Quest Diagnostics Lawsuits

If you want to know just how unhappy consumers are with Quest Diagnostics, take a look at the number of complaints consumers have made online. Nowadays, most original creditors, credit card companies, etc. have arbitration clauses, which means that if you have a complaint against that company, you must file your claim in arbitration. Arbitration limits discovery, is not public, has a limited appellate process, and, most importantly, is funded primarily by banks and big businesses. Quest Diagnostics Complaints

The Telephone Consumer Protection Act (TCPA) protects you from robocalls, which are those annoying, automated, recorded calls that computers make all day long. You can tell it’s a robocall because either no one responds on the other end of the line, or there is a delay when you pick up the phone before a live person responds. You can receive $500 per call if Quest Diagnostics violates the TCPA. Have you received a message from this agency that sounds pre-recorded or cut-off at the beginning or end? These are tell-tale signs that the message is pre-recorded, and if you have these messages on your cell phone, you may have a TCPA case against the agency.

The Electronic Fund Transfer Act (EFTA) protects electronic payments that are deducted from bank accounts. If Quest Diagnostics took unauthorized deductions from your bank account, you may have an EFTA claim against the agency. Quest Diagnostics, like most collection agencies, wants to set up recurring payments from consumers; imagine how much money it can earn if hundreds, even thousands, of consumers electronically pay them $50 – $100 or more per month. If you agreed to this type of reoccurring payment, the agency must follow certain steps to comply with the EFTA. Did Quest Diagnostics continue to take electronic payments after you told them to stop? Did they take more money from your checking account than you agreed to?  If so, we can discuss your rights and a potential case under the EFTA.

The Fair Credit Reporting Act (FCRA) works to ensure that no information reported to your credit report is false. In essence, it gives you the right to dispute those inaccuracies that you find on your credit report. We’ve handled many cases in which a debt collection agency reported debt on a consumer’s credit report to obtain leverage over the consumer. If Quest Diagnostics is on your credit report, they may tell you that they’ll remove the debt from your credit report if you pay it; this is commonly known as “pay for delete.” If the original creditor is on your report rather than the debt collector, and you pay off the debt, both entities should accurately report this on your credit report.

Several states also have laws to provide its citizens an additional layer of protection. For example, if you live in California, Florida, Michigan, Montana, North Carolina, Pennsylvania, Texas, or Wisconsin, you may be able to add a state-law claim to your federal law claim above.  North Carolina, for example, has one of the most consumer-friendly statutes in the country: if you live in NC and are harassed over a debt, you may receive $500 – $4,000 in damages per violation. We work with a local counsel in NC and our NC clients have received some great results in debt collection harassment cases. If you live in North Carolina and are being harassed by a debt collector, you have the leverage to obtain a great settlement.

How do we Use the Law to Help You?

We will use state and federal laws to immediately stop Quest Diagnostics’ debt collection. We will send a cease-and-desist letter to stop the harassment today, and if Quest Diagnostics violates the FDCPA, EFTA, FCRA, or any state law, you may be entitled to money damages. They say someone will call me back and put the bill on hold. No one ever calls back but several months later I just get the same bill in the mail. I have sent in bank statement/check numbers/dates as requested to show that the funds left my account. I have been through this cycle multiple times with the same result, no contact and another bill.”

  2. I have spent hours on the phone for an invoice since 4/15/2015. They billed my insurance multiple times for the same service. My insurance states it is paid and we owe nothing. Quest told me it was resolved, yet they sent me another bill and when I called 4/25/2016, I was told they decided it was not paid properly. They canceled my ability to go for blood work.”

  3. I have received four separate invoices from Quest Diagnostics for a blood test. I am a Medicare recipient and any billing should have been submitted to them accordingly. Instead, Quest Diagnostics consistently sends me an invoice for $441.67. I have informed them that the insurance information is incorrect and they need to resubmit claim to Medicare. Customer service acknowledged the mistake. However, I continue to receive invoices from them.”

Can Quest Diagnostics Sue Me?

Debt collection laws provided a laundry list of what collectors can and cannot do while collecting a debt.  Based on our years of experience handling thousands of debt collection harassment cases, here’s what collection agencies most often do to violate the law.

  1. Called you about a debt you do not owe.
  2. Called you at work after you told them you cannot receive calls at work.
  3. Left you a message without identifying the company’s name.
  4. Left you a message without disclosing that the call is from a debt collector.
  5. Called third parties (family, friends, coworkers, or neighbors) even though the collection agency knows your contact information.
  6. Disclosed to a third party (family, friends, coworkers, or neighbors) that you owe a debt.
  7. Contacted you after you said stop calling.
  8. Threatened you with legal action (such as a lawsuit or wage garnishment).
  9. Called you before 8:00 AM or after 9:00 PM.
  10. Continued to call you after you have told the collector you cannot pay the debt.
  11. Communicated (phone or letter) with you after you filed for bankruptcy.
  12. Failed to mark the debt on your credit report as disputed after you disputed the debt.

  1. Do I have to pay your fees and costs for helping me with my consumer rights case?  No. We handle consumer rights cases based on a fee-shift provision and/or a contingency fee. In any type of settlement, oftentimes Defendants pay much less than $500 per call. However, if there are 50 calls at issue, even at $250 per call, your case could settle for $12,500.00.

  3. Are there state laws that protect me from original creditors? Yes!  Several states also have laws that provide their citizens an additional layer of protection.  For example, if you live in California, Connecticut, Florida, Kansas, Massachusetts, Michigan, Missouri, Montana, North Carolina, Nevada, Oklahoma, Pennsylvania, Texas, and Wisconsin, you have additional state-law rights.

  4. What type of debt is covered under state laws that protect me from original creditors? Only consumer debt, such as personal, family, and household debts.  For example, the money you owe on a personal credit card, an auto loan, a medical bill, or a utility bill. State laws usually do not cover debts you incurred to run a business, or debts regarding unpaid taxes, or traffic tickets.

  5. Does the Fair Debt Collection Practices Act apply to banks or credit card companies? No. Only third-party debt collectors are bound by the FDCPA.  That is, original creditors, such as credit card companies and banks are not bound by the FDCPA.

I moved from Brooklyn to Seattle in February of 2020. In March 2021, over 1 year later, an account went to collections that I do not know from Quest Diagnostics of for a very small amount of money. It is now affecting my home loan and I do not know what to do. I do not know how to get it off my report or where it is from. How did it go to collections over 1 year after I left, and 1.5 years after any medical treatment? How could they not contact me with Mail forwarding or email or phone through that time before collections? I need help. Do not sell my information, thank you.

Had blood draw at Quest covered through Blue Cross Blue Shield. I paid my copayment. Quest filed with the wrong insurance location and were informed by BCBS to submit bill to correct location, which they did not do. Sent me to collections through Credit Collection Services. I informed them as well about coverage through BCBS as this is an option on their website. To my knowledge, they did not attempt to file through BCBS either. Credit Collections Services has now reported this to my credit and my score dropped. I disputed this with Experian but it it is still listed as a debt I owe. I am curious to see if this is something you are interested in pursuing. My goal is to have this removed from my credit.

In January of 2021, I visited the University of Pittsburgh’s Student Health center to have an STD test done. As a student veteran using the GI Bill, I told the university to bill my insurance provider. On January 30th 2022, I checked my credit report and realized that Quest has placed a derogatory mark on my credit report on January 14th 2022. I contacted the University of Pittsburgh to understand the problem and they had me pay out of pocket $87 to reverse the Quest diagnostics bill of $365. This has severely affected my credit score and I would like this fixed as soon as possible.

My experience with quest billing so far is nothing short of pathetic. I never sent by sample to quest for test. They were sent by the doctor. My insurance details were not used. I was sent a bill of 1094 USD without insurance. I called twice to share insurance details and i was told bill is on hold till we get feedback from insurance. Insurance was never used and then i was sent collection notice.

I received a bill with service date of June 2021. I contacted Quest several times to get the correct insurance billed. After a year and close to 10 calls, the bill went to collections despite them telling me it wouldn’t and my insurance company telling me they never received the claim on their end. Quest does nothing but hang up on me now that the bill has gone to collections even though it’s their fault for not being able to bill to the correct insurance.

I went to Quest this morning. The phlebotomist at first refused me service. She said that I owed money. I know this is not true because I have a zero co-pay. I had to call building three times from the Quest location. Finally the third person helped me and said that there was just a simple insurance mistake. The person in the office kept escalating the problem. I was so aggravated that I started getting palpitations and I had to call for the EMT. I am 70 years old. I asked her to stop harassing me and she just laughed. There was no reason for the person in the Quest Office to act the way she did. She said that the computer would not let her continue with the service. This was not true. As soon as the third billing person spoke to her she clicked a little checkbox on the computer and I was taken care of by another person in the office.

Nobody should require the assistance of an EMT just for having bloodwork done and because of a mistake on their end! I know I would not be happy if this happened to me or a loved one. We keep getting medical bills from Quest Diagnostics that we don\'t owe. One has already gone to a creditor, even though we have provided EOBs from insurance AND our insurance company has placed formal complaints against them.
