If you are invited to a person’s house or apartment and you suffer from a slip and fall accident, you can sue the owner of the house or apartment. In this case, you are considered an invitee, which is a type of entrant to someone’s property. Invitees are owed the highest duty of care to ensure their safety since they were invited by the property’s owner. This duty includes warning of any potential hazards on the property and otherwise fixing other reasonable dangers on the property. Thus, if this duty is breached and you suffer injuries or damages as a result, you can certainly sue them under premises liability laws.
There are a few conditions where the owner need not warn you of every potential danger on the property. They are expected to provide a degree of reasonable care; not necessarily know every possible accident that may or may not occur. Property owners do not need to warn invitees of dangers unknown to the owner or warn or protect guests from their own misuse of the property or anything attached. Nor do owners have to warn them of potentially dangerous conditions that are known to guests, open and obvious, or anything that can be reasonably discovered by the guest.
