Swimming pool drains are meant to be there to filter the pool water’s dirt and debris and run it through the pool’s pump and filtration system. They have a suction force and should be covered with some type of cover like a grate to prevent injury. If you or a loved one has been injured in a swimming pool drain injury, contact us to set up a free consultation and we can evaluate your case to see if it may be a viable premises liability accident.

Swimming pool drain accidents may be caused by an uncovered drain. That means that the suction force is unprotected from people in the pool, causing them to be dragged down by the  suction and get caught. This can result in drowning, disembowelment, injuries to the limbs, and even amputation. The same occurs for covered drains that are defective and simply have a suction force that is far too strong. It traps people below the surface of the water, and children are especially susceptible to this type of injury.

It is the responsibility of the pool owner to maintain a safe premises and inspect it regularly so that it stays that way. If the accident was due to poor maintenance or inspection, the pool owner may be liable for negligence. If the drain was inherently defective, you may have a product liability case where you can sue the product manufacturer for selling a defective and dangerous product. After you speak to an attorney, they will be able to pinpoint the responsible party or parties.
