Can Spring Oaks Capital LLC Sue Me?

Although anyone can sue anyone for any reason, we have not seen Spring Oaks Capital LLC sue consumers, and it’s likely that the agency does not sue because they don’t always own the debt they are attempting to collect, and would also need to hire a lawyer, or use in-house counsel, to file a lawsuit. No, unless they have a judgment. If Spring Oaks Capital LLC has not sued you, then the agency cannot get a judgment. Barring limited situations (usually involving debts owed to the government for student loans, taxes, etc.), a company must have a judgment in order to garnish someone’s wages. I owe hospital bills and decided i was going to call them and make payments on them and they were on my credit as midland memorial hospital, and now when i go in my credit again it says the original owner is midland memorial hospital and the collector is this spring oaks capital llc and I\'m kind of skeptical about this because they never send me a letter telling me they bought this collection of the original owner i still get the letters from the midland memorial but never from them and this just appear on my credit out of nowhere without informing me. They are damaging my credit without my content or awareness.

Spring Oaks Capital purchased my loan from UPSTART, UPSTART refused to work with me when I lost my disability insurance payment, instead they sold account to Spring Oaks Capital I saw that on my credit report after UPSTART reported charged off account. I send cease and desist letter to them and filed complaint with CFPB. They responded to CFPB with a lie and my complaint was closed. I need for them to go away, I am on total disability and on permanent SSDI , I have no means to pay them ......

I\'m sharing this for informational purposes only. I have received at least six text messages from Spring Oaks Capital SPC, LLC claiming they are \"willing to accept $340 to resolve your Milestone Mastercard account originated by the Bank of Missouri, which is now owned by Spring Oaks Capital SPC, LLC, for less than full balance.\" The text messages go on to instruct me to call them to settle this debt no later than Oct. 31, 2023 and provide a website and phone number by which which I can make the payment. First problem - I NEVER opened a Milestone Mastercard account, or a Mastercard account of any kind. Second problem - when I called them and told them this, they simply responded with, \"we don\'t have an account associated with your phone number. We\'ll take you off the list.\" How are they texting a notice of debt and payment plan to a number they don\'t have on their list? And, how can they confirm my debt, or non-debt as it were, using only my phone number? This wreaks of a scam.

Spring Oaks Capital keeps calling saying I am in collections over a Jared Jewelry account. I have contacted Jared and checked my credit report on numerous occasions and there is nothing there. I did have an account with Jared many years ago but that was completely paid off. Please help me to stop this harrassment. Thank you!

I have no idea what this debt is, it just showed up on my credit report. I believe it is linked to a fraudulent activity, as I have just had a different remark on my credit cleared to because of fraudulent activity. Not sure if this is related, but either way I have no recollection of having a debt with the amount shown, or any debt that was not paid for that matter.

I received a text on 06/17/23 from Spring Oaks Capital offering me a monthly payment plan for a debt on an Indigo Mastercard which I have never had or even heard of before. What is an Indigo Mastercard?

Hi, I got a call on 3/17/23 which I didn\'t answer and a subsequent text message from Spring Oaks Capital. They claim I have an outstanding balance on an Indigo Mastercard which they now own and want to collect. I responded by text message that I have never had an indigo credit card and have no record of any outstanding debt. I requested they they provide evidence to in order for me to validate their claim and that until they have responded to consider the debt in dispute. They ignored my requested and have continued to call and send text messages offering payment plans. I have prepared a certified Debt Validation letter which I intend to send but would like to hear from you before I send it. Thanks for your consideration, and hope to hear from you.

Spring Oak is showing as of 12/23/2022 on the TransUnion credit report for 12 Celtic Bank for $851 opened on 02-02-2022 balance updated 12/16/2022 and it comments \"dispute resolved reported by grantor\". I received a letter from them wanting $851 plus fees= $1,051. The original bill is from my Verizon account couldn\'t pay back in September 2022. The report has \"hasn\'t paid on the account in 24 months\" and I had it up until almost October 2022. I couldnt afford the amount all at once, on SSI with 2 autistic boys and worried over how to fix up (and now keep our home after a nursing home lied to and hounded my stroke/dementia mother til she sign for long term care and giving our home to Medicaids estate recovery while she was there for rehabilitation, ignoring the fact I have Durable POA and never to sign or approve anything then sending me a monthly bill claiming \"private pay\" while receiving her Medicaid along with the amount from her SSA check.) But anyway, I noticed since that showed up and is my most recent credit, I haven\'t been able to get an affordable rate for car insurance. Plus, not all of the information is correct, so what should i do? Thanks,
