Collection harassment by Ally Servicing / Ally Financial. Suspended my payment attempt to bring balance to current. Non-stop calls even though i have asked to stop calling me during business hours and requested an explanation for why my payment attempt was suspended. None given. They attempted to contact family members and friends even though they have my contact info. Violating multiple FDCPA regulations.

Hello. Ally called the house phone yesterday at 10:13 am. My husband answered. Ally collections asked him how are you going to take care of the $4,113 debt? My husband replied he wasn’t and hung up. At 10:17 am, I received a call from Ally on my cell phone. I was at a seminar for work and did not answer. Later I noticed a voice mail message had been left from John of Ally. He said to call him at a different number (800) 241-0172 x 181106. I have not returned the call. The story is that we financed a used car from Ally in 2011. My husband’s car was totaled in an accident in Jan 2014 and our previous insurance company (Geico) would not cover the gap insurance claim of $4,113 because they said we were late a few times on the car note. Yes we were late a few times. Our last loan payment to Ally on the car (according to credit report) was February 5, 2014 but Geico was paid on time each month. Ally is attempting to collect the$4,113 that my husband and I have disputed with Ally and it is noted on my credit report. Ally also reported the $4,113 to the credit bureaus which has impacted our credit. Ally has sent letters by mail asking for a settlement or if we want to settle. Ironically because of the high interest Ally charged us, Ally said we could refinance 1 year later, but my husband wanted to trade/upgrade instead and learned from an auto dealer that there was a negative car fax reported on the car which decreased the value of the car, so Ally ripped us off. Not sure how to approach. I’m just tired at this point and want it to be over. Hopefully you can help or provide suggestions. Thank you.
