Can Spring Oaks Capital LLC Sue Me?

I recieved a letter of garnishment from my employer on Monday. It was from Spring Oaks with a former address of mine on it. The former address is my fathers house who shares a name with me. I lived there in the past but was moved out far before their alleged proof of service. Which i recieved when i filed my own motion to quash. I attached a copy of my photo ID showing my current address with an issue date thats dated before the proof of service. The court this took place in isnt even in that jurisdiction.

I have been called by all of these Boston area code numbers since September. I answered the call last time and was threatened with court, lawer fees, wage garnishment, tax return garnishment and was basically belittled, being called an irresponsible adult that must not take care of any of my responsibilities. He tried his hardest to have me admit my responsibility of a $600 debt. The more i denied or couldn\'t remember, the more intense he became. BUT....when i asked for written proof of the debt, he refused, saying he already sent it. He then accused me of being irresponsible for losing my mail. I am writing in response to my recent request for the sale agreement related to the collection account you have on file under the above-referenced account number. Specifically, I requested a copy of the sale agreement between your company and the original creditor (or previous owner of the debt), as well as confirmation of the amount for which the debt was purchased. While I appreciate any documentation that has been provided, I must reiterate my request for the sale agreement, with the purchase price of the debt properly redacted. As a consumer, I am entitled to this documentation to verify the validity of the debt under federal and state law. Please ensure the purchase price is redacted, as I understand it is proprietary information, but the agreement itself is necessary to confirm the legitimacy of the debt transfer. Failure to provide the requested documentation or any attempt to continue false debt collection practices will result in me pursuing legal action. Under the Fair Debt Collection Practices Act (FDCPA), as well as relevant state laws, I have the right to dispute any debt and to receive verification of such, and your failure to comply would be a violation of these laws. Hello, I was served by Spring Oaks Captial SPV, LLC but I dont know my options. It has been hard to communicate with them. I have legal insurance and used a firm through them but the representatives of Spring Oaks dont respond. I have an upcoming court Date of Sep. 5th and submitted a form request to reschedule. The clerk said I should reach out to the plantiff but again they dont respond. I\'m not certain about my options as I have not receive any mail from Spring Oaks. Thank you, Virginia

I am writing to formally request your intervention in unauthorized credit reporting and identity theft involving Spring Oaks Capital LLC and their affiliate Spring Oaks Capital SPV LLC. Despite my continuous efforts to resolve this issue, the companies continue to report false information on my credit report, which has severely impacted my financial standing. Account Details: Original Creditor: Genesis FS Card Services Account Number: 5100-0400-1118-1314 Current Creditor Reporting: Spring Oaks Capital LLC or Spring Oaks Capital SPV LLC NMLS Number: 1916692 Reference Number: 110-961648 Amount Requested: $811.39 (original balance was less than $400) Background: I have been a victim of identity theft and have taken the necessary steps to prove this. I have filed and submitted the required paperwork, including police reports and identity theft affidavits, to Spring Oaks Capital LLC. Despite these efforts, they persist in reporting this fraudulent account as active, misleading, and harmful. Discrepancies and Issues: Lack of Verification: Spring Oaks Capital LLC has admitted to not having any signed paperwork or documents that would verify this is my account. The only information they have provided is the name on the billing statement, which was obtained fraudulently. Invalid Address: The address listed on the documents and where they requested me to dispute the bills are invalid. The USPS returned the bills to them, stating that the address was invalid. Additionally, I have submitted proof that the address is not a residential address but a commercial one, further indicating this account\'s fraudulent nature. Failure to Investigate Properly: Despite receiving my complaints and the supporting documentation, Spring Oaks Capital LLC has failed to conduct a proper investigation. They continue to report this account on my credit report, causing significant financial harm. Impact: The false reporting of this fraudulent account has drastically affected my credit score, resulting in increased interest rates on loans, higher insurance premiums, and even denial of credit. It has also caused issues with my tuition and financial aid. Request for Action: I respectfully request that your office investigate this matter and take the necessary steps to ensure that Spring Oaks Capital LLC and Spring Oaks Capital SPV LLC comply with the law. Specifically, I ask that they be required to: Remove the fraudulent account from my credit report. Cease all collection activities related to this account. Please note that I have been disputing this account for almost two years. Spring Oaks Capital LLC has sent out numerous emails, letters and calls non stop. I have replied to many calls and asked when is the harassment going to stop. I work hours 645 Am to 515 and they call while im at work, which i simply cannot answer. The letter they sent out plus all the emails is same thing. Lady called today and it was same thing they have emailed me about. A debt. I asked the lady when does this began to be harassment , and also advised i would be contacting the Attorney General office cause its now harrassing me daily.

I owe hospital bills and decided i was going to call them and make payments on them and they were on my credit as midland memorial hospital, and now when i go in my credit again it says the original owner is midland memorial hospital and the collector is this spring oaks capital llc and I\'m kind of skeptical about this because they never send me a letter telling me they bought this collection of the original owner i still get the letters from the midland memorial but never from them and this just appear on my credit out of nowhere without informing me. They are damaging my credit without my content or awareness.

Spring Oaks Capital purchased my loan from UPSTART, UPSTART refused to work with me when I lost my disability insurance payment, instead they sold account to Spring Oaks Capital I saw that on my credit report after UPSTART reported charged off account. I send cease and desist letter to them and filed complaint with CFPB. They responded to CFPB with a lie and my complaint was closed. I need for them to go away, I am on total disability and on permanent SSDI , I have no means to pay them ......

I\'m sharing this for informational purposes only. I have received at least six text messages from Spring Oaks Capital SPC, LLC claiming they are \"willing to accept $340 to resolve your Milestone Mastercard account originated by the Bank of Missouri, which is now owned by Spring Oaks Capital SPC, LLC, for less than full balance.\" The text messages go on to instruct me to call them to settle this debt no later than Oct. 31, 2023 and provide a website and phone number by which which I can make the payment. First problem - I NEVER opened a Milestone Mastercard account, or a Mastercard account of any kind. Second problem - when I called them and told them this, they simply responded with, \"we don\'t have an account associated with your phone number. We\'ll take you off the list.\" How are they texting a notice of debt and payment plan to a number they don\'t have on their list? And, how can they confirm my debt, or non-debt as it were, using only my phone number? This wreaks of a scam.

Spring Oaks Capital keeps calling saying I am in collections over a Jared Jewelry account. I have contacted Jared and checked my credit report on numerous occasions and there is nothing there. I did have an account with Jared many years ago but that was completely paid off. Please help me to stop this harrassment. Thank you!

I have no idea what this debt is, it just showed up on my credit report. I believe it is linked to a fraudulent activity, as I have just had a different remark on my credit cleared to because of fraudulent activity. Not sure if this is related, but either way I have no recollection of having a debt with the amount shown, or any debt that was not paid for that matter.

Hi, I got a call on 3/17/23 which I didn\'t answer and a subsequent text message from Spring Oaks Capital. They claim I have an outstanding balance on an Indigo Mastercard which they now own and want to collect. I responded by text message that I have never had an indigo credit card and have no record of any outstanding debt. I requested they they provide evidence to in order for me to validate their claim and that until they have responded to consider the debt in dispute. They ignored my requested and have continued to call and send text messages offering payment plans. Spring Oak is showing as of 12/23/2022 on the TransUnion credit report for 12 Celtic Bank for $851 opened on 02-02-2022 balance updated 12/16/2022 and it comments \"dispute resolved reported by grantor\". I received a letter from them wanting $851 plus fees= $1,051. The original bill is from my Verizon account couldn\'t pay back in September 2022. The report has \"hasn\'t paid on the account in 24 months\" and I had it up until almost October 2022. I couldnt afford the amount all at once, on SSI with 2 autistic boys and worried over how to fix up (and now keep our home after a nursing home lied to and hounded my stroke/dementia mother til she sign for long term care and giving our home to Medicaids estate recovery while she was there for rehabilitation, ignoring the fact I have Durable POA and never to sign or approve anything then sending me a monthly bill claiming \"private pay\" while receiving her Medicaid along with the amount from her SSA check.) But anyway, I noticed since that showed up and is my most recent credit, I haven\'t been able to get an affordable rate for car insurance. Plus, not all of the information is correct, so what should i do? Thanks,

I don\'t know where this so called debt is coming from. It is on my credit report and it should not be. This came out of nowhere and I have disputed this with no luck. Can you help me?

Spring Oaks has called me 5 times today on my cell phone. They stopped calling me at work but have called my work 2-3 times in one day. What can I do?

Spring oaks is on my credit report after original card closed dept - also calling me every morning- I hang up on them before they speak
