If someone has told a business of a spill on the property, the business does not clean it up, and someone later slips and falls on the spill, the business could be held liable but it depends on some factors.

Proving liability in premises liability cases involves proving that there was a duty of care, that duty was breached, and injuries and/or damages resulted directly because of that breach. Businesses and their owners owe a high duty of care to those that are invited or permitted on the premises, also known as invitees or licensees, respectively. This includes providing a safe environment that is reasonably free of danger for those people.

If someone were to directly tell the business of a danger on the property, then they had to have known about the danger. Their failure to act upon it to fix the situation, by cleaning it or putting up some type of warning or barrier as soon as possible, shows that they breached their duty of care to their invitees and licensees. Of course, if the slip and fall occurs during or seconds after being notified, and it was not reasonably expected that the business should have known about this hazard, then there may be less of a clear breach of duty. The point is that if they are made aware of a hazard and decline to clean it up, it is said that they had actual notice of the hazard and therefore can likely be held liable for negligence.
