Who is exempt from OSHA?

Under the Occupational Safety and Health Administration’s (OSHA) recordkeeping regulations, certain employers are required to prepare and maintain records of serious occupational injuries and/or illnesses. This information is important for employers, employees, and OSHA in evaluating the safety of the workplace, the hazards related to their industry, and implementing safety precautions to keep workers safe. 

However, there are two classes of employers that are exempt from keeping these records. Employers that have 10 or fewer employees at all times during the calendar year are exempt from keeping accident and illness records for OSHA. 

The second class of employers that are exempt from keeping records are certain industries that are considered low hazard. There are numerous low hazard industries which can be found here and includes the following:

  • Health and personal care stores
  • Other motor vehicle dealers
  • Florists
  • Clothing stores
  • Offices of physicians, dentists, other health practitioners, and outpatient care centers
  • Religious organizations
  • Deathcare services
  • Civic and social organizations 

Beginning in 2015, OSHA revised their recordkeeping requirements to include new industries, which can be found here and include the following: 

  • Automobile dealers
  • Beer, wine, and liquor stores
  • Consumer goods rental
  • Amusement and recreation services
  • Commercial and industrial machinery and equipment rental and leasing
  • Building materials and supply dealers
