Can AscensionPoint Recovery Services, LLC Sue Me?

Although anyone can sue anyone for any reason, we have not seen AscensionPoint Recovery Services, LLC sue consumers, and it’s likely that the agency does not sue because they don’t always own the debt they are attempting to collect, and would also need to hire a lawyer, or use in-house counsel, to file a lawsuit. It’s also likely that the agency collects debt throughout the country, and it would be quite difficult to have lawyers, or a law firm, licensed in every state. However, there are collection agencies that do sue consumers; for example, Midland Credit Management is one of the largest junk-debt buyers, and it also collects and sues on debt. Still, it is less likely for a debt collector to sue you than for an original creditor to hire a lawyer or collection firm to sue you. No, unless they have a judgment. If AscensionPoint Recovery Services, LLC has not sued you, then the agency cannot get a judgment. Barring limited situations (usually involving debts owed to the government for student loans, taxes, etc.), a company must have a judgment in order to garnish someone’s wages. In short, we have not seen this agency file a lawsuit against a consumer, so the agency cannot garnish your wages, minus the exceptions listed above. I've had about 5 calls from ARA the first call a man called my wife stupid and ignorant. it upset her very bad. I have the name of the man that called her that. they keep calling me and hanging up. i'm starting to get tired of the threats, and harassment. what can I do. the debt in question is a credit card debt from 1996 that my wife had.

I paid a debt my deceased father owed in Jan. 2017. It is now Aug 2017 & ARS has still not filed a release at our courthouse. This is the only item holding up the closure of my dads succession. They have told me numerous times they have mailed it. Courthouse has never received it. They were suppose to over night it 5 days ago. Still nothing. What can I do now. Who do I report them too?

I have tried settling 2 claims with them for accounts against my mother's estate. They tell me they will call me back and instead send ANOTHER letter to my attorney causing more charges from the attorney!

I got a call yesterday from Assension Point about my "late" father's debt. My father is alive and well. This call came to me at work, was very upsetting, and uncalled for. My father needs to pay his own bills, and leave his estranged kids out of his mess.

I received a call from Ascension Point to collect a debt I do not owe. I paid this bill in full on Feb. 6th. They now want me to send proof that I paid it. I had already sent proof to the bank that owns the account. I have all the receipts. This is the 2nd collection agency the bank is using as the first collection agency investigated & sent all the paperwork back to the bank. This is getting really frustrating. My husband passed away Feb. 17th. They say I'm not responsible for the bill as they have the account in his name. Should I send proof of payment to them? I feel like my head is spinning in all directions. Thank you

We have received TWO phone calls from Assention Point. I actually called there and spoke with HEDI HALVERSON. They are on a Fishing Expedition for my husbands late uncles estate. Through the Public Records they cannot locate who is Executor to try and collect money from our late uncle. WE are not responsible for his bills. Get these people to leave us alone..... P.S Our relative has been dead almost 10 months.....AND now they want to harass us.....

My husband passed away June 27,2018. On November 15,2018, I received a voice message on my home phone from Acesion point regarding my husband's debt. I called back and spoke to a man who would not identify what debt. I told him my husband had no will or estate and no probate had been done to establish an executor. I also told them I didn't know who they were and send something in writing. I received a letter addressed to The Estate of David Gwin about a week later from them requesting an authorized person of the Estate of David Gwin call them. I have not responded back as of yet. If my Mom's Probate is completed and AscensionPoint didn't file a claim during the allowed time frame do we have to pay the debt as beneficiaries of the estate? We are about to sell my Mom's house and the attorney that handled the Probate is ALSO the owner of the Title Company doing the Title Policy and he's stating that because the Title Company has knowledge of an outstanding debt, we have to pay this before he will issue the Title Policy. Isn't that at the minimum a breach to Attorney Client Privilege?!

They have been calling me night and day wanting to know about the estate of Joseph A. Fanale. I have told my uncle who is the personal administrator of his estate and that has been it. They continue to call me and I never answer the phone nor do I call them back. I am sick and tired of them calling me. I want it stopped. Can you help me with this!

In general, spouses are not required to pay off debts for their partner except in a few circumstances, including living in a community property state, being a joint account holder, or being a cosigner on a loan. The company Ascensionpoint called me today and told me my sister inlaw was dead and wanted to know who is over her estate. My sister in-law is not dead she is very much alive. You can image what I felt and went through being called to tell me they are sorry for my loss and hearing my sister is dead! This is not okay . I want them to stop doing this to people this is wrong in every way. Let's get them!

I saw your link when I googled about AscentionPoint. I\'ve worked for financial institutions in the past and I knew the first moment they called about my mother\'s estate that they were a scam as she had NO debt. How are they actually in business doing this?!? How is this even *sic* borderline legal? I have not given them any details about me since they started calling.
