Who is CareCredit, LLC?

CareCredit, LLC is an original credit service based in Kettering, Ohio. Founded in 1987, this agency is not accredited by the Better Business Bureau (BBB).

CareCredit offers a special credit card that is dedicated to covering out-of-pocket health care expenses and the agency partners with over 200,000 health providers/retailers nationwide, including major retailers such as Walmart, Walgreens, and Duane Reade. There are an estimated 11 million CareCredit cardholders.

CareCredit Lawsuits

If you want to know just how unhappy consumers are with CareCredit, take a look at the number of complaints consumers have made online. Nowadays, most original creditors, credit card companies, etc. have arbitration clauses, which means that if you have a complaint against that company, you must file your claim in arbitration. Arbitration limits discovery, is not public, has a limited appellate process, and, most importantly, is funded primarily by banks and big businesses. While it can be difficult to get a fair chance in arbitration, the good news is we have filed hundreds of credit harassment cases in arbitration, and we know how to aggressively fight these cases against the big banks and businesses even when arbitration is necessary.

CareCredit Complaints

The Telephone Consumer Protection Act (TCPA) protects you from robocalls, which are those annoying, automated, recorded calls that computers make all day long. You can tell it’s a robocall because either no one responds on the other end of the line, or there is a delay when you pick up the phone before a live person responds. You can receive $500 per call if CareCredit violates the TCPA. Have you received a message from this agency that sounds pre-recorded or cut-off at the beginning or end? These are tell-tale signs that the message is pre-recorded, and if you have these messages on your cell phone, you may have a TCPA case against the agency.

The Electronic Fund Transfer Act (EFTA) protects electronic payments that are deducted from bank accounts. If CareCredit took unauthorized deductions from your bank account, you may have an EFTA claim against the agency. CareCredit, like most collection agencies, wants to set up recurring payments from consumers; imagine how much money it can earn if hundreds, even thousands, of consumers electronically pay them $50 – $100 or more per month. If you agreed to this type of reoccurring payment, the agency must follow certain steps to comply with the EFTA. Did CareCredit continue to take electronic payments after you told them to stop? Did they take more money from your checking account than you agreed to?  If so, we can discuss your rights and potential case under the EFTA.

The Fair Credit Reporting Act (FCRA) works to ensure that no information reported to your credit report is false. In essence, it gives you the right to dispute those inaccuracies that you find on your credit report. We’ve handled many cases in which a debt collection agency reported debt on a consumer’s credit report to obtain leverage over the consumer. If CareCredit is on your credit report, they may tell you that they’ll remove the debt from your credit report if you pay it; this is commonly known as “pay for delete.” If the original creditor is on your report rather than the debt collector, and you pay off the debt, both entities should accurately report this on your credit report. 

Several states also have laws to provide their citizens an additional layer of protection. For example, if you live in California, Florida, Michigan, Montana, North Carolina, Pennsylvania, Texas, or Wisconsin, you may be able to add a state-law claim to your federal law claim above.  North Carolina, for example, has one of the most consumer-friendly statutes in the country: if you live in NC and are harassed over a debt, you may receive $500 – $4,000 in damages per violation. We work with a local counsel in NC and our NC clients have received some great results in debt collection harassment cases. If you live in North Carolina and are being harassed by a debt collector, you have the leverage to obtain a great settlement.

How do we Use the Law to Help You?

We will use state and federal laws to immediately stop CareCredit’s debt collection. We will send a cease-and-desist letter to stop the harassment today, and if CareCredit violates the FDCPA, EFTA, FCRA, or any state law, you may be entitled to money damages. For example, under the FDCPA, you may receive up to $1,000 in damages plus actual damages. The FDCPA also has a fee-shift provision, which means the debt collector will pay your attorneys’ fees and costs. Based on our experience, some debt collectors may credit-report, which means one may mark your credit report with the debt they are trying to collect. In addition to or instead of the debt collector, the original creditor may also be on your credit report in a separate entry, and it’s important to properly identify these entities because you will want both to update your credit report if or when you pay off the debt.

Can CareCredit Sue Me?

Yes, CareCredit can sue you. CareCredit can hire a lawyer to file a breach of contract lawsuit against you for the underlying debt, fees, and costs. Top Debt Collection Violations

Debt collection laws provided a laundry list of what collectors can and cannot do while collecting a debt. Based on our years of experience handling thousands of debt collection harassment cases, here’s what collection agencies most often to do to violate the law. 

  1. Called you about a debt you do not owe.
  2. Called you at work after you told them you cannot receive calls at work.
  3. Left you a message without identifying the company’s name.
  4. Left you a message without disclosing that the call is from a debt collector.
  5. Called third parties (family, friends, coworkers, or neighbors) even though the collection agency knows your contact information.
  6. Disclosed to a third party (family, friends, coworkers, or neighbors) that you owe a debt.
  7. Contacted you after you said stop calling.
  8. Threatened you with legal action (such as a lawsuit or wage garnishment).
  9. Called you before 8:00 AM or after 9:00 PM.
  10. Continued to call you after you have told the collector you cannot pay the debt.
  11. Communicated (phone or letter) with you after you filed for bankruptcy.
  12. Failed to mark the debt on your credit report as disputed after you disputed the debt.

Frequently Asked Questions

  1. Do I have to pay your fees and costs for helping me with my consumer rights case? No. We handle consumer rights cases based on a fee-shift provision and/or a contingency fee. That means either the other side pays your fees and costs, or we take a percentage of your recovery.   2. What are the damages under the Telephone Consumer Protection Act? You can get $500 per robocall, or $1,500 per robocall if the robocalls were willful. In any type of settlement, oftentimes Defendants pay much less than $500 per call. However, if there are 50 calls at issue, even at $250 per call, your case could settle for $12,500.00.

  3. Are there state laws that protect me from original creditors? Yes! Several states also have laws that provide their citizens an additional layer of protection. For example, if you live in California, Connecticut, Florida, Kansas, Massachusetts, Michigan, Missouri, Montana, North Carolina, Nevada, Oklahoma, Pennsylvania, Texas, and Wisconsin, you have additional state-law rights.

  4. What type of debt is covered under state laws that protect me from original creditors? Only consumer debt, such as personal, family, and household debts. For example, the money you owe on a personal credit card, an auto loan, a medical bill, or a utility bill. State laws usually do not cover debts you incurred to run a business, or debts regarding unpaid taxes, or traffic tickets.

  5. Does the Fair Debt Collection Practices Act apply to banks or credit card companies? No. Only third-party debt collectors are bound by the FDCPA. That is, original creditors, such as credit card companies and banks, are not bound by the FDCPA.

I'm a provider - care credit is allowing my competitors to sign up for their services - the very same services I offer, but I, as a physician psychiatrist cannot sign up. A neurologist or primary care physician can. I suspect they cost me hundreds of thousands of dollars in lost revenue due to this unfair business practice. I think this is illegal.

what happens with deferred payments when one is in arbitration with one of care Credit providers? Can Care charge you penalties and higher interests while amount is pending arbitration and scheduled for hearing?

Hi Elina. Arbitration has many rules that must be followed and each arbitration organization has those rules listed online. Did you or Care Credit initiate the arbitration proceedings? Do you have representation through the process? Arbitration can be a risky undertaking if you're not experienced in the process and you may wish to find someone that can help you. Care credit is trying to collect for a debt from Western Dental. At this point I don't know if its them or Western Dental I should go after. I keep disputing the amount and they keep saying I owe it. When there was absolutly no work done on me except a consultation and exrays. I'm lost at this point and they just keep calling.

I've had an ongoing issue with synchrony bank (CareCredit). I had an initial charge of 600 or so dollars, so I could get a crown at Albert Dental in Overland Park, KS. I was never able to go in, and actually get the dental work done. Nevertheless, they charged my carecredit for the work that wasn't completed. Carecredit had put me on some special promotion at the time, that if I paid off the debt in a certain window of time that there would be no interest. I set up auto payments to complete it in a certain amount of time that apparently didn't stick, and I've paid my debt 3 times over in fees now, upwards of 3000 to 4000 dollars I'd say. I have tried to ascertain my billing history since I opened the account in January of 2019, but synchrony bank apparently doesn't have this information, and tell me to call the carecredit customer service. They proceeded to give me a spoof number intended for carecredit but it was for some emergency care hotline in India. I called 18002927508, they gave me the number 8663968524. If I call carcredit's actual number it just puts me right back in cycle to synchrony financial. I feel like I'm in the middle of a scam, and all I keep doing is throwing these people money. The interest in INSANE, and it is absolutely destroying mine and my cosigners credit. I feel like I've read alot of forums with people having shady dealings with these people, and this is only my first time trying to dig any information out of the them and I was unsuccessful. I really have no idea what to do, because I don't have an extra 2000 dollars to throw at them right now to end this vicious cycle.

Care Credit is taking me to court to recover debt for $750. It is now $1000. Is this legal? They have a third party handling this. My case is on the docket June 1st in Fairfax County. Do I even need to attend this?

I just sent you a text. A person named Jonathan Franco left me a voicemail saying he was a legal courrier. He gave me the call back number of 833 431 3461 and a case number of F 433709. When I called they transfered me "upstairs" and a woman came on and said it was about a debt from Care Credit from 2009. I asked her which state or court or county it was from and she said she did not know or could not tell me just it was care credit.... I DID have a care credit account in 2004 or 2005 maybe even 2003 but it was for 700$ she claims this is for 2000 and some odd dollars.... ALSO I paid off the original care credit charges with 35 a month payments and had the card paid off in 2007 or 08... I do NOT recall ever using that card again AND in 09 when they claim this debt occurred I was in the hospital after being hit by a DD... I was in hospital or rehab or bed ridden and home with round the clock care from july 21 2009 thru Sept 2011 I did NOT use care credit to pay for any of that.... medicaid paid for that... and after the lawsuit was finished all the money awarded to me went to pay off medical bills and debt. ALSO this alleged care credit debt has never been on my credit report as care credit OR syncrony bank. I have not recieved any mail or bill from care credit, synchrony bank or collection agencies. Today's phone call has been the first I heard about this. Suppossedly this person is going to deliver a summons to my address but I do not think this is legit. As I stated, I have never heard of this bill, by mail, email, phone or collections until this morning Tuesday August 9 2022.... Also IF somehow I "forgot" about this alleged debt wouldn't statue of limitations be well passed date? I lived in Florida in 2009 until I was able to be transported to my mother's in CT in Dec of 2009 where I then was in and out of hospital and rehabiltation centers and had many many surgeries. I had 2 very trusted people collecting my mail, and tracking ALL bills. And I was paying off all my credit cards with the little savings I had. I think this may be a scam, but if it is not I would like to counter claim for the stress this call has put me under and the negligence on their behalf of not contacting me years ago, months ago days ago weeks ago and years ago again to have this settled. Please assist me. Thank you

On Oct 6, 2022 I paid my CareCredit account in full. Today, my credit report went down 35 points after CareCredit reported my account late owing $21 which was supposedly and uncollected interest charge plus late fees. I called the bank and they adjusted the account to zero acknowledging that I did indeed pay the account in full in October. However, the damage to my credit report is significant. This behavior should be address at the court level... perhaps you might consider a class action suit on behalf of many others who have been caused damage this way.

NEWPORT DENTAL GROUP CHARGED ME OVER $9000.00 WORTH OF DENTAL WORK HE DID NOT DO. ....THRU CARE CREDIT/SYCHRONY BANK I HAVE BEEN DISPUTING THIS CHARGE FOR OVER 6 MONTHS. THE DENTIST KEEPS SUBMITTING FALSIFIED DOCUMENTS WITH MY FORGED SIGNATURE AUTHORIZING TREATMENT....I HAVE THE ORIGINAL DOCUMENTS NEVER SIGNED OR AUTHORIZED. I ALSO HAVE A PANORAMIC XRAY FROM MY PRESENT DENTIST SHOWING (PROVING) THE WORK I WAS CHARGED FOR WAS NEVER DONE. CARE CREDIT /SYCHRONY BANK WILL NO LONGER RESPOND TO MY MESSAGES....MY BILL JUST KEEPS ADDING UP, BUT I AM NOT PAYING FOR WORK HE DID NOT DO. I ALSO WANT TO TAKE NEWPORT DENTAL GROUP TO COURT FOR SUBMITTING FALSIFIED DOCUMENTS.

I’m a care credit customer (low income bracket) I payed off one charge of $1,000 In a few months the second time around I charged a $1,075 for a crown I’m paying the monthly min or little bit more each month it’s been almost two years I pay about $45.00 a month it goes down to $1,000.00 then I get a bill it back up to $1,045.00 it is ridiculous with in the first year no ingest charges then after that they add like a huge amount in my case $300.00 it was like I’m not paying my bill at all it’s been a couple of years

care credit has erroneously applied payments i.e. they have not applied promotional balances to the promotional balance intended and charged me 25% or more on the unpaid portion for years. I have a long documented history of promises to reverse charges . How do I end this matter ?

Syncrhrony Bank sent me a letter indicating a balance of $5994.50. I do not have an account on record through Apen Dental. I visted one of their offices in Hot Springs, AR 02/272024 and had an x-ray and visit with dentist for possible route. They asked for my SS# and I was approved instantly. I did not like the dental clinic and their advise and told them forget it. I never received any agreement about an account number or documentation of an approval from care credit or terms of a loan. I closed the care credit account within 24 hours of getting a so called appoval even though I never received or looked at a contract from care credit and never filled out an application for a credit card with care credit while on my visit to Aspen Dental of Hot Springs AR. I have followed up with the credit agencies ( all 3) and have have placed a fraud alert.
