If you want to know just how unhappy consumers are with Best Egg, take a look at the number of complaints consumers have made online. Nowadays, most original creditors, credit card companies, etc. have arbitration clauses, which means that if you have a complaint against that company, you must file your claim in arbitration. Best Egg Complaints

The Telephone Consumer Protection Act (TCPA) protects you from robocalls, which are those annoying, automated, recorded calls that computers make all day long. You can tell it’s a robocall because either no one responds on the other end of the line, or there is a delay when you pick up the phone before a live person responds. You can receive $500 per call if Best Egg violates the TCPA. Have you received a message from this agency that sounds pre-recorded or cut-off at the beginning or end? These are tell-tale signs that the message is pre-recorded, and if you have these messages on your cell phone, you may have a TCPA case against the agency.

The Electronic Fund Transfer Act (EFTA) protects electronic payments that are deducted from bank accounts. If Best Egg took unauthorized deductions from your bank account, you may have an EFTA claim against the agency. Best Egg, like most collection agencies, wants to set up recurring payments from consumers; imagine how much money it can earn if hundreds, even thousands, of consumers electronically pay them $50 – $100 or more per month. If you agreed to this type of reoccurring payment, the agency must follow certain steps to comply with the EFTA. Did Best Egg continue to take electronic payments after you told them to stop? The Fair Credit Reporting Act (FCRA) works to ensure that no information reported to your credit report is false. In essence, it gives you the right to dispute those inaccuracies that you find on your credit report. We’ve handled many cases in which a debt collection agency reported debt on a consumer’s credit report to obtain leverage over the consumer. If Best Egg is on your credit report, they may tell you that they’ll remove the debt from your credit report if you pay it; this is commonly known as “pay for delete.” If the original creditor is on your report rather than the debt collector, and you pay off the debt, both entities should accurately report this on your credit report. 

Several states also have laws to provide their citizens an additional layer of protection. For example, if you live in California, Florida, Michigan, Montana, North Carolina, Pennsylvania, Texas, or Wisconsin, you may be able to add a state-law claim to your federal law claim above.  North Carolina, for example, has one of the most consumer-friendly statutes in the country: if you live in NC and are harassed over a debt, you may receive $500 – $4,000 in damages per violation. Debt collection laws provided a laundry list of what collectors can and cannot do while collecting a debt. Based on our years of experience handling thousands of debt collection harassment cases, here’s what collection agencies most often do to violate the law.

  3. Are there state laws that protect me from original creditors? Yes! Several states also have laws that provide their citizens an additional layer of protection. For example, if you live in California, Connecticut, Florida, Kansas, Massachusetts, Michigan, Missouri, Montana, North Carolina, Nevada, Oklahoma, Pennsylvania, Texas, and Wisconsin, you have additional state-law rights.

  4. What type of debt is covered under state laws that protect me from original creditors? Only consumer debt, such as personal, family, and household debts. For example, the money you owe on a personal credit card, an auto loan, a medical bill, or a utility bill. State laws usually do not cover debts you incurred to run a business, or debts regarding unpaid taxes, or traffic tickets.

  5. Does the Fair Debt Collection Practices Act apply to banks or credit card companies? No. Only third-party debt collectors are bound by the FDCPA. That is, original creditors, such as credit card companies and banks are not bound by the FDCPA.

My now-deceased father was an emotionally and financially abusive man. Over a matter of years he used my mother's personal information (name, SSN, DOB) to take out numerous loans and credit cards in her name, and without her knowledge. Also without her knowledge or consent, he changed her personal mailing address to his place of employment, which was a law firm (Shumaker Wililams) that he was the business manager for. Only after he died in March 2020 were these accounts discovered as well as the fact that all of my mother's personal mail sent to a business she has no affiliation with. Over the past 18 months, we have been able to resolve some of the accounts. This was done mostly through affidavits, showing that all of her mail was sent elsewhere, and IP addresses/phone numbers on loan promissory notes I tracked down which were tagged to his place of employment. There remain 3-4 creditors (Best Egg, Amazon, Lowes, Home Depot), however, with whom we have been unable to achieve a resolution. Mostly through 1) their lack of full investigation 2) unwillingness to be open about where to send affidavits and 3) putting said accounts into collections before we were even aware of the account’s existence. It is for these reasons we are now seeking legal assistance.

I opened a personal loan with Best Egg for 3k. I paid it off completely in a few months and closed the account. 3 Months later they report a balance increase of 2,571 to transunion. I have called Best Egg and they told me that they report incorrectly all the time and that I need to file a claim within their department to try and dispute it. This feels illegal. The reported increase caused my score to drop 22 points.

BestEgg erroneously reported a past due loan to the credit bureau that was paid off in October. On December 14, 2022, they reported that the loan was in default by 2 months, even though I paid it off in October. My credit score took a huge hit over this! I called them and they said it was a \"glitch\" in their system and I should dispute it to have it corrected. What can I do to hold them accountable? I have worked so hard to get my credit to an excellent status and now it\'s back down to fair.

Best Egg - paid off the personal loan completely in Oct 2022, recently had a rental home background/credit check and personal Experian reports state that Best Egg still shows a balance of $3,333 as owed updated 11/2022. Contacted Best Egg via chat, and they said: \"The issue was that multiple Best Egg accounts that had been paid in full were being reported to the credit bureau as active. We have had our users reach out to us and alert us of this. We are doing our best to gather all the affected accounts and resolve the issue.\" I feel this violates the Fair Credit Reporting Act without question. Thank you for your time, Matthew L. I have a loan through Best Egg. I just unexpectedly got put on disability and am going through chemo and other medications. Due to decreased, once a month payments, I have been struggling financially. I contacted Best Egg on 8/11/23 to let them know my situation and they agreed to pause my payments until 10/10/23 but that I would have to sign up for autopay for the payment on 10/10/23 and 11/10/23, I agreed to this. On 8/13/23, I logged into my Best Egg account to make sure that these changes were implemented and confirmed that they were. It showed my next payment was due on 10/10/23, and I took a screenshot of this for my records. Yesterday, 9/12/23, I go to purchase my medications and my card gets declined. I check to see what is going on and Best Egg took out my payment that was not due until 10/10/23. I called them in a panic to see what was going on and I checked my call notes for that day and my screenshot because I had to make sure that I was not remembering things wrong. I confirmed the rep told me payment was supposed to be taken on 10/10/23 through my call notes and through my screenshot. The rep that I spoke with today said that it looks like their \"back office\" noticed the rep and their system had a mistake and that the payment was supposed to come out 9/10/23 but the system was \"confused\" because I originally called on 8/11/23, one day after my payment would\'ve been due. Regardless, I did not agree to a payment coming out automatically for September, only for 10/10/23 and 11/10/23 and I have proof of this. I am now not able to purchase my chemo and my other medications that I was supposed to take on 9/12/23 which has now made me extremely sick and in extensive pain and I do not feel what they did was legal since I did not agree to that payment being taken out. My bank account is also overdrawn now which means I will be charged overdraft fees that I can certainly not afford. I am wondering if what they did was legal and if anything can be done in this situation? Thank you.

i got a loan through them at interest rate of 18 to 20% because of credit and debt to ratio income we wete unable to refinance our home to build a private office on our property business rental is to high.went to debt consolidation and recieved numerous calls harassing us.
