All property owners owe a duty of care and safety through reasonable measures to any and all of their visitors, consumers, residents, etc. This includes conducting regular and periodic safety inspections and quality checks on any necessary aspect of the property. If you are injured in an accident due to inadequate maintenance of the property, you may be entitled to file a premises liability lawsuit against the property owner.

If a property owner begins to fall behind on the regular inspections and evaluations that your property requires in order to stay safe and up-to-regulation, they can be held liable in a personal injury case. Premises liability laws state that if someone gets injured on someone else’s property, they may be held liable for their injury, depending on the circumstances around the situation.

Inadequate maintenance of property can come in countless forms, including an outdated fire or smoke alarm, an expired safety inspection on an elevator, and loose ceiling boards. Any of these can cause mild to severe or deadly injuries that force you to incur thousands in losses. After a successful case, you could recover compensatory damages in your case to cover medical expenses or lost wages, also. In certain situations, you could also sue the manufacturer of the product that injured you if it was found that it was a fundamental issue with the product, and not completely the fault of the property owner. They would be sued for their inability to build a safe product for consumers to use.
