Falls are a serious threat to construction workers on the job. Many of these serious and deadly accidents can be prevented by simple means, such as the use of personal protective equipment and the installation of guardrails or barricades in areas where falls are most likely to occur, such as at dangerous heights or raised surfaces. However, when these protective measures are not in place, construction workers can be injured.

If you have been injured in an accident due to a lack of guardrails, contact Mike Agruss Law for a free consultation. We are a Chicago-based injury law firm representing individuals (and their families) who have suffered an injury in an accident. We will handle your case quickly and advise you every step of the way, and we will not hesitate to go to trial for you. Lastly, Mike Agruss Law is not paid attorneys’ fees unless we win your case. Our no-fee promise is that simple. You have nothing to risk when you hire us – only the opportunity to seek justice.

Prevention of Guardrail Accidents

The safety of their construction workers should be the top priority for any employer. Employers are responsible for providing their employees with a safe environment, and when they fail, people are injured.

Guardrails and other barricades can prevent a catastrophe from ever happening. The areas where guardrails should be used include:

  • Scaffolding – Falls from scaffolding are one of the most common construction site injuries. Guardrails can prevent a construction worker from falling due to a misstep or tripping over equipment.
  • Elevator shafts – Working around an open elevator shaft is extremely dangerous. A slip and fall, stepping backward, or tripping over construction debris can cause a worker to fall into the elevator shaft which often has deadly results.
  • Unfinished wall openings – Wall openings that are not yet completed could allow a worker to fall through the opening and off the building as they are working.
  • Open holes – Any opening that could present a falling hazard should be marked off with warning signs and some sort of barricade.

The Occupational Safety and Health Administration (OSHA) provides training for employers and has established regulations regarding the safety of workers on the job site. When an employer does not provide the safest work environment possible for their employees, they could be found liable for the injuries and damages suffered in an accident.

If you or a loved one has suffered injuries due to negligence on the job site or a defective product, an experienced personal injury lawyer can review your claim and determine if there were unsafe working conditions, potential OSHA violations, and other hazards that may have existed at the time of your accident. They will also determine who may be liable for your injuries and damages and what compensation you may be entitled to.

We at Mike Agruss Law are proud to serve our fellow citizens in personal injury cases, especially when you or a loved one has been injured, and we are fully committed to protecting your rights and ensuring that the other party is held legally accountable when negligence occurs.
