretty upset about it as I'm sure many other consumers are. Thanks for any help you can give to us. Please let me know what you think and then of course we can speak. If you see no legal implication or UDAP violation for using "Retained" in a letter then maybe it is just me. I find it to be a lie, deceptive and I also think Allied specifically chooses to use that work in hopes it prompts consumer to mail in the money. Even if the consumer doesn't know what the debt is for. They don't have any proof of the debt. Their client cannot prove up the debt either. They offer a settlement and leave it open for 40 days in conjunction with being "retained" and end the settlement offer with "we are under no obligation to renew this offer." I just think the whole thing is phony and deceptive. The settlement amount is something ridiculously low like 15% of the debt or call us to make payment arrangements. I can scan and email you a copy of the letter tomorrow if you like.

Allied Interstate has constantly called me trying to collect a debt. I am in the process of bankruptcy and they won't stop harrassing me. They leave partial or no messages and when I answer and ask what the purpose of their business is they tell me they can't give me any information until I give them all my info such as name, phone,address, social security #, etc...they call at least 5 to 7 times a day, even after I told them to stop and that I'm filing bankruptcy.

They are garnishing my wages on a debt I don't owe for student loans which I expressed to them numerous times. I talk to one person than end up being connected to another stating the other person no longer work for them. They sent me promissory notes which had some of my information but had my partial name and a address I never lived at. I filed identity theft with local police station and gave that information to Allied interstate but they still are currently garnishing my wages. I dont know what else to do . What do you suggest I do. Should I just make a repayment plan since my wages are already being garnished.

My wife and I are in CH7 bankruptcy. Our debts were discharged last June, but this company along with our old mortgage lender is still harassing us. I have an atty, but he wants a steep retainer to sue. PHH Mortgage via a formal complaint I made with Consumer Financial Protection is claiming they have a right to come at us b/c they were granted relief from stay of foreclosure. We allowed them this b/c we were giving back the house to them anyway. The court papers state that Coldwell/PHH gets the house at discharge, which was almost a year ago!

allied interstate was garnishing my wages and i finally got that topped but am paying still.. they say it is for florida state college loan- but they have never provided proof and I have requested it. I only had loans through sallie may - they where co signed with my parents and those were paid off a few years ago.. they say it is a loan for florida dept of education..... i have no knowledged of that loan.. but do not want my wages garnished either so at this point it is easier to pay them.. but they have not provided anymore info!

I'm not sure. I just saw a link, after doing a reverse lookup on a phone number that is apparently Allied Interstate, LLC. They are calling a phone number that I have via Skype which I use for business purposes. I don't know what to explain. lol I have never answered, but they have called my number about 5 times in the last week and never leave a message. I don't generally answer calls from phone numbers outside of my calling area, where I conduct business, unless it is somebody that I already have in my contact list!

I have been receiving calls from allied interstate over the past few years looking for a man named William Hill. My name is MacCarthy I have lived in the same place for 19 yes. I have already reported these calls to the police, but today is the first time they gave up their nsme. Sure, they say they need to speak to him about something private, I have informed the every time my name and told them to stop harassing me but they keep calling.. They use toll free number that are unassigned this call was 1 866 473 4864!

I'm sorry I just wanted to clarify what this website is for. Yes, I've been called every day by allied interstate llc to collect a debt. Is there any action I can take? Well, it's a student loan debt, and they've been calling me almost every day for I at least a month. I set up a payment arrangement, but I wonder if I can do anything since that must constitute as harassment!

I keep getting calls from Allied Interstate and its not even me they are looking for but I havent been able to reach them. I received this phone number in July of 2014 and I am now receiving calls from Allied Interstate daily. WQhen I answer I get a recording asking for a Gorge and I press number 2 as instructed and I sit and wait for ever listening to the message that all the representatives are busy and will be with me shortly over and over again. No body ever answers.I cant reach them to tell them it's my number and Gorje's!

Just a general question, sort of. A friend has been getting calls from allied interstate, that the say isn't them because her number isn't in their system. When we called we knew they wouldn't give us info ofa personal nature, but they wouldn't even say what kind of business the company was. Is that legal? Don't they have to disclose at least that much if asked? Acetal it is right on their Web page. Not one I want to give out. As for the company It just seemed fishy!

This company will not stop calling me at 8 am. I have no idea why they are calling because other than ask for me they will not tell me who or what the call is about. I will not confirm any personal details until I know the reason for the call so we get no where other than their 8 am wake-up call. They never leave a message or leave ghost messages. Internet searching tells me they are a debt collection service but I have no outstanding debt that is delinquent. Every time they call I file a complaint with the FTC. I have never received any letters or notifications from Allied Interstate or any other company regarding outstanding debt. There is nothing on my credit report from them or any other company that isn't current with payments. Next time they call me I'm going to play along and then call a lawyer. Some ambitious lawyers should collect all this information and find a reason to go after them because from the experiences I'm reading on here, their practices are not professional, unjust and possibly outright lies. That smells fishy to me.

I was trying to send a typed message that I started this morning, but got interrupted. I have been getting calls on my answering machine from Allied Interstate for years now. It had to do with Cablevision, who succeed them on me because I cancelled their service. Years ago, when Cable went digital, and it would be necessary for me to get one of their boxes, I decided to quit them. They broadcast a phone number on the screen to call, but no one ever picked up the phone. So I wrote a note on a bill telling them to stop service, and that went unhedged also. After a whole, about 2 months, I called another of their numbers in the phone book, and got connected to some high power salesman that tried every trick in the book to keep me as a customer. He said his name was Demetrius. He couldn't sell me but insisted that I had to pay the 2 months that I didn't have any service. I believe it might have been he that turned me into the collection agencies. So, for quite some time I was harrass end by a collection agency, until I again called Cable and complained. Soon after, I got a call on my answer machine from a rep from Cable saying that they cancelled my 2 month bill where I had no service because I had no box and I had called their phone number to no avail. So I played that recording to the collection agency and the calls stopped...for a while. Then they started up again. Recently it seems that they call every day and leave a message. I tried calling their number a week or so again, after just ignoring them, but no one answered the phone. Today I called again and someone picked up the phone immediately. I told the girl I have been getting incessant calls and I was sick of it. She said their is no record in their computer that I owe anything so she admitted that they shouldn't be calling. Her name wasAlliya Rector. This morning the girl gave me a address in Virginia where I could write Allied Onterstate LLC. It was PO Box 4000, Warrenton,Va. 20188. I was going to write them a complaint letter and tell them to quit calling!

I being lock up three weeks now just get home will my payment be good on November the first if payed in full. I have a 32inch tv stolen laptop and washerand dryer I pay weekly behind in payments three weeks. No can charges be file against me for nonpayment I have the property. I wont to keep it make payments nov1. I never been in trouble before this is scary have alot of messages saying they will call the law before I make full payment this Thursday not fair!

I have a bill from allied interstate how do I get time to pay it and what happens if I am unable to pay it. Will they automatically take my monthly social security. I owe chase $8547 and it was used to live off of and pay medical bills for a year. Yes I owe chase but I just can't make the payments. I am on social security and can almost meet my mortgage, utilities, food. I can't find a job my husband is disabled. I am at a loss as to what to do. I wish someone could make this go away!

This link was available based on a comment regarding wage garnishment from allied interstare I received a notice from my employer about a wage garnishment from allied interstate on behalf of American student assistance. The garnishment had started and now they want me to pay an additional $78 per month for 5 months to stop garnishment. I had no knowledge of this debt!

Hello.. My name is Jody and I have received numerous phone calls from ALLIED Interstate. I have repeatedly told them not to call me again because they are harrassing me, after I have explained to them that I do not owe a bill to a storage unit I rented from last August 2015 thru Nov. 2015. I gave Public Storage notice as soon as I moved my belongings out of the unit last year. yes. I'm here. On August 7, 2015, I rented a storage unit at Public Storage and was never given the advertised move in price. I moved out end of October 2015 and left them a message on their phone I had moved out. They started calling and threatening me that I owed them rent and never told them I moved. They also said I left belongings in the space. I have told them I did not and asked them to stop calling me but I still received calls and letters from them. Monday is best day to call or after 3 pm other days!

I get 10 phone calls a day from all different numbers from this company Allied. They call all day and sometimes after 9 at night. My email doesn't work well so if you want to call me at any time my number is 856-217-6098 please help me to stop them from calling cuz they call every 20 minutes sometimes. They harass me at work and everything it needs to stop!

Receiving numerous phone calls on a daily basis, as early as 7 am and past 9pm from different numbers. I Initially advised them to send me a letter and to stop calling, but calls keep coming in, sometimes as often as 5+ a day. Since they require me to confirm identifying information to "discuss" a personal matter, and I am not willing to give that, I have no clue who they are collecting for. I had a Identity theft occured this month!

I have a notice of wage withholding from Allied Interstate which states that Great Lakes Higher Education Guaranty Corporation will be collecting wages unless I contact Allied. I do not know of any judgment on my account. Is this legal?

i have been receiving numerous phone calls from Allied interstate which i noticed was something that you guys at the firm handle and i would like to know what i can do. I'm almost positive that allied took over the debt from sprint (the cell phone company) and the problem with that is, the only reason that debt even exists is because of a discrepancy between myself and the sprint store i went to and when i called their customer service line, they claimed that i still had to pay it, even though i was neglected by the employees at the store on the day i went to cancel my plan (which was within the 14 day period) and regardless of what i told them they still constantly called me and then sent me to one debt collector and then it finally ended up in allied's hands, but the initial debt shouldn't have even existed!

They call every single day. I have a perfect credit rating and owe nothing but a mortgage, car loan, and credit card purchases, all of which I pay promptly (credit cards are paid in full each month and the car loan is paid up way ahead of schedule). They won't stop calling.

I was on the phone just now with a medical coach and "allied interstate" called and interrupted my call, said she was monitoring my call! She asked for Joel or Joelle a person I never heard of. I asked for he ph# she said she cannot divulge that info. I told her I would report her to the Attorney General's office and I hung up. After I hung up, my call to my coach was restored. Hi I have a question. My social security check is already being garnished 125$ a month from the Dept of education. Leaving me with $750 a month Allied relentlessly Says they can stop this. And if I pay $50 a month. For some consecutive payments They can stop the garnishment. Why in the heck whom ever is already garnishing my sos check. Settle for less. My default loans are up to 405k I’ll be dead 50 years and still owe Is this a scam I have accepted getting garnished I don’t trust these people They are relentless And it’s the student loan rehabilitation act I don’t trust anyone who calls 3-4 times a day Would I want to rock the boat now I’m 64 years old Any feed back would be great Thank you

Hi Stephen. I would recommend that you send them a certified letter asking for a debt validation letter. Debt collectors can call your references but only to get information on your whereabouts, they cannot divulge any personal information on you or about your debt to anyone but you.
