Though a day at the pool should be considered fun and relaxing, there are many risks that a pool owner may allow through improper inspection or maintenance of the pool and its parts. Drowning can occur in a pool in a number of ways. If there is a negligent lifeguard who is distracted, slow, or simply unqualified to be doing their job, they can be found liable for negligence in addition to the pool owner for negligent hiring. If the pool drain’s suction is defective or too strong and drags a person underwater so that they are trapped, they can drown from failure to break free from the force. Here, the pool owner can be found liable for failing to inspect or maintain the drain’s safety, or the product manufacturer can be found liable for negligence if it was an inherent issue with the drain’s design and they released a dangerous product to the public. Perhaps someone can’t swim and a slip and fall accident causes them to fall in the deeper end of the pool and drown. The pool owner may be liable for not warning others of the slipping hazard or not cleaning it up.

These issues are all amplified with children. They are at a much higher risk of drowning, as one in five drowning victims are children aged 14 and younger, according to the Center for Disease Control and Prevention. Pool owners must act to prevent injuries to everyone, but especially children, who are even more susceptible to these accidents.
