Who is liable?

The common carrier law holds that any public transportation vehicles owe their passengers the highest duty of care when transporting them from place to place. So negligence occurs when this high duty of care is breached and injuries directly result from the accident. In an accident with another vehicle, the driver who caused the accident due to negligence will be liable.

The negligent driver can be determined through the attorneys’ investigation of the accident. In an accident with another object, the driver is likely the liable party for driving with negligence. In accidents where the school bus driver is driving in a reckless or dangerous manner, they would be the negligent party. The driver may be drunk, too fatigued, or perhaps simply reckless.
