Lost Spousal Support in Dram Shop Cases

In some dram shop cases, a spouse may be compensated for lost spousal support, including lost income. According to Chapter 1, Section II. 6 [1.12] of the Illinois Dramshop Act Practice handbook issued by the Illinois Institute for Continuing Legal Education (IICLE):

“The wife of a working husband was killed by a driver who fell asleep at the wheel after two beers at the defendant’s restaurant. Reversing a directed verdict for the defendants, the court in Weiner v. Trasatti, 19 Ill.App.3d 240, 311 N.E.2d 313, 318 – 319 (1st Dist. 1974), observed:

The statute that plaintiffs invoked, gave them a cause of action for injuries which an intoxicated person caused to their means of support. It provided for recovery for loss of means of support resulting from the death or injury of any person…Loss of means of support includes loss of income which results from termination of voluntary contributions…The capacity for providing means of support may be shown by proof of earnings and contribution of services or income….The services of a wife to which a husband is entitled include those rendered by the wife in performance of her household and her domestic duties, as well as those rendered by her while assisting the husband in his business.”
