The Telephone Consumer Protection Act (TCPA) protects you from robocalls, which are those annoying, automated, recorded calls that computers make all day long. You can tell it’s a robocall because either no one responds on the other end of the line, or there is a delay when you pick up the phone before a live person responds. You can receive $500 per call if Specialized Loan Servicing violates the TCPA. Have you received a message from this agency that sounds pre-recorded or cut-off at the beginning or end? For example, if you live in California, Florida, Michigan, Montana, North Carolina, Pennsylvania, Texas, or Wisconsin, you may be able to add a state-law claim to your federal law claim above.  North Carolina, for example, has one of the most consumer-friendly statutes in the country: if you live in NC and are harassed over a debt, you may receive $500 – $4,000 in damages per violation.   1. Do I have to pay your fees and costs for helping me with my consumer rights case?  No.  We handle consumer rights cases based on a fee-shift provision and/or a contingency fee.  That means, either the other side pays your fees and costs, or we take a percentage of your recovery.  Whether it’s a fee-shift case or a contingency-fee case, we don’t get paid unless you get paid, and you’ll never owe us a penny for our time.

  3. Are there state laws that protect me from original creditors? Yes!  Several states also have laws that provide their citizens an additional layer of protection.  For example, if you live in California, Connecticut, Florida, Kansas, Massachusetts, Michigan, Missouri, Montana, North Carolina, Nevada, Oklahoma, Pennsylvania, Texas, and Wisconsin, you have additional state-law rights.

  4. What type of debt is covered under state laws that protect me from original creditors? Only consumer debt, such as personal, family, and household debts.  For example, the money you owe on a personal credit card, an auto loan, a medical bill, or a utility bill.  State laws usually do not cover debts you incurred to run a business, or debts regarding unpaid taxes, or traffic tickets.

  5. Does the Fair Debt Collection Practices Act apply to banks or credit card companies?  No.  Only third-party debt collectors are bound by the FDCPA.  That is, original creditors, such as credit card companies and banks are not bound by the FDCPA.

Here is our experiences: Our Mother, that passed away, had a loan, line of credit, with Bank of America that was sold to SLS Servicing Loans. Our mother loss her restaurant (source of income) was in and out of the hospital before passing away in Oct. 2019. All of this happened in the span of 7 months. Back to back it was something and she failed to pay on that loan. When she. passed we took a month to process. We collected her bills and reached out to SLS to have the validate the debt. During this time they continued to send 3-4 letters with interested added while we had to submit paper word of being an executor of the estate. Then once we ere able to access her files they continue to send more letters and added more interest and still no proof of debt owed. When it was validated we then applied for Mortgage Loan Assistance to get our options and reduce the interest. They then sent an attempt to foreclose from a lawyer. They also came by the house to take pictures. What we owe compared to the value of the house is less than 5%. During this time we had continued to find out by calling weekly about further documents need even when online it would state something else. Also every time we called it would be something different needed. They only way we would get status updates if we called or checked or mail which would also take long to receive. Now we logged into our account an our application is gone and more interest has been added. We are proactive in trying to settle this with no proper communication on what do moving forward. Not one person has been consistent in assisting us. If it was not for COVID19 we believe they would try to foreclose on us. We just want all fees and interest since her passing reduced.

I have been dealing with this mouse house for too long they have reported me late on payments I was not late on . I have repaired my credit and SKS has reported again I was late and I was not lowering my credit score making it impossible to get any loan and when the loan officer tryes to contact SLS they can not .They have harassed me on the telephone, used automated message, and took money from a so called suspense account . I am a Black property owner I have been in a modified plan with $L$ too pay $920.00 per month starting 01/20. I have made each months payment @ $919.40 & more but am not current through 06/20 which over $1457.00 was PAID. Over the last (10),years I have been defrauded,experienced a Jim Crow style property seizure & a mortgage company break into my property damage the HOME & change the LOCKS.

SLS came out of blue. They think they bought a real debt or whatever but they didn’t and it has been contested in writing. It was done within 30 days and sent via registered mail, signed for on 4/20. They sent a letter stating they had received the dispute and the dispute was under evaluation and they would let me know the results. They never did. More than 90 days have passed. No validation. The calls, letters and robocalls never stopped. They abused and harassed and lied and worse, maybe, they sent contradictory info through the various channels. “Congrats!!! You’ve been approve for a forbearance!!” Never asked for a forbearance. Then something threatening would come. My wife and I are regretfully members of a protected class. We’re disabled. Mostly back and neck stuff (horrendous surgical malpractice for me - that’s why I’m disabled and my life, though I’m always cognizant of and thankful for all that could be so much worse. In so many ways. My surgeon could’ve easily killed me or made me a quadriplegic, likely to be dead by now from COVID19. I mention the medical stuff bc a) protected class and b) they were informed and only abused us for it. They knew we were in extremely fragile mental and physical states and their refusal to follow any laws at all made everything infinitely worse for the both of us. Our marriage hung by a thread. It was amazing before that. We can barely function, we need help and everywhere we turn seems to little more than another SLS looking to break off a chunk of cash. Well, in this particular case, I LOVE the sound of that. I’m looking for someone who will attack our tormentors, out an immediate end to all the harm they have knowingly and illegally caused. They never appeared ever before on my credit report (not should they have) until 2 days ago when they posted 150 day late complete BS. I mentioned the 800+ of 850 credit scores? The pre-disability lives as dynamic aggressive entrepreneurs and high achievers. We were the American Dream in the flesh. We can from nothing and built a very nice life for ourselves - or, what should be a very nice life but is instead a near constant state of super high anxiety, chronic pain, depression and on and on. I hate the fact that this happened to me. I have zero desire to be filling out this form - I want your help, I just mean that I’m the scheme of things, I’d just as soon not have a lunatic felonious “bank” trying to ruin my life because they are confused, ignorant, incompetent, cruel and just plain awful. No one should be treated this way. Even if we were 150 days late - which we can’t be because there is no debt owed and never was. Look at our credit reports/histories. Diligence dedication focus prioritization are all the sorts of descriptors that should pop off the pages. I could write the check for the full amount they falsely claim a I owe. But these rat bastards not only stomped all over our rights but they tortured and abused us. And now, since they decided to post 150 day late without a word to my Experian File, the other agencies got wind of It and all crushed my 800+ Scores down into the 600s. I’m trying to refinance my “jumbo” mortgage and buy a new car - used car, I never buy new and doubt I ever will. I have no idea if I should continue the refi and car purchases or abandon all hope due to the aforementioned insanity we’ve been subjected to. Trans Union is so confused that they’ve counted the fake debt twice so they show that my “credit line increased $100k” when all it is is more stupidity, carelessness, recklessness and more. So, it seems that CRA foolishness may have in certain distinct ways actually exceeded the harm cause by the initial 150day late lie posted by SLS a mater of 2 days ago. All day today J was hit with more than a dozen emails texts and notifications from various credit monitoring services and banks. Being disabled is hard enough without soulless corporations knowingly torturing you for fun. When your spouse is also disabled, it’s beyond comprehension typically by anyone who hasn’t lived it themselves or isn’t some sort of gifted empath. Anyway, we have little bandwidth and less desire to go through the motions with all of them. I’m angry and I don’t want to say things I shouldn’t or even be mad at whatever poor souls answer the phone when i call. It’s not their fault - unless I’m calling the owner, CEO, etc. So, I’m really hoping that you’re as disturbed by the way we’ve been tested - apologies of this is difficult to understand, I have to take a lot of meds thanks to the careless surgeon and find that I sort of fade in and out a bit and jump around even more, or so I’m told :). We’re due hundreds of thousands of dollars if our understanding of the laws and penalties and so on is close to accurate. I’d much rather provide you the info you ask for and defer to your expertise. I owed $79,000 equity loan with Bank of America and it was transferred to SLS. The equity loan was opened in 2005 and made payments. I was unable to pay for maybe 6 months and then I send them a payment of 53,000 in 2020. They are telling me that I still have a balance of 56K. I checked my credit report and it says that 61,086 was charged off! I am still paying a monthly payment of $734.01. I've been contacting SLS with no luck

I'll try to be brief: Bought a new construction home May 2007. Countrywide and Ponderosa homes packaged my loan ($514 Jumbo and $64K HELOC Purchase Loan). When the market crashed my former home failed to sell. My husband lost his job, etc. In 2009 I modified my Countrywide Loan which was now with BOA. I was told that the $64k purchase loan was discharged, written off, etc. That I owed nothing. However, I occasionally received statements about the $64k on but when I called, they said NO PAYMENTS were needed. That the amount was a charge-off and the statement was for me, just in case I wanted to pay. In 2019 I put my home up for sale because I decided to downsize and secure secure money from my equity for my kids going to college. Now divorced, the entire burden was/is on me. SLS the servicer for the $64k purchase loan placed a lien on my home as soon as they learned I was selling and then demanded $116k. The new amount with 8% interest since 2007. I secured an attorney but he just wrote 1 letter then disappeared on me after reassuring me to go ahead and sell my home with his guarantee that although I'd ay something, I would not pay the 8% interest and fees SLS had added to the debt. In the end, I felt immense pressure to sell my home with no help from my realtor or attorney (he did nothing!) in order to avoid forced sell/foreclosure as they had threatened me. I sold my home and LOST $116k to SLS the fall of 2019. This is still very painful for me. I feel like an idiot who was completely overrun. I have all my efforts documented, miles and miles of notes still. If you can help me recoup any of this money I would be eternally grateful.

My home equity loan requires a court order to foreclose but they're trying. To fast track my property by ignoring the legally required court order and sell it in a trustee sell which violates the Texas Constitution.. they've already posted it illegally/with out a court order to sell in the 3-2-2021 trustee sell. I received a Default Notice and Notice of Intent to foreclose from SLS. They have not recorded the NOD nor posted the appropriate paperwork on my property. My first mortgage is paid off but my second mortgage is in default. Can SLS move forward with foreclosure on my second mortgage without an attorney?

loan was with green tree and had home refinanced then started hearing from ditec finc; said sls llc had bought loan loan was like 63,000 been paying on it for 26 years called for payoff sent me a letter stating i still owe almost 36,000 we got behind when my husband broke his leg but we caught it up sent 3200, check called ask them how they have my daughters lane in lean so they changed it saying i gave them one of my lots took them did not sent me a copy showing my name on lot lean i did not put up any land for loan so how they get paper with my signature they said i owned a house that,s bull i have a 1996 double wide they try,ed to foreclose said they could take my land the double wide is on another lot tired of dealing with these people, after along period of time they quiet calling had a lawyer trying to do some thing almost cost me everything he filed chapter 7 had to get him to file a dismissal had to call him back they said they never got it

Hello, I would like to speak with an attorney to evaluate a HELOC that I had with e-trade. This loan I thought was closed/charged off back in 2009 and now this debt collector (SLS) is threatening to foreclose on my home if I don't pay the original principal balance + interest and late fees all the way from 2009. Original loan with First Franklin in 04/2007, a first and second. When housing market crashed in 2008 my home value dropped by 33% and First Franklin modified my loan and new payments commenced. There was no subsequent collection effort on the second which I believed to be rolled in and partially forgiven with the modification as many loans were with the housing market crash. Now, in 2022 I am trying to sell my home and there is a lien on the property and Specialized Loan Services is demanding $89,000 principal and over $163k of interest on this loan. I am permanently disabled and was a single father until remarried in 2017. I am living on disability and a small annual annuity from my injury, and rent from this property and planned on living on the proceeds from the sale. With this lien and the first mortgage, I will have to pay out of my pocket to cover the taxes from this sale, with no funds left from the sale. My payoff will be $165,000 more than I paid for the home in 2007. I need assistance on how to negotiate a reasonable payoff on this note.

SLS has sent someone to my house a few times a months and takes pictures of my kids through our window. I only found out I had a second mortgage from 2006 after I tried to refi my house. after I called them to settle, they made it impossible to settle the debt and in less then three years of contracting them they have more then doubled the amount I owe after not knowing I had a second mortgage. They refuse to deal with my or work with me on the amount, it’s a horror story.. SLS is criminal and I need help.

I bought my house in 2006 with Countrywide. They transferred it to BOA. I have lived in my home since that date. I received a modification from BOA where they wrote off about 80k from my mortgage and sent me a tax notice. I then began receiving collecting calls from SLS aggressively on a daily basis, multiple times a day fighting with the same man. I have since received a foreclosure e notice in October 2022 which I paid a disputed debt of 32k. I did not make any additional payments to SLS. I then received a second notice of foreclosure October 2023. I purportedly owed them 43k on a HELOC loan that I never took out. I just paid them another 9k yesterday, again disputed debt. I have asked repeatedly for the breakdown of fees and charges. I have not received it. I have filed a complaint with the Consumer Affairs Bureau. I am aware that they have been sued successfully and they are merging this company out of their name. To add insult to injury after paying 41k on a 43k debt, I am told the balance is still 40k. I m completely over this company and I NEED HELP!!!!

I got a 2nd mortgage out with them a year ago. I lost my job in September I told them about this I asked about deferment they didnt want to help. They made me set up on auto withdrawl and never take the payments when they are supposed to. I had 3 NSF come out. They have been paid every month. I even paid late fees that I shouldnt have just to keep it in good standing. I called and said hey you didnt take my money out this month and they said to make the payment again. I did they took it and held it for 2 weeks saying that I now needed to mail them a check. I had to wait for them to send the money back before i could sent a check. I asked for all calls to be pulled at least 30 times. They call me everyday harassing me saying they arent at fault. I put it in writing and on recorded line I need someone to call me after 430 eastern time as I now work. I cut them 2 checks 2 days apart directly from my bank. I had to borrow money to maintain the good standing. They lost the 2nd second check but still have not admitted to losing it. They reported me late to the credit bureu. I cannot get anyone that knows what they are doing on the phone. This is stressing me out. I spend more time trying to communicate with them more then anything. I have proof of all contact to no avail. I am trying to get another loan to sell my house and they keep messing with my money and my credit. It is affecting my mental health having to call them everyday with the stress of them reporting me late again due to their error.

SLS is double charging me for Escrow. There is NO ONE who understands any type of conversation. You are transferred, put on hold, ridiculed, laughed at, and criticized for trying to make them DO THIER JOBS CORRECTLY. How can you work for a Mortgage lender and not know how to calculate ESCROW. I have spent over 12 hours (from 8 AM - 9 pm) waiting while they transferred calls from one idiot to another. They work on the WAIT, DON\'T do anything about anything MODE. I really wonder if there is ANYONE in the entire organization who is ETHICAL or is smarter than a 5th grader!

SLS bought the servicing rights to my second mortgage in 2019. I have always made my monthly payments. With a recent credit score in the 700s, I made an offer on a new home and sold my existing one. But I was then horrified to find that my credit score had dropped to the low 500s because SLS reported FOUR late payments in the previous year, No bank on earth will approve me for a mortgage now, nor do I even qualify for a decent rental. These days, I probably can\'t even buy a doghouse on layaway. I made my payment on time every month and have complete bank records and even acknowledgement emails from SLS to prove it. Yet SLS keeps insisting otherwise and won\'t back down. Because of SLS, my family has gone from a $2M home to being unhoused. This is so terribly unfair.
