Kohl’s Lawsuits

If you want to know just how unhappy consumers are with Kohl’s, take a look at the number of lawsuits filed against the agency on the Public Access to Court Electronic Records (“PACER”). PACER lists over 5,400 lawsuits involving Kohl’s throughout the United States, and there are also likely hundreds of claims filed through the American Arbitration Association. Nowadays, most credit card companies have arbitration clauses, which mean that if you have a complaint with a credit card company, you must file your claim in arbitration. Arbitration limits discovery, is not public, has a limited appellate process, and, most importantly, is funded primarily by the banks and big businesses. Kohl’s Complaints

The Telephone Consumer Protection Act (TCPA) protects you from robocalls, which are those annoying, automated, recorded calls that computers make all day long. You can tell it’s a robocall because either no one responds on the other end of the line, or there is a delay when you pick up the phone before a live person responds. You can receive $500 per call if Kohl’s violates the TCPA. Have you received a message from this agency that sounds pre-recorded or cut-off at the beginning or end? These are tell-tale signs that the message is pre-recorded, and if you have these messages on your cell phone, you may have a TCPA case against the agency.The Electronic Fund Transfer Act (EFTA) protects electronic payments that are deducted from bank accounts. If Kohl’s took unauthorized deductions from your bank account, you may have an EFTA claim against the agency. Kohl’s, like most collection agencies, wants to set up recurring payments from consumers; imagine how much money it can earn if hundreds, even thousands, of consumers electronically pay them $50 – $100 or more per month. If you agreed to this type of reoccurring payment, the agency must follow certain steps to comply with the EFTA. Did Kohl’s continue to take electronic payments after you told them to stop? In essence, it gives you the right to dispute those inaccuracies that you find on your credit report. If Kohl’s is on your credit report, they may tell you that they’ll remove the debt from your credit report if you pay it; this is commonly known as “pay for delete.” If the original creditor is on your report rather than the debt collector, and you pay off the debt, both entities should accurately report this on your credit report. Several states also have laws to provide its citizens an additional layer of protection. For example, if you live in California, Florida, Michigan, Montana, North Carolina, Pennsylvania, Texas, or Wisconsin, you may be able to add a state-law claim to your federal law claim above.  North Carolina, for example, has one of the most consumer-friendly statutes in the country: if you live in NC and are harassed over a debt, you may receive $500 – $4,000 in damages per violation. Can Kohl’s Sue Me?

  3. Left you a message without identifying the company’s name.
  4. Left you a message without disclosing that the call is from a debt collector.
  5. Called third parties (family, friends, coworkers, or neighbors) even though the collection agency knows your contact information.
  6. Disclosed to a third party (family, friends, coworkers, or neighbors) that you owe a debt.
  7. Contacted you after you said stop calling.
  8. Threatened you with legal action (such as a lawsuit or wage garnishment).
  9. Called you before 8:00 AM or after 9:00 PM.
  10. Continued to call you after you have told the collector you cannot pay the debt.
  11. Communicated (phone or letter) with you after you filed for bankruptcy.
  12. Failed to mark the debt on your credit report as disputed after you disputed the debt.

  1. Do I have to pay your fees and costs for helping me with my consumer rights case?  No. We handle consumer rights cases based on a fee-shift provision and/or a contingency fee.  That means, either the other side pays your fees and costs, or we take a percentage of your recovery.  Whether it’s a fee-shift case or a contingency-fee case, we don’t get paid unless you get paid, and you’ll never owe us a penny for our time.

You can get $500 per robocall, or $1,500 per robocall if the robocalls were willful.  In any type of settlement, often times Defendants pay much less than $500 per call. However, if there are 50 calls at issue, even at $250 per call, your case could settle for $12,500.00.
  3. Are there state laws that protect me from original creditors? Yes!  Several states also have laws that provide its citizens an additional layer of protection.  For example, if you live in California, Connecticut, Florida, Kansas, Massachusetts, Michigan, Missouri, Montana, North Carolina, Nevada, Oklahoma, Pennsylvania, Texas, and Wisconsin, you have additional state-law rights.
  4. What type of debt is covered under state laws that protect me from original creditors? Only consumer debt, such as personal, family, and household debts.  For example, money you owe on a personal credit card, an auto loan, a medical bill, or a utility bill.  State laws usually do not cover debts you incurred to run a business, or debts regarding unpaid taxes, or traffic tickets.
  5. Does the Fair Debt Collection Practices Act apply to banks or credit card companies?  No.  Only third-party debt collectors are bound by the FDCPA.  That is, original creditors, such as credit card companies and banks are not bound by the FDCPA.

I am not even a Kohl's customer or card holder. They have been calling me several times a day for weeks, to collect a debt for another person.

Kohl's has been calling our home phone but not leaving any messages, just called several times, from 903 593 8790. When the calls were answered no one was on the line, silence then disconnect. They were also calling form 231 751 0067, caller ID Boyne Falls, MI. When answered a recording would ask please call Kohl's Department Store. I got at least four of these calls and took photo's of the phone, with the date and time number and caller ID. I sent them a cease and desist letter and the calls have stopped. Please let me know if you feel I have a case and that they violated the FDCPA or TCPA. Thanks.

Repeated phone calls to my work after being told to stop and that phone calls of that nature were not allowed at my work. Phone calls continue even after several emails demanding that they cease, telling them only to contact my cell phone number or in writing.

I have a bill with Kohl's store and I am having bad financial problems. They call several times a week and we are not able to come to an agreement about a payment plan. The calls go on for 30 minutes and are getting very upsetting to me. I have gotten on payment plans with them a few times and both myself and Kohl's were responsible in problems with the plans and now they say they can't offer me another payment plan I can afford. They put me on one plan of paying $50/month for 3 months, but I discovered they double dipped into 2 of my accounts for the $50, causing me a lot of problems with my credit unions. They told me I would not have to pay the 3rd payment. Then they denied sayiing that and said I had broken the agreement!

Kohls is calling my phone and asking for my mother when I got should of someone at Kohls. Com she said there is nothing she can do and try card services. I told her I have never had a Kohls card and why can't she put me on a no call list she said I have to get a hold of there card services department. I spoke to my mother and she paid her bill a day or so ago. And it made her upset that they called me about her business and that's bad cause she is recovering and still doing therapy from a stroke and any undo stress is unaffordable!

I have an unpaid bill with Kohl's. I have spoken to them several times and told them that I can't pay it right now due to financial situation. They continue to call several times a day and they call from several different numbers. If I do answer the person does not listen to what you say, does not be quiet long enough to listen either. I know that I owe money, I just want them to quit harrassing me.

This is my story about Kohls department store. Last year I was shopping at Kohls and tore off tags when trying on cloyhes. I know this was not right however 2 wrongs do not make a right. As I was walking to my car a young strong guy walked up to me in the parking lot grabbing me with all the force he had and jerking me around like a rag doll. In the end I went to a Hospital and had someone take pictures of my arm that was black and blue with time and date stamped on all pics. I do have a charge card and am in a financial slump at this time. It now seems very odd that they are calling me multiple times every day. I feel like there LP guy is calling out of shear hate. His last name is Gentry. This is wrong and someone needs to stop this so called store now. I am 58 years old and am not in the best health. No other store in the country has such bold action I wonder how they are still in business.

I opened an account to get a discount on a pair of shoes at a cost of $31.49 in September/2018. Kohls sent me a card which I have not activated and I sent them a check for $31.49 in October/2018 (and then tossed the card and mail from them in the trash). For the past several weeks, I have had multiple robo calls from Kohls demanding payment of money owing. I got a subsequent Kohl's bill in November, 2018 which acknowledges that I paid them the $31.49 but indicating that I owed them $55 in service charges. I contacted them last week to clear it up and they indicated that there system was down so they could not address my concern/complaint. After more robo calls from them and other fraudsters (I might add), I was contacted this am by human from Kohls who indicated that my payment had been a couple of days late and that was the reason for the $55 outstanding balance that they were seeking. Their represetative acknowledged the situation and appropriately reversed the $55 charges. My concern is that I had to put up with a series of harassing phone calls for no legitimate reason and that less empowered people are being completely taken advantage of by Kohl's usury and preditary practices. I actually dumped a Kohls account a few years ago for exactly the same reason. This company needs a serious wake up call and start treating people more fairly and stop their harassing and inappropriate approach to account receivables for nominal amounts. A class action suit against Kohl's might get their attention!

Kohls has been calling via robocall nonstop to my personal and work telephone. My voicemail gets full because there are so many daily robocalls . On February 13, 2019 I sent Kohls a cease and desist letter and email because I was getting in trouble at work for the non stop calls. Kohls is still constantly calling everyday with their robocalls

My problem began after the everthing was closed to to Covid 19, I was a day late and Kohls hit me with a late fee, I called and got it reversed, they tacked late fee after late fee on me, and i was unable to pay, they said they offer Co-vid relief which is a flat out lie, I am sick about this they call day and night, I have told them I am unable to pay, I am a Cancer survivor, and they are harassing me, putting my health at risk,I have been in contact with then days on end with no result,I just stopped ansewring them, and stopped calling them they are horrible

Kohl’s informed me they would remove report of a late payment multiple times over several months. Since then they have not reported one accurate balance since March even after disputes. Debt was paid in full. Since then one item was purchaced and returned after being sent to wrong address. After talks with multiple reps debt was not removed for months. Then when it was late fees were added to the account and disputed then when they weren’t removed properly added to more late fees. I have not purchaced anything since March. And my credit score keeps lowering every month when it was over 700 in January and I pay everything on time. Since this year I have paid off 2 cards in full, and one card I have regularly paid much more then the minimum every month.

I have every receipt, call logs, incident numbers, etc. in 1/2023 my daughter used my kohls credit card because it was linked to her kohls account and she did not know she thought it was her kohls credit card on file. She bought shoes pricing out to be about 150.00. When my daughter went into kohls with me to return the shoes the customer service inside kohls said that they would have to give a merchant credit for the items. They also made us pay the 150 to make the account current on balance. We were given the merchant credit and within 10 minutes we had dropped the card somewhere. We talked to the manager and she had us call customer service to get a new merchant card sent to us. We had the old merchant credit card cancelled and we have that card number as well it is in our documentation. They told us they would send us one in the mail which we never received. They also sent us an outstanding bill of 150.00 when we spoke to a representative of kohls on the phone he said we had to pay 62.00 to make the account current. We didn’t understand why but we paid the 62.00. We also have proof of that. They than sent us a outstanding bill of 107.00. We have called and spoke with multiple people over months and months and keep getting bounced around. We are getting nowhere and they are calling us multiple times harassing us for payment when we have already paid and paid even more than we should have. They finally sent us a letter that they are cancelling the kohls account because of non payment but we paid 62.00 on 4/2023 so it doesn’t make sense why they would even close it if a payment was just made less than a month ago. We have proof of everything and the stress and emotional trauma due to all of this has gotten us to now request compensation for not only our over payment but for emotional damage as well.
