Years ago we had a line of credit at 3%. They decided 4 years or so into it they they were changing to a 2nd mtg at 9% or so. We filed bankruptcy 1.5 years ago. We were able to continue paying our house and car payments but our a try told us not to pay bmo because it would be a Leon on our house. Yesterday they hit our experian saying We were 180 days late. Can they do this?

I had a negative ballance in my BMO harris bank apparently too long. On April 23 2022 I deposited $50.00 dollars in the account so I could at least make a showing I was trying to resaulve the negative amount. The very same day I deposited the $50.00 dollars in the account the BMO Harris bank closed my checking account and reported the $43.00 dollars to the ChexSystems. Unbelievable, over $43..00 dollars BMO harris closed my account reported me, talk about rude. I'm defently going over the the bank this morning and have a talk with the manager.

We have been locked out of our BMO business account since August 2023. We haven’t been able to access our funds in our business account since we’ve been locked out. BMO has not been able to resolve this issue for 5 months which has impacted our business accounting significantly and has caused financial damages exceeding $10,000. We’ve made countless attempts to get in contact with BMO to resolve this matter to no avail. We’ve gone into local branches to seek a resolution but they told us they couldn’t resolve the matter and we needed to reach out to customer services and gave us a list of numbers to call. We called all those numbers countless times and have been placed on hold for countless hours where we finally got in touch with a representative who took initiation on the matter but stopped responding after we reached back out to inform her that the issues, she confirmed were resolved, are recuring. We’ve sent copious follow up emails outlining all of our ongoing issues but haven’t received any response. Additionally we have a commercial real estate loan and a business credit line with BMO which we cannot make payments on but get nonstop calls harassing us for a payment. We’ve disclosed our ongoing issues everytime we receive a call requesting payment and they submit a ticket/complaint to their customer service department but we never get a follow up call to resolve the ongoing issues. Our vendors refuse checks from BMO bank as their banks wont accept checks from BMO due to the ongoing issues that many BMO customers are having. Lastly, we wired money from our BMO account to make a payment early September but that wire never landed which caused us to pay $10,500 in legal fees for non-payment because we were unable to follow up on the wire payment since we’ve been locked out of our account and BMO branches wont disclose account information while the account is locked. We also don’t know the extent of the damages as we can’t get access to our account to see what fees and charges BMO has withdrawn from the money we had locked inside our account as we’ve seen countless reviews and complaints from BMO customers experiencing similar or other issues who have reported stolen/unauthorized charges and fees from BMO.

Set the list my complaints about Venmo Harris Bank below so here we go bought a car in 2018 be Harris gave me the loan the time they were my bank also so it was really easy. I just transferred my payments every payday I paid half the payment and because I got paid every two weeks and all my payments were made on time 100% And then Covid came around and I lost my job. We lost our business yada yada so anyways, I would start to get behind on my car loan, so Harris offered me one of those deferred for three months payment things that everybody was doing for Covid so they were deferring three months worth of my payments to the end of my note so I mean I took them up on it because I was out of work. They told me whenever they got close to three months being over they would call me back and see how I was doing and maybe extended another three months so three months later or 2 1/2 months later about they call me back and the guy on the phone, he even checked with the supervisor put me on hold and everything said I was good to go for a 2nd to 3 month referral which would’ve made my payment Due again in October well in September 2 weeks before my first payment after the six months of referral, I was supposed to be receiving by the way they did not have me sign any paperwork or anything for this and he’s the guy said I was totally approved for the second three months and that they would contact me if something came up and it turned out that it was not good to go. I never heard of work Two weeks before my next payment is due 5 1/2 months later BMO Harris repossessed my car out of my driveway one in the morning and it cost me I want to say roughly $1800 or over 2000 right around $2000 to recover my car While it was on a six month deferred payment plan so I redeemed my car which they noted on my credit repossessed, but redeemed which to me is unfair because because they they offered me the three month referral and they offered me a second three month referral so I do not understand how they can Repossess my car in the first damn place two weeks before my next payment was due because my payments were due on the third of the month so that would’ve made my payment due on October 3 and they repossessed my car around mid September 2 weeks before my payment was due After that after I got my car back I made my payment sometimes late but and then I got a couple of months behind and then I paid it up and then I got a couple more months behind again and then I paid it up during this time they called me two or three times a day every day and at one point in time my account was current. They close my note and wrote it off with my account current and then when they they said oh no cause I called him I said I am curious why my when I try to call in and make my you know my payment it says that I don’t have a loan there’s no loan And she’s oh boy somebody made a mistake so they reinstated my loan and in doing that and I was current when they did all this totally caught up on my payments. I paid them over $2000 and I got it all caught up then they reinstated my loan and then they said That I was three months behind on my payment and they put my car up for repossession again even though I was current and I had paid like two payments in the drive-through at the bank and I no longer had my checking account at this time so I paid two payments in cash. I believe one of those payments was a double payment and another one that was the normal payment so one of those I paid like $900 in cash and the other one I paid the 444 4684 I believe was my car payment amount so they lost the records of my cash payments at the drive-through and then they put my car on my credit report as repossessed again they had it in their stuff as in repossession status they tack on $150 repossession fee, even though they never repossessed my car so then after that, they call me like crazy every day 23 times a day every single day, not even Sundays off I don’t know what kind of a credit collections department that BMO Harris has, but it was the special special something department of BMO Harris so I believe it is their credit collection department And all of a sudden I was no longer dealing with BMO Harris bank on my loan or anything like that every time I called or needed to talk to somebody about my loan, it went to this other phone number to this collections area and at one point my loan was totally current and they were still calling me about my payment and I asked her I said excuse me ma’am, but why are you calling me? I paid my payment last week. It’s paid up to current. It’s not late. I even paid it three days before the due date so why are you calling me today about my payment that’s current. She said well I don’t know. Let me look. She said well for some reason you are on the call all the time list and excuse my friend here I asked her what the fuck is that the call all the time and you’re calling to harass me when I’m current on my payment so and every single time they left a message on my voicemail or anything like that when I didn’t answer because I’m getting two or three calls from them a day so even if I would talk to them in the morning, they would still call me back in the afternoon about my late payment and always. There was a delay when I answered the phone if I answered it, and if not, parts of my messages would be cut off so they were using the Robo collar I had to be and I’m pretty sure it was strictly a recorded message that said this is BMO Harris bank call us about your loan ending in whatever whatever you need to call us. Call us back this number. It was always a recorded message leaving a recording on my voicemail so at this point, I filed a bankruptcy in 2022 to try to save my house a chapter 13 bankruptcy and be my Harris alleged and I bought my car in 2018 and I caught all my payments up in fact when I filed my bankruptcy my BMO Harris payment except for arguing with them about the payments that they lost when they reinstated my loan which was written off and closed when it was current, which can’t be legal They reported on my credit report the entire time I was in bankruptcy, which I’m supposed to be afforded the protection of the bankruptcy court it was a chapter 13 they were receiving payments from the bankruptcy court. I was in bankruptcy about a year little over a year. I think they received a payment every month from the trustee still, they reported on my credit report throughout those months I was over 90 days past due so and I was current. I was really makes me angry. Is that when I filed the bankruptcy I was current on my payments with BMO Harris. I just had to argue with that with them. I was in the process of with a supervisor. I asked the supervisor to please send me a list of all the payments that they showed I made so that way I can bring them the receipts for the payments. They don’t have that they lost. I never got that list. I called them at least five times. I talked to a supervisor two or three different times and they never sent me the list of payments they showed that I had made on that loan before they closed it and wrote it off and still somewhere in my file cabinet. I have the receipt for the ones that I made in person at the drive-through at the bank in Sun Prairie, Wisconsin, which was my local bank at the time so I’ve been trying to figure out what to do it’s been seven years now and my loan was for 84 months. It was only for a $31,000 loan anyway I filed the bankruptcy in about a year or so later it was dismissed because I had an issue and I couldn’t make my mortgage payment and my $2000 a month bankruptcy payment at the same time which was almost $4000 a month on my $120 an hour wage Somewhere over $12,000 and they said I owed zero dollars in payment 0.00 and I hadn’t paid any interest yada yada yada they sent me these for five or six months. I got the same statements that said I owed nothing so I’m like OK then I didn’t pay him because my payment was zero then in January all of a sudden I got a small those statements that said that the $12,000 and I have put a payment of $340 And instead amount of this payment that will go to principal and the answer for that was zero so how are they gonna say that I need to make a payment on my car loan and none of that going to my principal that’s like 100% interest rate so you know I meant to call him but the next month they sent me another statement. My statement said I owed 12,000 whatever dollars plus it was $340 more so they take the $340 that I didn’t pay for January onto February statement. This was just February of last year and I just had started a job right it’s beginning in January when I started getting these payment things, but they all said $340 and they said none of it was going to the principle of my note so how are you going to take $340 a month and not give me a dime of it towards the actual car payment for the car on the principle of the car and then also if I didn’t pay it, they added that amount onto my note. They did this for four months by the time they were done my payment in four months time went from that I owed the amount I owed went from 12,000 and something dollars to over 16 almost $17,000 in four months And they all said I owed 340 and that none of that paid on the interest. I have a 6% interest rate six so in April of last year they closed my note and they wrote it off now. My credit report shows that my car has been repossessed again. It showed as being repossessed before they even close the note and wrote it off. Pretty sure it said it was repossessed while I was in bankruptcy on my credit report so my credit report has said my car was repossessed for a couple years now and my car is breaking down now and I desperately need to buy a newer car because it has 162,000 miles on it and it’s starting to go to shit And I have to have a reliable transportation for my job. That’s what I do so how what can I do? Can I sue them? I would like to I would like to sue them. I would like them to remove everything off my credit report and they should be sued for you know putting me on some call all the time list where they harassed me For months in and even if my payment was current, they harassed me and if my payment was due on the third if the fifth or the sixth wrote around and I had a 10 day grace period and I hadn’t made my payment. They would call me when I was three days late. I will never ever ever sign another loan with BMO Harris again I will never do business with them again they close my checking account for a $35 overdraft which I in and didn’t say anything to me at all about it and I went to cash a check for $950 at the ATM and it kept the check and it would’ve put the money on my account and when I tried to look into it, my checking account was closed also and they made me wait for that money For like 10 days for that check to clear OK so the check cleared when the check cleared I went through the drive-through. I got my money in cash minus the $35 that I had owed for a check that was overdraft fee and then in the manager is at the branch. He told me you know once this place you can you can reopen you know since you paid this check there you paid this that means you close your checking account close with a zero dollar balance it’s all gonna be fixed. You can go back in and get another checking account cause I’m like this is how I pay my car payment I just deposit the money and then I transfer it over to my car loan. He said I could reopen an account to this day. BMO Harris still will not allow me to open an account I desperately need needed to be able to open an account and then whatever they put on my account. They also sent the $950 to a collection agency saying I owed it even though my account was closed with a zero dollar balance And they they made me wait almost 2 weeks to get that money for that shit until that shit cleared at the bank, it was written off of. I had to wait to be able to get the funds which put me in a huge bind and then they sent me to a collection agency stating that I owed them $950 in overdraft from that checking account Which was closed with zero dollars owed zero balance you paid me $915 in cash at the window and took out the $35 that I have been overdrafted and that included overdraft fees and everything so why I have a bill collector after me now for $950 which was due to a check that I cashed and and I waited for that sucker to clear from the written the bank it was written on I have no idea because my checking account had a zero balance whenever I closed it, I have not opened another one still in the checking account associated with the $950 that they’re trying to collect for me is my checking account and literally I checked that checking account every day to make sure there were no overdraft and so my overdraft that they closed my account for was literally on there a couple of days and then they close my checking account Maybe a week I’m just waiting for a payday so be Mo Harris is horrible. They do not do any collection practice since the legal way as far as I can see and they have their own credit collections department it’s a BMO Harris special finance department, which is where they harass you and stuff. I guess that’s how they get around that those laws that only can go to the creditors, but the credit collections but if it’s credit collection department is not be Harris bank anymore it’s just it’s run by Harris, but I believe they’re separate separate phone number and address and everything so I’m not sure how this works but my car only cost me $31,000. I paid on that car. I paid many payments on that car. I mean I had that car already over two years whenever Covid hit hard and I lost my job and then they were supposed to defer six months worth of payments but they did Not And instead repossessed my car so I had to pay a 400 whatever dollar repossession fee 100 and some odd dollar repossession fee to them then I had to pay the repossession fee to the wrecker place that came and pick my car up at one in the morning out of the driveway and also I paid it. I had to pay back all my payments. I was behind that they said they were deferring. It cost me. I believe it was $2500 to get it so it shouldn’t even been that much money because they said I was only that I was only you know they deferred three months payment so it was in the second three months so I shouldn’t even have been three months past due. If they repossessed my car I wasn’t. I was just you know as far as I knew I wasn’t to do it all so I believe that’s illegally repossessing my car and then I don’t know if they gave me credit for the payments that I had to pay to get my car back either And then twice they’ve put 100 and $130 or $150 repossession fee that they said I owed them later when they never repossessed my car just because it was over 60 days past due. I paid it up in full right as it was almost to the 90 days I caught it up and still they charged me $150 repossession fee even though I did not repossess my car so how they can do that either I don’t know like I said they do not follow the law they do a lot of illegal practices And I do have my statements somewhere where it shows that I owe zero dollars and then I owe $340 payments and that’s what they put on my credit report to that my payment was $340 but I didn’t pay it. How can I do that if my interest rate is 6% that means only 6% should go to interest and the rest of it should go to my principal. I probably should’ve called or consultation, but that is my complaint for BMO Harris and right now they’re not calling me because they don’t have my phone number. I lost my home. They don’t have now. I just changed my address so they have it but it’s been a year in April since they closed and wrote off my note and I still have my car And I just talked to somebody in a debt solutions area that said if it’s been a year since they closed your note and wrote it off and they are showing your car is repossessed if they were going to take it they would’ve already come and got it. They’re not gonna come and do anything to take it now Cause my credit report shows that it was closed and my note was closed and written off in December, I mean in April 2024 I think I have a hell of a lawsuit. They should give me back everything I paid for this car for all the hell I’ve been through with them and everything they’ve done to me and now they’re ruining me totally I can’t. I can’t even get a $500 personal loan because of them And you know they do credit check so you can get a place to live also and I lost my house so I’m not gonna be able to. I can’t even rent a place cause I can’t pass a credit check to rent an apartment so I’m currently been homeless as well. Currently, I am living in a camper at a campsite paying a month what I should be paying to rent an apartment or a house somewhere definitely for $950 a month plus electric I could rent a place except I can’t pass a credit check.
